RESOLUTION NO. 11795
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND ANTHONY CIOTTI FOR SERVICES RELATIVE TO
THE CITY'S COMMUNITY HOUSING IMPROVEMENT PROGRAM
(CHIP) FOR 1984-85
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that that certain agreement between THE CITY
OF CHULA VISTA, a municipal corporation, and ANTHONY CIOTTI, for
services relative to the City's Community Housing Improvement
Program (CHIP) for 1984-85
dated the 23rd day of October , 1984, a copy of Which is
attached hereto and incorporated herein, the same as though fully
set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized and directed to
execute said agreement for and on behalf of the City of Chula
Vista.

AGREEMENT
THIS AGREEMENT is made
(hereinafter called the "CITY")
"REHABILITATION CONSULTANT").
by and between the City of Chula Vista
and Anthony Ciotti (hereinafter called
RECITALS

WHEREAS, the City desires to retain Rehabilitation Consultant in
connection with the implementation of Community Housing Improvement Program
(hereinafter called "CHIP") and the proposed Rental Rehabilitation Program, as
financed from the Community Development Block Grant Program of the Federal
Government; and,
WHEREAS, Rehabilitation Consultant is ready, willing and able to
provide such expertise to further the CHIP program,
NOW, THEREFORE, BE IT RESOLVED that the parties agree as follows:
1. The above recitals are incorporated herein as if set out in full.
2. The City agrees to retain Rehabilitation Consultant for services
connected with the CHIP program and proposed Rental Rehabilitation program as
described herein.
3. Rehabilitation Consultant shall perform those administrative
services relating to the City's CHIP program and proposed Rental
Rehabilitation Program, including but not limited to as-required day-to-day
consultation with the Housing Rehabilitation Inspector, officials of the
Bu ilding and Hous ing Department and Commun ity Development Department;
promoting the programs in designated neighborhoods of the City, meeting and
participating in negotiations with property owners and the designated
financial institutions including Fund Control institutions; providing
counseling services to property owners with regard to the programs; recommend
and make changes to the CHIP manual as approved by either City Councilor City
CHIP Loan Committee; determine eligibility of homeowner, lender, contractor,
fund control and various City agencies to expedite rehabilitation process;
present loan package requests to City Loan Committee or Trailer Loan Committee
for approval; act as recorder for City Loan Committee and Trailer Loan
Committee; perform final inspection for fund release in all rehabilitation
work.
4. All services performed by Rehabilitation Consultant shall be
conducted in connection with and under the supervision of the Director of
Community Development.
5. Rehabilitation Consultant shall be paid the sum of $ 1 854 per
month, reflecting a 5 % cost of living adjustment, due and payabie on the
first of each month Tor the services provided pursuant to th is agreement
crunmencing July 6, 1984 and terminating July 4, 1985 unless otherwise agreed
1 to extend by mutual consent of both the Rehabilitation Consultant and the

City Council. Rehabilitation Consultant shall also be reimbursed for
'lecessary out-of-pocket expense such as travel in connection with the duties
Jreviously described. Rehabilitation Consultant shall not undertake City
expense out-of-town (Chula Vista/San Diego area) travel without prior approval
of the City Community Development Director.
6. Rehabilitation Consultant shall submit a bi-weekly statement to
the Community Development Director detailing the actual number of hours worked
and a month ly statement to the Commun ity Development Director deta i 1 ing the
services performed. The Community Development Director shall review these
statements prior to authorizing monthly payment. It is the expectation of the
City that the Rehabilitation Consultant will work a minimum of 1600 hours
annually. The Community Development Director will quarterly evaluate the
number of hours worked by the Rehabi 1 itat ion Consu ltant and sha 11 report
significant deficiencies to the City Council with recommendations regarding
termination of contract.
7. Rehabilitation Consultant shall notify Community Development
Director in writing of any proposed absence exceeding eight (8) consecutive
working hours. If unexpected absences due to illness occur, Rehabilitation
Consultant shall notify Community Development Director as soon as possible.
8. This Agreement is subject to unilaterial termination by either
the Rehabilitation Consultant or the City Council by 30-day written notice.
IN WITNESS WHEREOF this Agreement is executed this 23rd day of
October 1984.
