Home My WebLink AboutReso 1984-11760 RESOLUTION NO. 11760 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHUIA VISTA ORDERING THE SUMMARY VACATION OF THE PORTION OF "K" STREET WEST OF BAY BOULEVARD TO THE SAN DIEGO & ARIZONA EASTERN RAILWAY (CORONADO BRANCH) RIGHT OF WAY The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Ratner Development Company, owner property along the west side of Bay Boulevard between "J" Streets proposes to develop said land, and of and the ilL I! WHEREAS, in order to fully utilize the property, Ratner has requested that the City vacate the portion of "K" Street which lies within it, and WHEREAS, Chapter 4, Article 1, Section 8331 of the Streets and Highways Code permits the legislative body of a local agency to summarily vacate a street or portion thereof which has been impassable for vehicular travel or has not been maintained by public money expenditures for a period of five consecutive years, and WHEREAS, this portion of "K" Street is a "paper street" and is not improved and research reveals that the right of way has never been used for vehicular travel. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby order the summary vacation of the portion of "K" Street west of Bay Boulevard to the San Diego & Arizona Eastern Railway (Coronado Branch) right of way.
