RESOLUTION NO. 1749
RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF
CHULA VISTA APPROVING A ONE-YEAR EXTENSION OF AN OWNER
PARTICIPATION AGREEMENT WITH HERCAB LIMITED LIABILITY FOR
THE DEVELOPMENT OF AN 11,702 SQUARE FOOT CONCRETE
BUILDING FOR A WAREHOUSE, RESEARCH, OFFICE, AND
DISTRIBUTION CENTER WITHIN THE OTAY VALLEY REDEVELOPMENT
PROJECT AREA
WHEREAS, on August 22, 2000 the Redevelopment Agency passed a resolution adopting
Negative Declaration IS-00-28 and approving an Owner Participation Agreement with Desert King
Intemational, an importer/exporter of natural plant extracts, for the development of an 11,702 square
foot concrete building for warehouse, office, and distribution center within the Otay Valley
Redevelopment Project Area; and
WHEREAS, due to economic reasons, Desert King was unable to move forward and develop
the subject property; and
WHEREAS, Hercab Limited Liability, a firm specializing in the software design of computer
panels, purchased the subject property and approved plans from Desert King for their proposed
warehouse, research, office, and distribution center; and
WHEREAS, Hercab Limited Liability proposes no changes to the plans and has requested
an extension of the Owner Participation Agreement to allow them additional time to comply with the
conditions set forth in said agreement; and
WHEREAS, approval of the extension will move the Owner Participation Agreement expiration
date to August 22, 2002; and
WHEREAS, the project site consists of a vacant .94-acre site located on 725 Main Street in
the Otay Valley Redevelopment Project Area under the jurisdiction and control of the
Redevelopment Agency of the City of Chula Vista, which is shown in the Locater Map attached to
the Owner Participation Agreement and incorporated herein by reference; and
WHEREAS, no additional environmental impact analysis is required under CEQA; and
NOW, THEREFORE, BE IT RESOLVED THAT THE REDEVELOPMENT AGENCY OF THE
CITY OF CHULA VISTA does hereby find, order, determine and resolve as follows:
1. The Redevelopment Agency of the City of Chula Vista hereby approves a one-year
extension of the Owner Participation Agreement with Hercab Limited Liability for the
construction of an 11,702 square foot concrete building for a warehouse, research,
office, and distribution center on 725 Main Street in the Otay Valley Redevelopment
Project Area.
2. The Executive Director of the Redevelopment Agency, or his designee, is hereby
authorized to execute and record an Extension and Assumption of Obligations
Agreement with Hercab Limited Liability in a form approved by the Agency Attorney.
