RESOLUTION NO. 11858
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA INITIATING THE "BROADWAY/PALOMAR STREET
REORGANIZATION" INVOLVING ANNEXATION OF APPROXIMATELY
23 ACRES OF UNINHABITED TERRITORY TO THE CITY OF CHULA
VISTA, AND CONCURRENT DETACHMENTS FROM THE MONTGOMERY
FIRE PROTECTION DISTRICT, MONTGOMERY SANITATION DISTRICT,
THE SAN DIEGO COUNTY FLOOD CONTROL DISTRICT-ZONES 3 AND
4, AND COUNTY SERVICE AREA NO. 62-MONTGOMERY PURSUANT TO
THE PROVISIONS OF THE DISTRICT REORGANIZATION ACT OF 1965
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City of Chula Vista desires to initiate a
reorganization of certain territory in the unincorporated area of
the County of San Diego pursuant to the District Reorganization
Act of the Government Code, Division 1, Chapter 2, Article 1
Section 56140, et seq., and
WHEREAS, the proposed change of organization would
involve the annexation of approximately 23 acres of uninhabited
territory to the City of Chula Vista and concurrent detachments
from the Montgomery Fire Protection District, Montgomery Sanitary
District, the San Diego County Flood Control District-Zones 3 and
4, and County Service Area No. 62-Montgomery, and
WHEREAS, the exterior boundaries of the proposed annexa-
tion are shown on Exhibit A and further described on Exhibit B,
and
WHEREAS, the City Council adopted Resolution No. 11851
authorizing the payment of all annextion fees on behalf of Sunbelt
Holdings, Inc. in order to expedite the application process
through LAFCO, and
WHEREAS, the subject area is contiguous to the City
boundary on two sides, is comprised of five parcels of land and
the adjoining street rights-of-way, and
WHEREAS, the City's Environmental Review Coordinator has
reviewed the proposed reorganization and has determined that
annexation of the existing commercial development would not
require environmental review and, therefore, would be exempt
therefrom.

NOW, THEREFORE BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby adopt the resolution of
application initiating the proposed "Broadway/Palomar Street
Reorganization" and requests that proceedings be taken for the
proposed reorganization.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista is hereby authorized to sign all applicable annexation
application forms for submittal to LAFCO.

EXHIBIT B
Those portions of Fractional Quarter Section 167 of Rancho de la Nacion
according to Map thereof No. 166, recorded in the Office of the County
Recorder, San Diego County, State of California, May 11, 1869, and Fractional
Section 15 of Township 18 South, Range 2 West, San Bernardino Meridian,
described as follows:
Beginning at the northwest corner of Parcel 3 of Parcel Map No. 3634 filed in
sai d County Recorder's Office on March 20, 1975, al so bei ng a poi nt on the
southerly right-of-way line of Oxford Street, an 80-foot-wide street;
1. Thence easterly along sai d southerly li ne N71035'25" E, 850 feet to its
projected intersection wi th the easterly 1 i ne of Broadway (fonnerly
National Avenue) 100 feet wide, as shown on Road Survey 1511 on file in
the County Engineer's Office of said San Diego County;
2. Thence southerly along said easterly line and its projection to its
i ntersecti on wi th the southerly ri ght-of-way 1 i ne of Palomar Street, 80
feet wide as shown on Road Survey 1370 on file in said County Engineer's
Office.
3. Thence conti nui ng southerly along sai d easterly li ne a di stance of 11.00
feet;
4. Thence 1 eavi ng sai d easterly ri ght-of-way li ne of Broadway westerly on a
line parallel to and 51 feet south of the centerline of said Palomar
Street a di stance of 99.23 feet to a poi nt of tangency of a 251.00 foot
radius curve concave northerly;
5. Thence along said curve through a central angle of 24°51'00", a distance
of 108.86 feet to a tangent line, also being the southerly right-of-way
line of said Palomar Street;

7. Thence N1S022' OO"W, 23.16 feet to a poi nt on the southerly ri ght-of-way
line of said Road Survey 1370;
S. Thence westerly along said southerly line to its intersection with the
