HomeMy WebLinkAboutcc min 1954/07/20 -.. ...:.;.¡'~.< '''~~i'C-·· " ~~".<,.,.-.{ "';"., ;-~~~~ MINUTES OF AN .!'illJOURNED REGULAR MEETING O~ THE CITY COUNCIL OF THE CITY OF Chula Vista, California Held Tuesday July 20, 1954 The City Council met in the Council Chambers at City Hall on the above date at 7:00 P.M., with the following Councilmen present: Councilmen: Rader, Halferty, Riesland, Hobel, DeWolfe Absent: None Also present: City Administrator Floyd, Assistant to the City Engineer Johnson, Cit;y Attorney 11. Campbell Invocation was led by Reverend B. E. Reed ~ndings on 1911 Act 'Iayor Halferty explained that the hearing of protests on the 1911 Act was closed as of the Council meeting held July 13, 1954. However, because of an advertisement inserted in the daily papers by an ano~'IIlous property owner, the public was erroneously advised to be present to protest. Property owners in the district would therefore be again given an opportunity to be heard if they had anything further to add that was not already previously covered. Mayor Halferty added that it is the intention of the Council to visit, as a group, those sites on which protests had been registered, in order to determine whether or not certain changes should be made in the engineering plans for the good of the individuals concerned, as well as the City as a whole. Monday and Tuesday, July 26th and 27th are being set aside for this purpose. L~s. W. H. Farrel, 381 D. Street stated that the main objection was not to the 1911 Act improvements as a whole, but to the manner in which it is being presented to the pubLic. The public has had no time to consider and study the matter. Commander Farrel objected to the presence of an outside attorney on a local matter. He stated that he doesn't want to object to the improvements, but jet to the manner in which the Council is going about it. Every letter of Division 7 of the 1911 Act is being carried out by the Council, but the spirit of presenting it is wrong. Council, he continued, should have gone directly to the people and visited the sites personally before drawing up a Resolution of Intention. Other comments by the people in the audience: 1. Request was made for an explanation of the newspaper item quoting Mayor Halferty as saying that the Council'~ hands are tied. The Mayor answered that, by law, as soon as proceedings are stated by Resolution of Intention the Council must go ahead. 2. Mrs. Little declared that the tax rate for Chula Vista is oVer $7.00 in spite of Oouncilman Hobel's denial at previous public hearing. Mayor Halferty explained that City of Chula Vista tax rate is $1.68, and that the Chula Vista City Council has no control over County, School, and other taxes. 3. In talking with assessment engineer, one property owner got the impression that each property mYner registering protest is counted as one, such as husband and wife. Mayor Halferty answered that he did not know the answer to that. The protestant declared that poor planning is the cause for dissension to the 1911 Act. 4. Are there some properties in district not subject to assessment? Hamilton: All property in district is subject to assessment. All public property except Federal and State owned property is subject to assessment unless City Council decides otherwise. By law, Federal Government property cannot be assessed. In the present case, the Council has decided to assess public property. 5. One property owner would like an explanation as to the extent that corner properties would be assessed, and if adjacent properties would share in assessment of intersections. Hamilton: All properties to be assessed according to benefits received. Council has it within power to elect that intersection assessments be shared on an equitable basis. 6. If the public had known that the 1911 Act assessment was coming up, they would not have voted in additional school bonds and the new Recreational Center Bonds, which were thought necessary at that time for the benefit of all the City. Councilman Rader asked advioe of legal Counsel: Would like to know what the prospects were for reopening the public hearings. He felt that the great majority of the people did not register their protests. Hanilton: Several avenues legally open to Council at this time: 1. They can abandon proceedings in their entirety if, in the opinion of the Council, it is justified. 2. If the City Council desires to substantially change the plans and specifica- tions in some respects, it would be necessary to adopt a new Resolution of Intention and declare new public hearings thereon. 3. If the Council feels it advisable, they have the power to order proceedings exactly as the original Resolution of Intention states 4. The Council can go forward with the present setup, taking up each individual problem, and making changes as work progresses, giving hearings on the changes. Counoilman Rader inquir"d of the attorney if he would advise starting from scratch or leaving it stand as it is, and make changes later. He stated he feels that the major portion of the work should be done, but that the entire program should be stopped at present, in order to give each member an opportunity for personal survey, and come up with a new Resolution. Hamilton replied that he cannot tell (~uncil what to do, only can advise what legal procedures may be taken. Report by Mr. Currie of Currie Engineering Total area within the Assessment District subjeot to assessment is 31,131,860 square feet. The Engineers, after carefully checking all written protests by area concluded that the area represented by protests was 6,577,007 square feet, or 21.126% of the entire area in ~~e District subject to assessment. Mayor Halferty, at this point, declared further comments on 1911 Act will be closed until after balance of items on Agenda are disposed of: ORDINANCE No. 496 - Approving Annexation of Country Club Manor- 2nd reading It was moved by Councilman De';'lolfe, seconded by Councilman Riesland, and carried, that Ordinance No. 496 be placed on its second reading. After the reading of the title, it was moved by Councilman DeWolfe, seconded by Councilman Hiesland, and carried, that the reading of the text be waived and the Ordinance adopted. The Ordinance was adopted by the following vote, to-wit: AYES: Councilmcn Riesland, DeWolfe, Hobel, Rader, Halferty Noes: None Absent: None ORDINANCE No. 495 - Intention to close portion of Guava Avenue-2nd reading It was moved by Councilman Riesland, seconded by Councilman DeWolfe, and carried, that Ordinance 1/0. 495 be placed on its second reading. After the reading of the title, it was moved by Councilman Riesland, seconded by Counoilman DeWolfe, the Ordinanoe was adopted by the follo'iÍng vote, to-wit: AYES: Councilmen Riesland, DeWolfe, !lobel, Rader, Halferty Noes: None Absent: None VREQUE..'3T FOR TAXI...cAB LICENSE - Harmil, Inc. A letter from fIr. Harold Rogers, Harmil, Inc. requesting ten taxi-cab licenses for operation of a taxi company to be known as "Harmil, Inc., dba Chula Vista Chula Vista Cab Company" was read. At this point Mayor Halferty called a ten minute recess in order to get some of the overflow crowd outside, and to inform those outside that the 1911 Act hearings had been closed. The letter from Harmil, Inc. was referred to the City Attorney and the Chief~~olice for further study. No action taken by Council at this time. V"AFPROVAL - Rules & Regulations of Parks & Recreation Commission It was moved by Councilman Hobel, seconded by CounoiL"1Ian Rader, and carried, that the City Council approve the Rules and Regulations set up by the Parks and Reoreation Conmission. ~ APPOINTMENT - Four Planning Commission Members The name of Archie A. Young, 588 National Avenue, Chula Vista was offered by Mayor Halferty as a man he approached, and who expressed a willingness and interest in beooming a Planning Commission L~mber It was moved by Councilman Riesland, seconded by Councilman Rader, and unanimously carried, that the following Planning Commission members be reappointed: C. :1. Farris until 1957 Claude F. Henninger " 1956 Eugene Trook "1956 also, that Archie A. Young be appointed to replace John Smith, and his tenure of office to extend until 1958. ~/ APPOINTMENT of Civil Service Member After reading the names of three prospective members offered at the Council meeting held June 29, 1954, it was moved by Councilman Hobel, seconded by Councilman Rader, and carried, that J. D. Peters be appointed to the Civil Service Commission to replace William Eckhart as City Council representative. Councilman Rader offered the name of Dr. Oren Smith, subject to further questioning as to wi.llingness to serve, to replaoe Col. Dillon on the Civil Service Commission. Councilman DeWolfe suggested that appointment of an additional member to replace Col. Dillon be delayed until the Council had an opportunity to review Council meeting. · , ",. '''N' ."""""'~':''''''''''"''1 ~'APPOINTMENT of Harbor Commission Member Councilman DeWolfe offered the name of Col. Dillon to replace Herbert v. Bryant on the Harbor Commission. It was moved by Councilman Riesland, seconded by Councilman Hobel, and unanimously carried that Col. Dillon be appointed to the Harbor Commission for a full term. ORDINANCE No. 497 - Food Handlers examinations - first reading It was moved by Councilman Riesland, seconded by Councilman DeWolfe, and carried, that the Ordinance be placed on its first reading. It was thereupon read in full. 4. REQUEST - by Chamber of Commerce Mr. ì,alter P. Davis, Secretary of Chula Vista Chamber of Commerce, requested that the first reading of Ordinance amending Ordinances Nos. 370 and 448 covering parking meters be delayed 60 days so that the Chief-of-Police and merchants can determine what to do with the courtesy parking tiokets. It was moved by Councilman Hobel, seconded by Councilman DeWolfe, and Unanimously carried, that the request of the Chamber of Commerce letter dated July 9th be granted, and that the matter be tabled for 60 days. /.,.-/ BELLA VISTA HEIGHTS - Tentative Map It was moved by Councilman Riesland, seconded by Councilman DeWolfe and unanimously carried, that the Tcntative Map of Bella Vista Heights Subdivision be approved, subject to improvements required by Section 7 of the Subdivision Ordinance and heretofore approved by the PlannL~g Commission. V'" OBJECTION - Reinstatement of Harland King on Police Force Jack Murphy, 500 block Parkway, protested the reinstatement of Harland King on the Chula Vista Police Fbrce. In his opinion this matter of King's guilt should have been left up to the grand jury. Things will come to a boiling point when King takes it upon himself to issue so much as a minor traffic violation ticket. Public opinion is against him. The matter of the charges against him have been overlooked, and thus flaunted in the pUblic's face. Does not think a man like that should be on the police force. Mayor Halferty replied that, in accordance with Civil Service rules, the Council had no alternative than to reinstate Harland King. City Attorney M. Campbell added that, if someone should come up with definite evidence and proof were presented, the matter could again be opened up and charges preferred. VADDITIONAL DISCUSSION - on 19l1 Act. Mrs. Rita Smith commented as follows: 1. Such a thing as human feelings should have entered into the proceedings. Complimented one member of Council who apparently feels the needs of the property 01Yners. Some people hcsitated to sign the protests because they were ignorant of the facts. The signs posted around town were not vmrded clearly. Inquired if it were necessary for the gentlemen from Los Angeles to come in to the Council meetings at the expense of taxpayers. Halferty explained that inasmuch as Mr. Hamilton worked on a percentage the cost would be the same whether he came down once or twelve times.' Inquired if any Councilman said that tonight's meeting was a closed meeting. Mayor Halferty answered "no". 2. 3. 4. (Mayor basis, 5. ~'~....-.:.. . ~ "'",.¡.-::.- ...... '. ~"""\"....¡w..\::j'f''''''.>~'.~,..'iW'J1>~ Some inquired as to whether or not each property owner would be contacted personally on the Council's tour next Monday and Tuesday? Mayor Halferty replied that the sites would be visited about which protests were reoeived. Another view expressed was that the people should be contacted personal¡Y and given another chance to send in written protests. A comment was made on the condition of the streets, and inquiry was made as to why they are not kept up by the Street Department, so that repaving would not be required. Mayor Halferty replied that with the limited personnel available and the limited budget amounts, such a program could not be followed. At present, Councilman niesland added, street repairs are costing the City upwards of $50,000. yearly. One member of the audience suggested that the District be divided into small sections and a representative from each section be appointed to meet with the Council. District is too large to hear all sides and problems at one hearing. The point that trees were to be removed at approximately $100. a piece would detract from the beauty of the City. A cOnu:Jent was made regarding the proposed width of iioodlawn Avenue- a forty foot street in one block and sixty foot width in the next block. It was explained by City Administrator Floyd that the railroad company donated land for the widening in that block where street is proposed at sixty foot width. The question was asked as to why the sidewalk could not be extended to the curb on Flower Street off of Fourth Avenue. Diagonal parking at the Junior High School should be continued with indented curb on G. Street, Yfuat is to prevent runoff of water on Second Avenue between D. Street and Chula Vista Streets? ,hat will be done to hold up the sidewalks? 1Vhy ts 31 feet being taken from property owners on one side of street and only 2! feet from other side of street? City Administrator Floyd explained the original subdivider on opposite side of street dedicated the extra footage to the City. Mr..lhrk t~ney, Realtor st~tcd that he believed the trouble lies in the fact that the property ~Nners were not properly informed, and should have means of educating themselves. This might be done through newspaper articles or by means of pamphlets to be tI!Jlde available to the public. Above all people want to know how much it is going to cost them. Councilman Hobel summarized that the cOImnents made by protestants at the Council meeting 'of Jul;r 13th, indicated that they were not made on a common sense basis. People are seeking answers to their questions. Because of noise of crowd, answers could not be given. It is his recommendation that several days - possibly six or seven in a row be given to study on the spot, those areas in District under protest. He believes if people are given the opportunity for a thorough explanation of the 1911 Act, 90% of them would be in favor of it. The people are entitled to know. He recommends that an educational brochure be worked out for distribution to all property owners. l~s. R. v.. Beasley inquired as to when the Council planned on starting on the area south of G. street in order to form another 1911 Act District. Former Planning Commission L!ember Mohr stated that under normal 1911 Act prooedure, smaller districts are formed. Such introduotion does not originate from the Council, but rather from the property owners. Mayor Halferty, in answer to Mrs. Beasley's question regarding the south half of the City in connection with 19l1 Act improvements stated that the City Council plans to institute proceedings immediately on the properties south of G. Street, so that those taxpayers in northern section of City are not burdened ,vith street repairs in southern half of City. City Administrator Floyd suggested that the people would be advised by pamphlet and newspapers, and requested Council to authorize him to put out the literature. Davis, Secretary of the Chamber of Commerce suggested that all property owners in the City be mailed such literature, and offer~d the assistance of the Chamber of Commerce in getting them out. Mr. Davis stated that in figuring bonds for the improvements, a twenty year general bond at the rate of 3% would cost $266 for pavement of 30 feet on a 50 foot lot, including interest and under the 1911 Act similar cost would be $200. lli"TTER - Nell Dunseith - 665 D. Street Councilman Riesland read a letter from Nell Dunseith expressing favor of the 1911 Act. It is pressure such as these that prompted Councilmen to start the proceedings. Attorney Hamilton explained in detail the manner in which the improvements might be paid for. Ray Chalmers, 237 Glover Avenue inquired as to how long improvements would last. Engineer of work Mr. Currie stated fifteen to twenty years. Mrs. Rita smith, 531 Flower street objects to Flower Street being improved. Peter McKiernen, 305 Fourth Avenue asked if ir.1provements on the railroad twenty foot right-of-way adjoining his house would be assessed to the Railway Company. !!llyor Halferty answered in the affirmative. William Slinkard, 374 G. street asked if the 1911 Act program was to be extended south of G. Street. He was told it would. He objected to the tearing up of present streets and sidewalks. Mona Karenburg, 30 F. Street objected to the removing of Pepper trees on F. Street, as property values would be decreased. . ~.,. .' iIc:.~.; There being no other persons desiring to protest, Mayor Halferty asked if anyone present wished to speak in favor of the 1911 Act proceedings. C. H. Farris, 189 Brightwood Avenue was heartily in favor of the 19l1 Aot, stating it was the only V(ay to get the job done. Jack MUrphy, 569 Parkway was in favor of paving Parkway. Albert Sohnepf, 482 D. Street thought the plan was excellent way of getting needed improvements and could not see any reason why the plan should not be successful. Warren Capaoh, 212 Fifth Avenue objeoted to paying again for improvements made just five years ago. Mrs. A. P. Beasley, 432 Parkway asked for a meeting for those who want 1911 Act Improvements. C. M. Sheridan, 120 Brightwood Avenue presented petition with seventeen names in protest. 1~. Steck of the San Diego Contractors Association commented on the manner of conducting the meeting and good choice of attornies and engineers, remarking it is a wise time to do paving as contractors are available. Mr. S.teck was of the opinion bids, when called, would indicate a great reduotion in price over those estimated figures of the assessment engineer. P. E. Pinkham, 121 Madison Avenue remarked that this step 3hould have been taken years ago in order for the City to progress. He is heartily in favor of the plan. Councilman Hobel stated that much thinking should be done on the subjeot; that many good points and legitimate protests were presented; that the Council was unable to determine the oost of each individual improvement at this time. He stated that the City Council must make a complete study of the written protests and then make a decision. It was moved by Councilman Hobel, seconded by Councilman Riesland, and carried, that the hearings be continued and that the Co~~cil adjourn to the Council Chambers at 12:30 A.M. for conclusion of the hearings. The Council re-assembled in the Council Chambers at 12:30 A.M. with the following members present: Councilmen Hobel, Rader, Halferty, Riesland, DeWolfe A)Jsent: None The Mayor then stated that this was the time and plaoe for the oontinued hearings under Resolution No. 1565.
