RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA CONSENTING TO NEGOTIATE WITH THE COUNTY OF SAN
DIEGO OUTSIDE THE BOUNDS OF THE MASTER PROPERTY TAX
EXC~GE AGREEMENT FOR THE PROPOSED LOWER SWEETWATER
REORGANIZATION
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Revenue and Taxation Code Section 99 requires
the negotiation of any exchange of property tax revenues
occasioned by jurisdictional changes between the areas affected,
and
WHEREAS, the City Council on April 7, 1981 adopted
Resolution No. 10429 approving an agreement between the City of
Chula Vista and the County of San Diego, a political sUbdivision,
for Master Property Tax Exchange, and
WHEREAS, said Master Property Tax Exchange Agreement
signed by the City of Chula Vista and the County of San Diego
states that by mutual consent of both the County and City, a
property tax exchange for jurisdictional changes can be negotiated
outside the bounds of the Master Agreement, and
WHEREAS, there are unusual circumstances regarding this
jurisdictional change, and
WHEREAS, the City of Chula Vista has had preliminary
negotiations with the County of San Diego to determine an
equitable exchange of property tax revenue applicable to the
proposed Lower Sweetwater Reorganization.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby consent to negotiate with the
County of San Diego outside the bounds of the Master Property Tax
Agreement for the proposed Lower Sweetwater Reorganization.
BE IT FURTHER RESOLVED that the City Clerk be, and she is
hereby directed to forward a certified copy of this resolution to
the Local Agency Formation Commission.
