RESOLUTION NO. 11765
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING AMENDED AGREEMENT WITH MARWAN A. YOUNIS,
CONTRACT ENGINEER, FOR WORK IN THE LAND DEVELOPMENT
DIVISION OF THE ENGINEERING DEPARMENT, AND AUTHORIZING
THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, on July 3, 1984, Council approved an agreement
for a contract engineer to work in the Land Development Division
of the Engineering Department, and
WHEREAS, due to work load changes and personnel turnover,
it has becane necessary that the agreement be IIDdified to include
overtime compensation.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby approve that certain Amended
Agreement with Marwan A. Younis, contract engineer, for work in
the Land Development Division of the Engineering Department, a
copy of which is attached hereto and incorporated herein by
reference as if set forth in full.

PERSONAL SERVICES AGREEMENT
-·THIS AGREEMENT is made at Chula Vista, California, as of July 6, 1984, and as amended on
September 18, 1984, by and between the CITY OF CHULA VISTA, a municipal corporation
( "C ity") and MARWAN YOUNIS ("Contractor"), who agree as fo llows:
1.
Subject to the terms and condit ions set forth in th is Agreement, Contractor sha 11
provide to the City the services described in Exhibit A, which is, by this
reference, incorporated herein. Contractor shall provide said services at the time,
place, and in the manner specified in Exhibit A.
Payment. City shall pay contractor at the rate of $15.00 per hour for services
rendered pursuant to this Agreement within the hours described in attached Exhibit A
not exceeding 40 hours per week. For hours worked in excess of 40 hours per week,
the rate of compensation shall be $21.00 per hour. Said amount shall be the total
compensation paid for work performed under this Agreement.
Contractor shall provide City with a weekly statement of the total hours worked
pursuant to this Agreement. Compensation for said hours shall be paid bi-weekly.

Exemption from Civil Service. It is expressly agreed and understood by City and
Contractor that thlS Agreement and the rendition of services hereunder is
specifically exempted from Civil Service of the City of Chula Vista. The parties to
th is Agreement agree that Contractor is a professional person, in business for
himself, and that the relation created by this contract is that of
employer-independent contractor. Contractor is not an agent or employee of the City
and is not entitled to the benefits provided by the City to its employees, including
but not limted to health insurance and unemployment insurance.
General Provisions.

(a) Except as otherwise provided in Exhibit A, this contract shall be based on the
performance of the Contractor to the satisfaction of the City Engineer.
(b) This Agreement shall commence on the date first stated above and shall continue
thereafter until June 30, 1985.
(c) This Agreement may be terminated by City or by Contractor upon 30 days written
notice to the other party.

EXHIBIT "A"
SCOPE OF WORK
It is intended that the Contractor apply his full time to the expeditious implementation
and processing of plans, calculations, improvements for subdivisions, and other
professional and technical duties.
:ontractor shall:
1. Be available for work from 8:00 a.m. through 5:00 p.m., Monday through Friday
each week, holidays excepted, at the City of Chula Vista En~ineering Department
Office, or at such other suitable place designated by the Clty Engineer. These
hours are for purposes of establishing availability and shall not be considered
limiting as to the number of hours which contractor may work on any individual
day.
2. Review maps and plans for subdivisions and subdivision improvements submitted
to the City of Chula Vista, to insure compliance with City specifications,
policies and procedures, and special conditions applied at the tentative map
and planned development stages.
3. Review maps and plans and calculations for subdivisions and subdivision
improvements in order to evaluate their adequacy and accuracy and the
application of sound engineering judgment. Subdivision improvement plans
include, but are not limited to, drainage, sanitary sewers, pump stations,
streets, grading, landscaping, and lighting.
