HomeMy WebLinkAboutReso 1983-11493 CHULA VISTA CITY COUNCIL RESOLUTION NO. 11493 (a) A RESOLUTION OF THE CHULA VISTA CITY COUNCIL FINOING THAT THE USE OF TAXES ALLOCATEO FROM THE OTAY VALLEY ROAD REDEVELOPMENT PROJECT AREA FOR THE PURPOSE OF IMPROVING AND INCREASING THE COMMUNITY'S SUPPLY OF LOW- ANO MODERATE-INCOME HOUSING OUTSIDE THE PROJECT AREA WILL BE OF BENEFIT TO THE PROJECT AREA WHEREAS, pursuant to Section 33213 of the California Health and Safety Code, the Board of Supervisors of the County of San Diego did on October 18, 1983 adopt Ordinance No. 6676 (New Series) authorizing the City of Chula Vista and the Chula Vista Redevelopment Agency to undertake redevelopment activities within specifically designated unincorporated areas of the County of San Diego contiguous to the City of Chula Vista herein identified as Parcel 2 of the Otay Valley Redevelopment Project Area; and WHEREAS, Section 33334.2 (a) of the California Health and Safety Code provides that not less than 20 percent of all taxes which are allocated to the Chula Vista Redevelopment Agency shall be used by the Agency for the purpose of increasing and improving the community's supply of "low- and moderate- income housing" available at affordable housing cost to persons and families of low or moderate income, and very low-income households unless one of the following findings is made: 1) That no need exists in the community, the provision of which would benefit the Project Area to improve or increase the supply of low- and moderate-income housing; or 2) That some stated percentage less than 20 percent of the taxes which are allocated to the Agency pursuant to Section 33670 is sufficient to meet such housing need; or 3) That a substantial effort to meet low- and moderate-income housing needs in the community is being made and that this effort, including the obligation of funds currently available for the bene- fit of the community from state, local, and federal sources for low- and moderate-income housing, alone or in combination with the taxes allocated under this Section, is equivalent in impact to the funds otherwise required to be set aside pursuant to this Section. The legislative body shall consider the need that can be reasonably foreseen because of displacement of persons and families of low or moderate income or very low-income households from within or adja- cent to the Project Area because of increased employment oppor- tunities or because of any other direct or indirect result of implementation of the Redevelopment Plan. WHEREAS, Section 700.33 of the Otay Valley Road Redevelopment Plan provi- des for such allocation of taxes; and WHEREAS, Section 33334.2 (g) of the California Health and Safety Code states that the Chula Vista Redevelopment Agency may use these funds inside or outside the Project Area if, by resolution of the Agency and City Council, it is found that such funds and the provision of low- and moderate-income housing the Project Area will be of benefit to the Project Area. NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CHULA VISTA CITY COUNCIL, AS FOLLOWS: 1) The City Counci 1 hereby finds that the use of funds pursuant to Section 33334.2 (a) of the California Health and Safety Code and the provision of low- and moderate-income housing outside the Project Area, and/or the replacement of housing to be placed out- side the Project Area, if necessary, will be of benefit to the Otay Valley Road Redevelopment Project Area. 2) This determination of the City Council along with that of the Chula Vista Redevelopment Agency shall be final and conclusive as to the issue of benefit to the Project Area. 3) The City Council hereby acknowledges the adoption of a similar finding of benefit relative to the use of funds outside the Project Area for the provision of low- and moderate-income housing by the Chula Vista Redevelopment Agency.
