HomeMy WebLinkAboutReso 2005-137 RESOLUTION NO. 2005-137 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING A FOUR-PARTY AGREEMENT BETWEEN THE CITY OF CHULA VISTA, DUDEK AND ASSOCIATES (CONSULTANT), K. HOVNANIAN AT BELLA LAGO, LLC, AND BELLA LAGO, LLC (APPLICANT), FOR BIOLOGICAL MITIGATION MONITORING AND ENVIRONMENTAL SERVICES TO BE RENDERED FOR THE BELLA LAGO TENTATIVE TRACT MAP AND PRECISE PLAN FINAL ENVIRONMENTAL IMPACT REPORT, AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT WHEREAS, on April 8, 2003, the City Council certified Final Environmental Impact Report (FEIR-02-05) and adopted the accompanying Mitigation Monitoring and Reporting Program (MMRP); and WHEREAS, the implementation of the MMRP(s) and project Area Specific Management Directives (ASMDs) necessitates the expertise of an Environmental Monitor Specialist (biological) and requires the hiring of a consultant; and WHEREAS, it was determined by the Director of Planning and Building that staff has neither the available time or expertise to perform the subject work; and WHEREAS, the applicant has deposited or will deposit funds necessary for the biological mitigation monitoring services; and WHEREAS, a request for proposal was distributed to three qualified consulting firms in accordance with the City's informal bidding process, and two proposals were received by the City that were responsive to the request; and WHEREAS, the City is in immediate need of an experienced California Environmental Quality Act (CEQA) consultant that is familiar with the City's policies and procedures; and WHEREAS, the Consultant is uniquely qualified to serve as the Consultant for this project based on their projects ofa similar nature, their knowledge of the City's Multiple Species Conservation Program (MSCP) Subarea Plan, their experience with the resource agencies, their grasp ofthe project's complexities, and the firm's project experience within this region; and WHEREAS, the Environmental Review Coordinator has negotiated the details of this agreement in accordance with procedures set forth in Section 6.5.2 of the Environmental Review Procedures; and WHEREAS, the proposed contract with Dudek to provide biological mitigation monitoring services would be in an amount not to exceed $46,585. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve a three-party agreement between the City of Chula Vista, Dudek and Associates ("Consultant"), K. Hovnanian at Bella Lago, LLC, and Bella Lago, LLC Resolution 2005- 137 Page 2 ("Applicant") for consulting services related to biological mItigation monitoring and environmental services for the Bella Lago Tentative Tract Map and Precise Plan. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista is hereby authorized and directed to execute said agreement on behalf of the City of Chula Vista.
