RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING THE FIRST AMENDMENT TO
THE AGREEMENT BETWEEN THE CITY OF CHULA VISTA
AND THE SAN DIEGO UNIFIED PORT DISTRICT FOR
TIDELAND MAINTENANCE SERVICES AND
AUTHORIZING THE MAYOR TO EXECUTE THE
AMENDMENT
WHEREAS, since 1977, the City has maintained the Port District property at the Chula
Vista Bayfront Park, Marina View Park, Bayside Park and landscaped medians on Tidelands
Avenue between Sandpiper Way and West "J" Street, pursuant to written agreement between the
City and the Port District; and
WHEREAS, maintenance, according to acceptable green industry and Port District
standards, includes mowing, edging, litter control, pruning, weed control, irrigation repairs and
restroom cleaning; and
WHEREAS, on May 28, 2002, the City Council approved Resolution No. 2002-170,
which authorized a three-year agreement between the City of Chula Vista and the San Diego
Unified Port District to maintain these areas for the period of July I, 2002, through June 30,
2005; and
WHEREAS, the resolution approved an agreement amount not to exceed $1,098,464; and
WHEREAS, City and Port District staffs have been working together to address increases
in staff costs for Fiscal Year 2004 and 2005 resulting from rising California Public Employees
Retirement System (CalPERS) and Workers Compensation costs for City employees; and
WHEREAS, inclusion of these increased costs exceeds the amount approved by the
agreement, and therefore requires an amendment to the agreement and additional appropriation
by the Port District; and
WHEREAS, this amendment will continue to provide the same level of maintenance for
the Port District property with a not-to-exceed amount of$I,152,659; and
WHEREAS, the funds received from the Port District based on this amendment will fully
reimburse the City's operational expenditures including staff and overhead costs.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby approve the first amendment to the agreement between the City ofChula Vista
and the San Diego Unified Port District for Tideland maintenance services.
IT IS FURTHER RESOLVED that the City Council of the City of Chula Vista does
hereby authorize the Mayor to execute the amendment.
