HomeMy WebLinkAboutReso 1984-11858 RESOLUTION NO. 11858 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA INITIATING THE "BROADWAY/PALOMAR STREET REORGANIZATION" INVOLVING ANNEXATION OF APPROXIMATELY 23 ACRES OF UNINHABITED TERRITORY TO THE CITY OF CHULA VISTA, AND CONCURRENT DETACHMENTS FROM THE MONTGOMERY FIRE PROTECTION DISTRICT, MONTGOMERY SANITATION DISTRICT, THE SAN DIEGO COUNTY FLOOD CONTROL DISTRICT-ZONES 3 AND 4, AND COUNTY SERVICE AREA NO. 62-MONTGOMERY PURSUANT TO THE PROVISIONS OF THE DISTRICT REORGANIZATION ACT OF 1965 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City of Chula Vista desires to initiate a reorganization of certain territory in the unincorporated area of the County of San Diego pursuant to the District Reorganization Act of the Government Code, Division 1, Chapter 2, Article 1 Section 56140, et seq., and WHEREAS, the proposed change of organization would involve the annexation of approximately 23 acres of uninhabited territory to the City of Chula Vista and concurrent detachments from the Montgomery Fire Protection District, Montgomery Sanitary District, the San Diego County Flood Control District-Zones 3 and 4, and County Service Area No. 62-Montgomery, and WHEREAS, the exterior boundaries of the proposed annexa- tion are shown on Exhibit A and further described on Exhibit B, and WHEREAS, the City Council adopted Resolution No. 11851 authorizing the payment of all annextion fees on behalf of Sunbelt Holdings, Inc. in order to expedite the application process through LAFCO, and WHEREAS, the subject area is contiguous to the City boundary on two sides, is comprised of five parcels of land and the adjoining street rights-of-way, and WHEREAS, the City's Environmental Review Coordinator has reviewed the proposed reorganization and has determined that annexation of the existing commercial development would not require environmental review and, therefore, would be exempt therefrom. -1- -£- NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Chula Vista does hereby adopt the resolution of application initiating the proposed "Broadway/Palomar Street Reorganization" and requests that proceedings be taken for the proposed reorganization. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista is hereby authorized to sign all applicable annexation application forms for submittal to LAFCO.
