HomeMy WebLinkAboutReso 1984-11815 RESOLUTION NO. 11815 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA EXPRESSING ITS OPPOSITION TO PROPOSITION 36 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Proposition 36 would exacerbate the unequal taxation between pre-1978 property owners and post-1978 property owners by refunding a portion of the taxes collected for 1975-77 for pre-1978 owners while raising the taxes of post-1978 owners to cover resulting shortages in debt service funds, and WHEREAS, Proposition 36, due to its fee limitations, may affect the ability of government agencies to sell revenue bonds to construct necessary improvements because investors typically require evidence that an agency issuing bonds has the power to raise fees as necessary to payoff the bonds, and WHEREAS, proposition 36 would result in a further shift of power away from local control of local affairs to state control because it would cost local governments and school districts ap- proximately 2.3 billion during its first year leading to the spec- tre of another state "bailout" to maintain local services, and WHEREAS, proposition 36 would limit the ability of the City to establish benefit assessment districts to provide services such as flood control, street lights and fire protection even where the majority of the local residents support these districts, and WHEREAS, proposition 36 will impair the ability of local government to require that people who directly benefit from services pay their cost and thereby shift the cost of services to the general taxpayers, and WHEREAS, proposition 36 will impair the ability of local government to require that future development pay its own way thereby shifting the costs associated with future development to present residents of the City, and WHEREAS, proposition 36 purports to be retroactive which raises a great number of legal issues with regard to the validity of contracts entered into in the past insuring a period of con- fusion and litigation to clarify the rights of parties to these contracts. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula vista does hereby oppose Proposition 36.
