RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING A WAIVER OF THE
P ARKLANDS AND PUBLIC FACILITIES FEES PURSUANT
TO MUNICIPAL CODE SECTION 17.10 TO FACILITATE THE
CONSTRUCTION OF LOW INCOME HOUSING
WHEREAS, Seniors on Broadway Limited Partnership, a California limited partnership
(the "Developer") has proposed to construct a 42-unit apartment building located at 825
Broadway in the City of Chula Vista (the "Project"); and
WHEREAS, the Seniors on Broadway development shall provide forty-one units of
affordable rental housing to very low-income seniors and one unit for an on-site manager; and
WHEREAS, Chapter 17.10 of the Municipal Code relates to Parklands and Public
Facilities which requires that developments not requiring final subdivision or parcel maps, and
who do not have suitable land within the development, satisfy the obligation for this requirement
through land dedication or payment of an in-lieu fee; and
WHEREAS, the applicable in-lieu fee for Parklands and Public Facilities would be an
additional cost to this project of $273,420, and is due and payable prior to the issuance of the
first building permit for a development that is not required to submit either a final subdivision
map or a parcel map; and
WHEREAS, Chapter 17.10.070 also allows that the City Council may, by resolution,
waive all or any portion of said dedication or in-lieu fee requirements in the interest of
stimulating the construction of housing for low and moderate-income households; and
WHEREAS, the waiver of the in-lieu fee for Parklands and Public Facilities would assist
in reducing the development costs for the construction of the affordable residential units in order
to make the Project feasible; and
WHEREAS, on October 14, 2003, the City Council conditionally approved financial
assistance in the form of a residual receipts loan from the City's HOME Investment Partnership
Program funds; and
WHEREAS, on February 22, 2005, the City Council approved the Loan Agreement and
Related Restrictive Covenants and Affordable Housing Agreement for the appropriation of
$1,043,850, from the available balance in the City's HOME Investment Partnership Program
funds.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby resolve as follows:
Section 1. The City Council hereby approves a waiver of the Parklands and Public Facilities
fees pursuant to Municipal Code Section 17.10 to facilitate the construction of low income
housing, in the approximate amount of $273,420 to assist with reducing the development costs
for the construction of the residential units of the Project.
