RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA AUTHORIZING THE DESTRUCTION OF COUNCIL MEETING
TAPES FROM 1973 THROUGH 1978
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, there are approximately 200 tapes of City
Council meetings from 1973 through 1978 which are being kept in
the City Clerk's files, and
WHEREAS, a survey of other cities in the County along
with the State City Clerks' Organization indicate there is no set
rule for the preservation of tapes by the various cities, and
WHEREAS, since the tapes are being used as public
records, the City Attorney has issued an opinlon that destruction
in accordance with Government Code Section 34090 et seq. may be
authorized by Council.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby authorize the destruction of
City Council meeting tapes from 1973 through 1978.

Destruction of City Council Meeting Tapes

SUBJECT:
This office has reviewed the request from the City Clerk for
destruction of Council meeting tapes from 1973 through 1978.
There is no requirement under the law that we retain these tapes
and Government Code Section 34090 describes the procedure by which
we may destroy these no longer needed records. It requires
written consent by the City Attorney and approval by the City
Council. By this writing, the City Attorney consents to the
destruction of the tapes.
