RESOLUTION NO. 11558
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING AND GRANTING EASEMENT TO SDG&E FOR
UNDERGROUND ELECTRIC FACILITIES TO BOYS/GIRLS CLUB
AND AUTHORIZING THE MAYOR TO EXECUTE SAID GRANT OF
EASEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
That the City of Chula Vista does hereby grant certain
easement to San Diego Gas & Electric Company
for underground electric facilities to Boys/Girls Club
a copy of which is attached hereto and by this reference made
a part hereof, the same as though fully set forth herein.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized to execute same
for and on behalf of the City of Chula Vista.

EASEMENT
CITY OF CHULA VISTA, a municipal corporation, (Grantor), for valuable
consideration, grants to SAN DIEGO GAS & ELECTRIC COMPANY, a corporation (Grantee), an
easement and right of way in, upon, over, under and acro~s the lands hereinafter
described, to erect, construct, change the size of, improve, reconstruct, relocate,
repair, maintain and use facilities consisting of underground facilities and
appurtenances for the transmission and distribution of electricity.
The above facilities will be installed at such locations and elevations upon,
along, over and under the hereinafter described easement as Grantee may now or hereafter
deem convenient or necessary. Grantee also has the right of ingress and egress, to,
from and along this easement in, upon, over and across the hereinafter described lands.
Grantee further has the right, but not the duty to clear and keep this easement clear
from explosives, buildings, structures and materials.
The property in which this easement and right of way is hereby granted is
situated in the County of San Diego, State of California, described as follows:
That portion of the West Half of the Northeast Quarter of
Section 90, in Rancho De La Nacion, according to Map thereof No. 166, filed
in the office of the County Recorder of said County of San Diego; described
in a Deed recorded March 23, 1971 at Recorder's File/Page No. 54882, of
Official Records of said County of San Diego.

The easement in the aforesaid lands shall be 10.00 feet in width,
being 5.00 feet measured at right angles, on each side of the following
described center line:
Commencing at the intersection of the center lines of Oleander
Avenue and Redwing Road, as shown on Zenith II Subdivision, according to Map
thereof No. 8331, filed in said County Recorder's Office; thence Easterly along
the prolongation of the center line of said Redwing Road North 720 06' 27"
East, 27.50 feet to a point on the Easterly right-of-way line of Oleander
Avenue; thence Southerly on said right-of-way line South 170 48' 54" East,
4.50 feet to the TRUE POINT OF BEGINNING of the center line herein described;
thence from said TRUE POINT OF BEGINNING North 740 11' 06" East, 45.00 feet;
thence North 860 11' 06" East, 91.00 feet; thence South 660 48' 54" East,
19.39 feet to the beginning of a 25.00 foot radius curve concave
Southwesterly; thence Southeasterly along the arc of said curve through a
central angle of 460 00' 00", a distance of 20.07 feet; thence South 200 48'
54" East, 46.39 feet.
All engineering data and/or legal description(s) for the
location(s) of the facilities in this easement has been furnished to Grantee
by Grantor's Engineer R.C.E. No. 18640. Grantor accepts full responsibility
for the accuracy of such data and descriptions and declares that the
descriptions represent the locations of Grantee's facilities within Grantor's
property as previously agreed upon by Grantor and Grantee.
Grantor agrees that should any changes in grade; realignment of
road, street, or avenue, or relocation of facilities become necessary as a
result of inaccuracies of data furnished by Grantor, such changes,
realignment or relocation shall be immediately remedied by Grantor at
Grantor's sole expense, and upon Grantor's failure to remedy same within 30
days after demand, Grantee shall have the right, but not the duty, to make
such changes, realignments or relocations and Grantor shall promptly pay to
Grantee all reasonable charges thereof.
Grantor shall not erect, place or construct, nor permit to be erected, placed
or constructed, any building or other structure, plant any tree, drill or dig any well,
within this easement.
Grantor shall not increase or decrease the ground surface elevations within
this easement after installation of Grantee's facilities, without prior written consent
of Grantee, which consent shall not unreasonably be withheld.
Grantee shall have the right but not the duty, to trim or remove trees and
brush along or adjacent to this easement and remove roots from within this easement
whenever Grantee deems it necessary. Said right shall not relieve Grantor of the duty
as owner to trim or remove trees and brush to prevent danger or hazard to property or
persons.
CONDUITS CARRY HIGH VOLTAGE ELECTRICAL CONDUCTORS, therefore Grantor shall not
make or allow any excavation or fill to be made within this easement WITHOUT FIRST
NOTIFYING SAN DIEGO GAS & ELECTRIC COMPANY AND OBTAINING PERMISSION.

This easement shall be binding upon and inure to the benefit of successors,
heirs, executors, administrators, permittees, licensees, agents or assigns of Grantor
and Grantee.
