RESOLUTION NO. 11817
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA REVISING CONDITION NO~ 17 FOR CHARTER POINT
SUBDIVISION AND CONDITION NO. 6 FOR TELEGRAPH POINT
SUBDIVISION
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the development of prop~ty adjacent to Tele-
graph Canyon Road provides an opportunity for the improvement of
Telegraph Canyon Road in a manner consistent with its ultimate
improvement, and
WHEREAS, Condition No. 17 for the Charter Point Subdivi-
sion required that Telegraph Canyon Road be temporarily improved,
and
WHEREAS, Condition No. 6 of Telegraph Point Subdivision
required a similar type of improvement for Telegraph Canyon Road,
and
WHEREAS, the City Engineer has discussed with the
developers of EastLake, the Gersten Companies and Pacific Scene,
the ultimate improvement of Telegraph Canyon Road, and
WHEREAS, Charter Point Subdivision and Telegraph Point
Subdivision are currently under construction or about to be
constructed.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby amend Condition NO. 17 for the
Charter Point Subdivision to read as follows:
The developer shall construct four-lane street improve-
ments in front of their development and Pacific Tele-
phone's property to include full intersection with Otay
Lakes Road and approved transitions on each side of the
development. Improvements shall include a ten foot wide
parkway on the north side with a five foot sidewalk and
other improvements as proposed; thirty-two feet of
pavement on the north side of the median island, sixteen
foot wide raised landscaped median island, and thirty
foot pavement south of the median island with a five foot
parkway. The developer shall be responsible for
acquiring any additional right of way necessary for this
work including slope easements on the property on the
south.

BE IT FURTHER RESOLVED that Condition No. 6 of the Plan-
ning Commission Resolution accompanying City Council Resolution
No. 10767 (Telegraph Point Subdivision) shall be amended in a
manner consistent with Condition NO. 17 of the Charter Point
Subdivision. In addition, Telegraph Point Subdivision will be
required to improve the intersection of Otay Lakes Road with
Telegraph Canyon Road easterly to the intersection of Rutgers
Avenue. Said improvements which shall be the same as those for
Charter Point and the developer will be required to obtain the
necessary right of way.
