RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND PONDEROSA HOMES FOR PERPETUAL MAINTENANCE
AND OPERATION OF A SEWAGE LIFT STATION IN RANCHO
ROBINHOOD III SUBDIVISION
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that that certain agreement between THE CITY
OF CHULA VISTA, a municipal corporation, and PONDEROSA HOMES, a
California General Partnership, for perpetual maintenance and
operation of a sewage lift station in Rancho Robinhood III
Subdivision
dated the 11 th day of September , 1984, a copy of which is
attached hereto and incorporated herein, the same as though fully
set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized and directed to
execute said agreement for and on behalf of the City of Chula
Vista.

PONDEROSA HOMES WHEREBY PONDEROSA HOMES AGREES
TO PAY THE CITY $34,000 TO RELIEVE IT OF ITS
RESPONSIBILITY FOR THE OPERATION AND MAINTENANCE
OF A SEWAGE LIFT STATION IN RANCHO ROBINHOOD UNIT 3
THIS AGREEMENT, made and entered into this 11th day of
September, 1984, by and between THE CITY OF CHUIA VISTA, a
municipal corporation, hereinafter called "City" and PONDEROSA
HOlolES, a California General Partnership, hereinafter called "Sub-
divider" ¡

'.' WHEREAS, Subdivider's predecessor in interest has
previously entered into an agreement dated May 13, 1977 with the
City of Chula Vista whereby it agreed to operate and maintain a
sewer lift station in Rancho Robinhood Unit 3, and
WHEREAS, Subdivider now wishes to be relieved of this
ongoing responsibility, and
WHEREAS, City staff has reviewed the cost of operating and
maintaining said sewer lift station in perpetuity, and

NOW,' THEREFORE, IT IS MUTUALLY UNDERSTOOD AND AGREED AS
FOLLOWS:
1. Subdivider shall pay to the City Thirty Four Thousand
Dollars ($34,000).
2. City shall relieve the Subdivider of any responsi-
bility for the maintenance and operation of a sewage lift station
in Rancho Robinhood Unit 3.
IN WITNESS WHEREOF, the parties hereto have caused this
.agreement to be executed the day and year first hereinabove set
forth.
