HomeMy WebLinkAboutReso 1983-11494 CHULA VISTA CITY COUNCIL RESOLUTION NO. 11494 (b) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA CONCURRING WITH THE CHULA VISTA REDEVELOPMENT AGENCY'S APPROVAL AND CERTIFICATION OF THE ENVIRONMENTAL IMPACT REPORT ON THE OTAY VALLEY ROAD REDEVELOP- MENT PLAN AND PROJECT AREA WHEREAS, on October 24, 1972 the Chula Vista City Council adopted Ordinance No. 1425 creating the Chula Vista Redevelopment Agency for the pur- pose of pursuin9 redevelopment activities in the community; and WHEREAS, pursuant to Section 33213 of the California Health and Safety Code, the Board of Supervisors of the County of San Diego did on October 18, 1983 adopt Ordinance No. 6676 (New Series) authorizing the City of Chula Vista and the Chula Vista Redevelopment Agency to undertake redevelopment activities within specifically designated unincorporated areas of the County of San Diego contiguous to the City of Chula Vista herein identified as Parcel 2 of the Otay Valley Redevelopment Project Area; and WHEREAS, on January 13, 1983 the City Council further adopted Resolution No. 404 captioned: RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA DESIGNATING A CERTAIN PORTION OF THE OTAY RIVER VALLEY AS A REDEVELOPMENT SURVEY AREA WHEREAS, the Chu 1 a Vista Redeve 1 opment Agency has found and determi ned that the Otay Valley Road Redevelopment Project Area is characterized by the conditions of blight. These conditions represent physical, social, and econo- mic liabilities which require a redevelopment plan in order to properly pro- vide for the development of these properties in a manner which is consistent with, and in the interest of, general welfare. In addition, the Redevelopment Plan shall be a guideline to insure that the objectives of the Chula Vista Redevelopment Agency, the Chula Vista City Council, the Board of Supervisors of the County of San Di ego, and the 1 aws of the State of Cali forn i a are complied with and implemented in a manner which is most in keeping with the general welfare; and WHEREAS, the Chula Vista Redevelopment Agency has prepared a proposed Redevelopment Plan for the Otay Valley Road Redevelopment Project Area pur- suant to the direction of the Chula Vista Redevelopment Agency; and WHEREAS, on October 26, 1983 the Agency filed a Notice of Completion and forwarded the Draft EIR to the State Clearinghouse for distribution to those agencies which have jurisdiction by law with respect to the Project, and to other interested persons and agencies and sought the comments of such persons and agencies; and WHEREAS, the Draft ErR was thereafter revised and supplemented to adopt changes suggested, to incorporate comments received and the Agency's response to said comments, and as so revised and supplemented, a Final EIR was prepared and submitted to the City Council of the City of Chula Vista; and WHEREAS, the Environmental Impact Report for the Otay Valley Road Redeve lopment PI an has been prepared and c i rcu I ated for comment pursuant to the California Environmental Quality Act (UCEQAU) and State and local regula- tions and guidelines adopted pursuant thereto; and WHEREAS, a jOint public hearing was held by the Agency and the City Council on December 20, 1983, on the Redevelopment Plan and the Final ErR relating thereto, following notice duly and regularly given as required by law, and all interested persons expressing a desire to comment thereon or object thereto having been heard, and said Final ErR and all comments and responses thereto having been considered; and WHEREAS, the Final EIR consists of the Draft EIR, as revised and supple- mented, is made a part of the Agency's Report on the Redevelopment Plan, incorporating all comments received and the response of the Agency and the City Council thereto as of the date hereof; and WHEREAS, on December 20, 1983 the Chula Vista Redevelopment Agency approved and certified the Environmental Impact Report on the Otay Valley Road Redevelopment Plan and Project Area by Resolution No. 468 , said resolution having been received by the City Council. NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CITY COUNCIL OF THE CITY OF CHUlA VISTA, AS FOllOWS: Section 1. The City Council of the City of Chula Vista hereby further finds and determines as follows with respect to the adverse environmental impacts detailed in the final Environmental Impact Report: a) That the adverse environmental impacts of the Redevelopment Plan and Project Area set forth in the Environmental Impact Report including those raised in comments to the draft Environmental Impact Report have been considered and recognized by the Chula Vista Redevelopment Agency. b) That none of said adverse impacts after mitigation will have a significant effect or result in a substantial, or potentially substantial, adverse change in the environment. R- 11494 A-Ilr,,,, c) The City Council hereby makes the written finding set forth in Exhibit A, attached hereto and incorporated by reference herein, for each of the significant effects set forth in said Exhibit A, and further approves the statement of facts set forth in said Exhibit A. Based on such findings and statement of facts, the Agency hereby finds that significant environmental effects have been reduced to an acceptable level in that all significant environmenta 1 effects have been e1 iminated or substant i ally lessened. Based on the foregoing, the Agency finds and determines that the Otay Vall ey Road Redevelopment Project wi 11 not have a significant effect upon the environment. d) That as to those adverse environmental impacts of the Redevelopment P1 an and Project Area wh ich cannot be ent i re 1y mit igated, the public safety and general welfare could best be served by the adop- tion of the Redevelopment Plan and Project Area set forth in detail in the final Environmental Impact Report. e) In the event it is determined that significant environmental effects are not mitigated or substantially lessened, the City Counci 1 hereby finds that, based on the Final EIR and/or other i nformat ion conta i ned in the record, its act ion to approve and carr y out the Redeve I opment PI an is supported because the Redevelopment Plan wi 11: 1) correct physical and environmental deficiencies in the Project Area; 2) eliminate blighting influences in the Project Area; 3) improve infrastructure and circulation in the Project Area; 4) cause the installation, construction, or replacement of presently inadequate or deteriorating public improvements; 5) cause the development and/or improvement of housing for persons and families of low or moderate income; 6) assemble land into parcels suitable for modern, integrated commer- cial and industrial development; 7) replan, redesign, and develop undeveloped areas which are stagnant or improperly utilized; 8) strengthen the economic and commercial/industrial base of the Project Area and the community, thereby stimulating employment and economic growth; and 9) provide adequate land for park and open spaces. TED City Clerk (seal) ;-660 EXHIBIT A FINDINGS ON SIGNIFICANT EFFECTS Description of significant effect: Traffic circulation and access will be significantly effected by anticipated street widening, and public improvement projects with increased, industrial and residential development in the Project Area and surrounding region. The Agency finds that as to such significant effect identified above: [X] Changes or alterations have been required in, or incorporated into, the project which mitigate or avoid the significant environmental effects thereof as identified in the Final EIR. [] Such changes or alterations are within the responsibility and jurisdiction of another public agency and not the agency making the fi ndi ng. Such changes have been adopted by such other agency or can and should be adopted by such other agency. [] Specific economic, social, or other considerations make infeasible the mitigation measures or project alternatives identified in the Final EIR. The facts supporting such findings are as follows: 1) The projects ant i c i pated under the Redeve I opment PI an are a measure of mitigation to alleviate current circulation deficiencies and hazards which characterize the Otay Valley Road and Project Area. I?-//~' , 2) All street widening and improvement projects anticipated are in com- pliance with the City of Chula Vista and County of San Diego Master Plan of Streets and Highways. 3) Future increases in traffic volume will be monitored and mitigated through street widening, intersection signalization, and review of indi- vidual development projects with consideration for needed street improve- ments. These findings are supported by substantial evidence in the record of the pro- ceedings before the Agency. /.(-/IYF" EXHIBIT A FINDINGS ON SIGNIFICANT EFFECTS Description of significant effect: Implementation of the Redevelopment Plan will result in significant visual changes in character of the Project Area resulting from the improvement of existing deteriorating conditions and essential infrastructure and will also remove visual open space and vegetation which characterize the area. The Agency finds that as to such significant effect identified above: [X] Changes or alterations have been required in, or incorporated into, the project which mitigate or avoid the significant environmental effects thereof as identified in the Final EIR. [] Such changes or alterations are within the responsibility and jurisdiction of another public agency and not the agency making the finding. Such changes have been adopted by such other agency or can and should be adopted by such other agency. [] Specific economic, social, or other considerations make infeasible the mitigation measures or project alternatives identified in the Final EIR. The facts supporting such findings are as follows: 1) Projects anticipated under the Redevelopment Plan are measures of mitiga- tion to alleviate adverse visual conditions associated with deteriorating conditions of existing industrial uses, underutilized properties and vacant parcels used as dumping grounds. I?-I/f"~ 2) Loss of visual open space quality can be partially mitigated by planting new vegetation, requiring setback and reviewing site design of all future industrial projects to ensure visual corridors and open areas are encouraged to maintain open space qualities existing in vacant areas. 3) Utilize site design and Precise Plan mechanisms to encourage open space and visual corridors. 4) All future development and anticipated projects will be carried out in compliance with all applicable General Plan and Specific Plans and are necessary to eliminate factors of neglect, which create the visual blight existing. These findings are supported by substantial evidence in the record of the pro- ceedings before the Agency. /P-/I Yf~ EXHIBIT A FINDINGS ON SIGNIFICANT EFFECTS Description of significant effect: Implementation of the Redevelopment Plan and future development associated with the Project Area will significantly increase the demand for sewer dispo- sal service and may even surpass current capacity levels of the existing transport system with only a significant incremental effect on capabilities of treatment facilities. The Agency finds that as to such significant effect identified above: [X] Changes or alterations have been required in, or incorporated into, the project which mitigate or avoid the significant environmental effects thereof as identified in the Final EIR. [] Such changes or alterations are within the responsibil ity and jurisdiction of another public agency and not the agency making the finding. Such changes have been adopted by such other agency or can and should be adopted by such other agency. [] Specific economic, social, or other considerations make infeasible. the mitigation measures or project alternatives identified in the Final EIR. The facts supporting such findings are as follows: 1) Off-site uti lity improvements anticipated among the Redevelopment Projects List wi 11 serve to meet increased demands from future develop- ment thus providing partial mitigation of service capacity limitations. ~-II Y?Y 2) This City will seek to provide additional sewer mains capacity to service the Project Area by either seek ing ways to fund such improvement when determined necessary or by cooperating with other public agencies to uti- lize increased service capacity available under other improvement pro- jects. 3) All revitalization, redevelopment and new development will be conditioned to conform to the Regional and City Sewer Master Plan.
