The Act requires the City to evaluate all facilities which it owns, operates, or from which it provides services, programs, and activities, to determine what modifications are necessary to ensure accessibility and to develop a "Transition Plan" specifying how and when these modifications will be completed. Staff will provide a report on the status of the program and will request formal adoption of the proposed "Transition Plan". Staff recommends Council accept the report and approve the resolution. OM' "'y M",gal Job, Uppitt, Dire"", of '" k W..b ~ FROM: SUBJECT: Transit Division Compliance with Americans with Disabilities Act (ADA) This is a summary of the progress the Transit Division is making toward compliance with the ADA for both CVT and HandYtrans. Chula Vista pioneered service to the disabled and seniors by creating HandYtrans in 1989. The following is a summary of how we are meeting the ADA requirements: CVT 1. Requirement: That all new buses have at least two wheelchair tie-down positions. Compliance: The four buses purchased last fiscal year have two wheelchair tie-down positions. All future buses purchased also will comply. All buses have at least one tie down, and wheelchair lifts. 2. Requirement: The ADA requires that either a recording or the driver announce major intersections. Compliance: CVT drivers announce all major intersections. 3. Requirement: The ADA requires that drivers assist wheelchair passengers to board and deboard the bus if requested. Compliance: CVT drivers comply with this requirement. HandYtrans 1. Requirement: The ADA requires that "comparable paratransit service" be provided for all ADA certified individuals who have difficulty accessing or riding fixed route systems (such as CVT). Comparable service is defined under the law as: 1) paratransit service must be available within a 3/4 mile corridor of a fixed route and during the same hours of operation as the fixed route, and 2) the trip time that a person takes on the comparable paratransit system must be a reasonable facsimile to the fixed route service (for example, if it takes a person 1-1/2 hours to travel from Chula Vista to the V A hospital in La Jolla John Lippitt January 28, 1994 Page 2 if it takes a person 1-1/2 hours to travel from Chula Vista to the V A hospital in La Jolla on the fixed route system, then comparable paratransit service must be provided in a "reasonable" time to the 1-1/2 hour service. The law does not specify what that time is, but if it takes 1-1/2 hours on fixed route, it cannot take 3 hours on paratransit service.) Compliance: Compliance with the comparable paratransit service must be achieved by 1997. In this region, the following actions are taking place toward our compliance: A. All TDA Article 4.5 services (such as HandYtrans) have been designated comparable paratransit services by SANDAG and MTDB. B. A Regional Comparable Paratransit Service Study is currently being conducted by Crain & Associates, under contract with SANDAG, to look at options to meeting the ADA comparable paratransit service requirements by 1997. C. Preliminary indications are that there will be a significant financial shortfall (probably $5 million annually for the San Diego region) to meet the comparable paratransit service requirements, particularly for the City of San Diego. Therefore, additional funding sources need to be identified to meet the 1997 requirements. D. Regarding HandYtrans, there are currently about 80 ADA certified individuals in Chula Vista. So far, HandYtrans has been able to meet me needs of these individuals, and non-ADA certified individuals (mostly seniors who would prefer to ride HandYtrans ramer than CVT). Complying with the ADA in California, particularly for fixed route requirements, is somewhat less burdensome than in some other states because me State of California had numerous requirements already in place for senior and disabled transportation services. For example, the State law for years required that any bus bought with TDA funds must be wheelchair lift equipped. Also, the TDA Article 4.5 funds in the 1970's provided funding for senior and disabled transportation services. HandYtrans has been operating in Chula Vista since 1979 serving the senior and disabled community. The main differences with the ADA comparable paratransit service are: priority must be given to ADA-certified individuals; lack of capacity is not an excuse for denying service to an ADA-eligible person; and paratransit service must be available within a 3/4 mile corridor of a fixed-route service and operate during me same hours as the fixed-route service. Authorize the Mayor to send a letter to our local Congressional representatives advising them of the ramifications of adoption of a more restrictive set of regulations, and our opposition to those regulations due to current and anticipated financial constraints. BOARD/COMMISSION RECOMMENDATION: The Human Resources Commission at their February 10, 1993 meeting unanimously endorsed Staff's proposed on-site and street related ADA compliance program. PUBLIC INFORMATION MEETING: As mandated by the ADA, municipalities required to undertake structural modifications to existing facilities to achieve program accessibility must hold a Public Information meeting to discuss their proposed Transition Plan with individuals with disabilities and those representing their interests. This meeting was intended to provide an opportunity to interested persons to participate in the development of the Transition Plan by submitting comments (35.150(d)). The City held this Public Information meeting January 21, 1993. The meeting was advertised through the distribution of press releases to over 20 local news media, posting of flyers at the City's public facilities, and sending complete Transition Plan packages (including meeting announcement) to 11 local organizations which serve the needs of individuals with disabilities. No objections have been received regarding the adoption of the proposed Transition Plan. Staff has since received several comments from concerned residents and those representing their interests, and to the maximum extent feasible, has attempted to address their concerns and suggestions into the aforementioned resolutions. Comments received have included issues such as accessible elements of the main library, City parks, curb ramps and pedestrian ways. BACKGROUND: The Americans with Disabilities Act (ADA) was passed by the Congress in July, 1990 and signed into law by the President in July, 1991. This Civil Rights legislation will heavily influence how the City conducts business with any individuals considered disabled under the Act. The Department of Justice added a new part 35 to title 28 of the Code of Federal Regulations to implement subtitle A of Title II of the Act. Section 35.150 of 28 CFR Part 35 specifies the need for local government entities to operate each service, program or activity, when viewed in its entirety, in a manner which makes it readily accessible and usable by individuals with disabilities. All new construction and alterations to existing City facilities are mandated by Section 35.151 of Title II (as well as existing state laws) to comply with accessibility d-~ ... .~.. _ ._M....'_._·,____·___~__·_··,·_·___·____·__ Council Agenda Statement Page 3 Americans with Disabilities Act January 20, 1994 specifications, ensuring that where provided, restroom areas, parking lots, drinking fountains, and public telephones, that serve the altered area are made accessible. Program Status: In working to comply with the new federal law, a three prong approach has been initiated; the Department of Building and Housing is coordinating all issues relating to physical modifications to on-site public facilities; the Department of Public Works is coordinating all issues relating to street related public facilities, specifically, the wheelchair accessible curb ramps required throughout the city; and the Personnel Department is coordinating the required Self-Evaluation of the City's policies, practices and procedures regarding disabled employees and information disseminated to the disabled community. A brief summary of the actions taken towards compliance and accessibility is identified below: 1) Establishment of a City-wide ADA Steering Committee consisting of representatives from all maj'or departments affected by the law. Committee is co-chaired by the Assistant Director of Building and Housing and the Assistant Director of Personnel. 2) Creation of a detailed inspection checklist to be used to survey all facilities to assess accessibility (see Attachment D). 3) Surveys of all City building facilities by inspection personnel from the Department of Building and Housing and a report sent to each Department Head. 4) Surveys of all City streets by the Public Works Department for compliance with the wheelchair ramp access requirements and a prioritized list of deficiencies has been compiled (see Attachment C). 5) Training for City employees to familiarize themselves with the new requirements regarding service delivery, equivalent facilities and general requirements of the ADA. 6) Establishment of an ADA Subcommittee to research and recommend specific action on facility modifications. Committee members represented Public Works, City Attorney, Parks and Recreation, Ubrary, Community Development and Building and Housing. 7) Development of informational brochures by the Personnel Department 02-3 - ._-----._._-~._..._----_._.~--_.,_..._--------- Council Agenda Statement Page 4 Americans with Disabilities Act January 20, 1994 explaining the City's efforts and procedures to insure persons with qualified disabilities are afforded access to the City's various programs and job opportunities (see Attachment F). 8) Estimates of costs for modifications to city-owned public buildings were provided by the Department of Public Works personnel and preparation of a draft list of prioritized deficiencies for ultimate inclusion in the Transition Plan to be adopted by Council. 9) Preparation of a grievance procedure for resolving complaints alleging the City is in non-compliance with the ADA and is included for council approval. 10) Holding of required public information meeting to discuss the City's proposed Transition Plan with members of the disabled community and those representing their interests as discussed on page 2 (see Attachment E). 11) Development of a draft Transition Plan identifying and describing the physical modifications for accessibility to the City's facilities, their estimated cost, and the estimated schedule for implementation. 12) Receipt of grant for approximately $29,500 from the California State Library in April, 1993, for the installation of a Community Adaptive Workcenter at the Main Library, which is comprised of multiple devices designed to allow individuals with disabilities to utilize City and Library resources. 13) Designation of the City Manager as the individual responsible for implementation of the City's compliance program, with Building and Housing, Public Works, and Personnel Departments delegated to respond to issues mentioned previously. 14) Development of a series of self-evaluation questionnaires by Personnel Department to assess the City in terms of the accessibility of its programs, services, and employment opportunities. These questionnaires will be completed by department representatives and the information compiled will be used to identify and correct any city-wide and departmental programs, services, policies, practices, and procedures, if any, which could discriminate against individuals with disabilities. 15) Purchase of Telecommunication Devices for the Deaf (TDD) to be installed in Administration, Public Services and Main Library buildings to provide d-1- __ ·~___·___··_·____._~...'.m____.___~_....._ Council Agenda Statement Page 5 Americans with Disabilities Act January 20, 1994 individuals with hearing and speech impairments with the opportunity to communicate with staff at those locations. Funds from the FY 93/94 ADA CIP were used to purchase and install two devices at a cost of less than $1,500; the Ubrary used grant funds from item 12 for the TDD purchase. Discussion of Transition Plan: Paragraph (1) of subsection (d) of 35.150 requires that if structural changes to facilities will be undertaken to achieve program accessibility, the public entity shall develop a "Transition Plan" setting forth the steps necessary to complete such changes. The ADA requires government entities to adopt a Transition Plan by July 26, 1992, with all modifications identified in the plan to be completed by January 26, 1995. Paragraph (2) of subsection (d) of 35.150 requires that "If a public entity has responsibility or authority over streets, roads, or walkways, its Transition Plan shall include a schedule for providing curb ramps where pedestrian walks cross curbs, giving priority to walkways serving entities covered by the Act, including State and local government offices and facilities, transportation, places of public accommodation and employers, followed by other areas." The Act further requires that the Transition Plan shall include the following: 1) identify and describe physical obstacles in the City's facilities which limit the accessibility of its programs or activities to individuals with disabilities; 2) develop a schedule for implementing the physical modifications for compliance; and 3) designate an official responsible for the implementation of the plan, in this case, the City Manager. As is the case with many federally mandated laws, the ADA does not establish federal funding sources for assisting local governments comply with its requirements; the financial burden for ADA compliance has been placed solely upon each municipality. The scope of the ADA compliance plan has been increased dramatically since its inception, and City funds anticipated to be available for ADA related modifications have been uncertain. As the Transition Plan is required to include both the funding source and estimated completion date, concerns over funding forced a delay in the transition pian's availability for council approval. Staff is confident, however, that when comparing efforts made by other local municipalities, the City of Chula Vista remains a leader in terms of ADA compliance. DISCUSSION OF STREET RELATED (CURB CUT) ISSUES: The City of Chula Vista is required to include in its Transition Plan a schedule for eJ,-5 --- ,--.------------- --_.._---""--- --~~--_.._------- Council Agenda Statement Page 6 Americans with Disabilities Act January 20, 1994 providing curb ramps where pedestrian walks cross curbs. The Engineering Division of the Public Works Department undertook the required Self Evaluation of street related facilities by completing a survey of all street and alley intersections within the City. For survey purposes, the City was broken into 21 areas and a field check was done for each section. A listing of all street and intersection locatiuns was completed which indicated what improvements were in place and whether or not a curb ramp was required. Cost estimates were then developed for all the areas that have existing sidewalk and curb improvements, but no ramps. There are two conditions existing at locations where barriers to the wheelchair access could be found to exist under the ADA program. The first condition includes intersections which are fully improved with curb, gutter and sidewalks, but lack curb ramps. There are 2,497 individual curb ramps that need to be installed in this category. The second condition covers intersections which are improved and have curbs, but lack sidewalks in the vicinity of the ramp location. It is staff's position that, since there is no sidewalk, there are no access problems since persons using wheelchairs would not be using the area behind the curb. There are 337 locations that have this second condition. These locations are not included under the proposed Transition Plan, since the curb ramps would be installed at the time sidewalk is installed. Two conditions were found to exist that do provide for disabled access. The first accessible condition includes all the intersections which lack curbs, gutters and sidewalks. It is believed that these conditions present no barriers to persons using wheelchairs, as these are not pedestrian areas, and that curb ramps are not currently required at these locations. The second accessible condition are those locations where all required improvements, including curb ramps, exist. The 1,647 locations with this condition generally meet the ADA standards. The existing wheelchair ramp standards do not meet the new ADA standards in that the slope of the transition area from the bottom of the ramp to the full curb face exceeded the specified slope for that transition. However, since the ramp and the landing area critical to a user meet the ADA standards, staff's position is that these ramps do not need to be reconstructed. A spreadsheet summarizing the total number of ramps needed is attached. The total cost to install curb ramps for all of the 2,497 locations not having ramps as indicated above is $2,966,000 at current prices. Cost estimates are attached. FUNDING FOR INSTALLATION OF STREET RELATED (CURB-RAMP) PROGRAM Staff has investigated all possible sources of financing the construction of street related curb ramp modifications. These sources are as follows: Community Development Block Grant (CDBG) Fund c:<-6 ._--_._.--.~--_.__.._-~- -~_..- . Council Agenda Statement Page 7 Americans with Disabilities Act January 20, 1994 Gas Tax Fund Transnet Fund Residential Construction Tax (RCT) Fund Transportation Development Act (TDA) Fund General Fund The Community Development Block Grant program is used to fund programs for low income, elderly and persons with disabilities, social service programs such as "Meals on Wheels" and economic planning and development activities. Both of these programs are considered absolutely vital to the City. In the past, the City has utilized CDBG funds for sidewalk safety programs and this is considered a likely source of funding for the curb ramps identified in the proposed Transition Plan. The Gas Tax and Transnet funding sources are restricted use funds for the maintenance and repair of the City's streets. These sources could are totally used to maintain and expand the City's street system. Further they are insufficient to do the required work to keep the street system up to acceptable, safe standards. Additionally, when the City does a construction project on a street using these funds, and a curb ramp is needed, the project funds are used to install them. RCT funds are the residential construction tax placed on all new dwelling units in the City and are extremely limited. They are used to finance facilities and infrastructure needs created by the new construction. These limited funds are unreliable in nature of the annual amount (which depends on the level of new home construction), and are needed to meet the high level of needs that this source must currently finance. TDA funds are State Transportation Development Act funds available for pedestrian and bicycle facilities. The administration of these funds are handled by SANDAG and are given to projects on the basis of "grant" applications for specific projects. Currently, SANDAG has placed a priority on the use of these funds for bicycle facilities. The City staff believes, however, that the utilization of these funds to meet the ADA mandate should have a higher priority. Accordingly, the City will make application for TDA funds to complete the curb ramps and will attempt to get SANDAG to recognize this program as a priority. Since the City does not control this source of funding, we can not specifically program any funds at this time. The General Fund is the source of funding for all City wide functions, including police and fire protection and has not been keeping pace with the increase in City costs. This is particularly true in the last two fiscal years as the State of California has taken away a sizable portion of the City's General Fund revenue to balance its own budget. Because the amount of funding is limited, all needed curb ramps cannot be constructed c2-'7 ..__..__......_""'__,~___...m___.____._ _+..~__. --~- Council Agenda Statement Page B Americans with Disabilities Act January 20, 1994 within the time period specified. The establishment of a schedule for the construction of these ramps under this CIP program at all first category locations is proposed to be dependent upon their relative values as determined by three factors. These factors are: 1. The proximity of the intersections to State and local governrr.~ntal offices, facilities, or programs. All intersections within 1/4 mile of such facilities shall be given one priority point. 2. The proximity to transportation facilities. All intersections located on a transit route shall be given one priority point. 3. The proximity to commercial areas which indicate a higher volume of pedestrian traffic. All intersections located in a commercial area shall be given one priority point. Since there are 2,497 individual locations in the program, it was not considered feasible to develop an individual listing of all locations for this document. However, all locations are being placed in a computerized data base and will be assigned priority points for each of the above categories as appropriate. All intersections will then be prioritized for construction scheduling based on 3, 2, 1, and 0 points. The highest priority locations will be those with 3 priority points (meeting all three conditions above), working down to the lowest with no points. As each year's Transition Plan funding is approved by the City Council, depending on City wide priorities, the first locations to have curb ramps constructed will be those with three points. As these are completed the program will move to lower priorities, as funding is available, until the entire list is completed. In addition, the City will include the construction of curb ramps as necessary in any of it's annual street improvement projects. As a further measure, missing curb ramps may also be constructed in connection with one of the City's other programs such as the following: 1. Sidewalk Safety Program, which involves the installation of sidewalks in areas with high pedestrian traffic such as schools, shopping centers, or public facilities. Over the past five years (FY B7-BB through FY 91-92), the City has spent $26,500 in TDA funds to construct various phases of this program. 2. Missing Sidewalk Program, in which various missing segments of sidewalk are installed. This program is currently inactive, with no funding over the last five years. 3. Sidewalk Rehabilitation Program. This program involves the replacement c2-~ --"'~'--'-"'--"-'-~'-'-----'---'----~~"---"-"-"-'-----~- Council Agenda Statement Page 9 Americans with Disabilities Act January 20, 1994 of deteriorated sidewalk in various locations. Over the past five years, the City has spent $117,800 in Community Development Block Grant (CDBG) funds to finance three phases of this program. New regulations are now being considered by the Architectural and Transportation Barriers Compliance Board of the Federal Government to replace the currently sanctioned standards for ramp construction. These regulations are likely to require new construction standards that will cost many more times per curb cut to install. Council is advised that should these proposed regulations become effective, the cost estimate for compliance on street related facilities for the City of Chula Vista could increase significantly. Further, depending on the final language of those regulations, all existing curb ramps could be non-conforming and have to be replaced. Staff recommends that the Council advise our congressional representative by letter of the ramifications of , adoption of a more restrictive set of regulations, and our opposition to those regulations due to current and anticipated financial constraints. Related Issue Brought Up By The Public During the process of formulating this policy, a local resident requested that the City provide on-street handicapped parking on Third Avenue. The resident suggested that under Title II of the Americans with Disabilities Act of 1990, the City of Chula Vista is required to modify existing metered parking spaces in that area to fully comply with the law, specifically with the "program accessibility" portions of the Act. As a result of that inquiry, staff has investigated the existing parking configuration on Third Avenue, reviewed all federal,state and local laws related to public right-of-way parking requirements and examined the City's responsibilities for providing parking under the ADA. Section 35.150 (Existing Facilities) of the ADA Title II regulations state that a public entity shall operate each service, program, or activity in a manner which, when viewed in its entirety, is readily accessible to and usable by individuals with disabilities. The ADA does not require a public entity to make each of its existing facilities accessible and usable by individuals with disabilities. Subsection (b) allows for the delivery of the service at alternative accessible sites, and states that a public entity is not required to make structural changes in existing facilities where other methods are effective in achieving compliance. Disabled parking spaces are currently provided in numerous lots adjacent and accessible to the Downtown Business District for those individuals unable to use metered parking spaces on Third Avenue. In addition, any disabled individual with a valid California distinguishing placard may park at any metered parking stall without being required to pay the standard parking meter fee or adhere to the time restrictions c:2- 9 ----_._---_.__._._~--~--~-- Council Agenda Statement Page 10 Americans with Disabilities Act January 20, 1994 {California Vehicle Code Section 22511.5 (b){2)). The configuration of parking in the Downtown Business District is such that an individual with a disability may either use any metered parking space without payment or time limitation, or utilize disabled parking spaces located at any of the adjacent lots serving the area. Accordingly, the City has provided alternative accessible sites, and is in full compliance with §35.150 and the Act. As far as the location of the accessible parking spaces in the adjacent lots, current ADAAG standards regulating the location of these spaces in new construction states that parking facilities serving a particular building are to be located on the shortest accessible route of travel from adjacent parking to an accessible entrance. In parking facilities that do not serve a particular building (I.e. Downtown Business District), accessible parking spaces shall be located on the shortest accessible route of travel to an accessible pedestrian entrance of the parking facility (ADAAG 4.6.2.). According to the Department of Justice, the lead federal agency responsible for the enforcement of the ADA's accessibility requirements, "the law is geared to the future -- its goal being that, over time, access will be the rule, rather than the exception" (ADA Analysis, Title III, Subpart D, Paragraph 3). Section 35.150(a){1) of the Title II regulations "makes clear, however, that a public entity is not required to make each of its existing facilities accessible", but that when new facilities are built or modifications to existing facilities are made, they shall be required to comply with the accessibility provisions of federal and state laws. Retroactive modifications are not necessarily required in order to be in compliance with the law, as long as the public entity has provided alternative means for access. When viewed in its entirety, the City of Chula Vista has provided usable and accessible parking areas which serve the Downtown Business District, and has complied with the provisions for existing facilities under Title II of the ADA. ESTABLISHING A FINDING OF UNDUE BURDEN: With the high number of city street intersections which have been found to lack accessible curb ramps, the City is faced with approximately three million dollars in required curb ramp modifications to be completed by January 26, 1995 to fully comply with the ADA. Due to reasons given above, staff believes this deadline cannot be met. The Act contains language that could be interpreted to exempt the City from the compliance deadlines if it can demonstrate a finding of an "undue financial burden". The undue burden defense has been defined as a "significant difficulty or expense" and serves as a limitation on a City's ADA obligation. The undue burden defense does not excuse the City's obligation to make city streets accessible, but it may allow for an extended time period in which to install the curb ramps. The 1992/93 CIP included $50,000 for this purpose. After extensive research of all available funding sources, staff recommends that the City establish a c2 - /0 "--- - " _..__.,'_··..,__.......____.~".,.__~____.._.._.____u Council Agenda Statement Page 11 Americans with Disabilities Act January 20, 1994 finding of undue burden for purposes of extending the time period for making the City facilities and curb ramp modifications. By complying with the on-site facilities requirements, the City is illustrating its commitment to providing accessible services. While it is apparent that the City can not fully comply with the time period for street related modifications due to financial constraints, setting a schedule for providing curb ramps on City streets identified in the Transition Plan will demonstrate a commitment to an accessible Chula Vista. Despite the proposed extension of implementation of the City street improvements, the City will be making a stronger financial effort relative to most of the regions local municipalities, and remains a leader of local governments in terms of ADA compliance. Discussion of ProDosed Alternative Methods Policy The ADA recognizes that existing facilities may not be completely accessible to and usable by individuals with disabilities, and while the City is required to provide an equivalent level of service to all interested parties, the modification of all non-accessible elements at city facilities is not required. The proposed Transition Plan recognizes alternative compliance methods which make expensive physical construction alterations unnecessary. These proposed changes include the following: 1. Many counters within the City are non-compliant due to height, with the cost to modify each counter estimated to be $3,500, and a city-wide total of over $70,000. Staff is recommending that the City comply with this provision of the ADA by training staff to provide clipboards or other alternative methods of providing equivalent service, to be determined both by staff and the individual on a case by case basis. 2. Several departments have public services which are physically located in non-accessible upper floor facilities. The Transition Plan proposes that a communication device be installed at the bottom of the stairs in such a building in order to avoid the need to install an elevator. A person unable to use the stairs would then have the opportunity to notify the department and have a member of the department meet them at an accessible alternate site, thus providing equivalent service. 3. Many existing City drinking fountains are not accessible to some individuals with disabilities. Rather than modify or replace these drinking fountains at approximately $1,800 each, the Transition Plan proposes to install permanent paper cup dispensers at some fountains located inside City buildings, which will allow use by anyone unable use the fountains in their present configuration. d.-II ~._.._.....__._--_. -----~.._-_.._~------------. Council Agenda Statement Page 12 Americans with Disabilities Act January 20, 1994 Discussion of the Establishment of Accessible Parks: Section 35.150(a), Title II, of the ADA requires that all "public entities shall operate each service, program, or activity, when viewed in its entirety, in a manner which is readily accessible and usable by individuals with disabilities". The Parks and Recreation Department has 34 existing park sites throughout the City. The playground equipment at most of these parks is not in full compliance with current accessibility requirements of the ADA, and may represent access barriers for some disabled individuals. To retrofit each site with new accessible play equipment and resilient surfacing would cost an average of $30,000 - $40,000 for those portions of each park designed to accommodate individuals with disabilities, with a City-wide total of $3 million to retrofit each park with fully accessible elements. As the funds required to retrofit all parks with the equipment represent a significant portion of the Department's annual budget, this endeavor may not be feasible. The Department plans to comply with the intent of the ADA by providing full service accessible playgrounds in the major sections of the City, allowing any disabled individual unable to use an existing, unmodified park to have easy access to any of the City's many accessible parks. As City funds to support advertising is extremely limited, staff is investigating cost effective options to accomplish this task. All new construction and alterations to existing park and recreation facilities are mandated by Section 35.151 of Title II (as well as existing state laws) to comply with accessibility specifications, ensuring that, where provided, restroom areas, parking lots, drinking fountains, and public telephones, that serve the altered area are made accessible. AdoDtion of Grievance Policv: AMERICANS WITH DISABILITIES ACT GRIEVANCE POLICY POLICY DISCUSSION The City of Chula Vista is committed to providing employment opportunities, services and facilities for the disabled community as described by the Americans With Disabilities Act which was enacted by the United States Congress in 1990. In the area of employment, the City will commit to making reasonable accommodations in all hiring opportunities. The City also commits to a qualified individual (as per the Americans With Disability Act) the opportunity to participate in or benefit from public services, programs or activities. If differences of opinions or unforeseen problems arise, and in spite of the City's best efforts to eliminate disability discrimination or barriers to access, the City has developed this grievance procedure in an effort to resolve any allegation of non- compliance with the ADA. This formal grievance procedure should not preclude the public from resolving any ADA problems or issues on an informal basis. If the City and the complaining party cannot reach a mutually agreeable resolution, then the formal grievance procedure should be implemented. Employees who have an ADA related grievance should follow the City of Chula Vista's General and Sexual Harassment Policy. BACKGROUND The Americans With Disabilities Act 1990 (ADA) provides comprehensive civil rights protection to individuals with disabilities in the areas of employment, public accommodations, state and local government services and programs, and telecommunications. The right for the disabled to have the same opportunities as the non-disabled is the intention of the Federal Law. The underpinnings of the ADA are derived from Section 504 of the Rehabilitation Act of 1973, as amended (29 U.S.C. 701- dl-/3 ._.,.__.,.___.__u__.______."..__...., ___.._......._...". Council Agenda Statement Page 14 Americans with Disabilities Act January 20, 1994 796) and title VII of the Civil Rights Act of 1964 (42 U.S.C. Secs. 2000a and 2000d.) Section 504 prohibits discrimination on the basis of handicap in federally assisted programs and activities; the ADA extends disability discrimination prohibitions to all state and local governments, whether or not they receive federal funds. Compliance is mandatory, it is not linked to federal funds. ON-SITE FACILITIES: Accessibility modifications to city facilities are required by the ADA to be implemented prior to the compliance deadline of January 26, 1995. These modifications have been estimated at approximately $260,000 for modifications to City facilities, and facilities at which the City operates or supports programs. The Department of Building and Housing has been issued a Capital Improvement Program for the implementation of those listed modifications not funded by other Department's CIPs. The funding for these projects has been included in the Budget for FY 93/94, listed under "ADA Modifications - PH I" or by individual site locations for City facilities covered by separate department CIPs. For example, ADA modifications expected to be completed by the Parks and Recreation Department are listed in the transition plan under the Parks and Recreation Department with a funding source designated as PRCIP. All available funding sources were considered, including CDBG, RCT, PAD, and the General Fund, with $36,000 allotted for ADA Modifications Phase I from CDBG during FY 93/94. A CIP request to fund the remainder of the program from CDBG funds next fiscal year ($207,000) is currently being evaluated. Approval of this CIP will allow the City's on-site facilities to come into compliance by the Federally mandated compliance deadline (January 26, 1995). If In the future It Is determined that this CIP cannot be approved, it will be necessary for staff to seek Council approval to establish a finding of undue burden for the on-site facilities in a manner similar to the method used here to justify an undue burden for the street related facilities. 2. STREET RELATED FACILITIES (CURB RAMPS): The FY 93/94 CIP included $50,000 as an annual cost for the purpose of installing curb ramps on City streets. While this amount will not allow the City to comply with the street related modifications deadline of January 26, 1995, it will provide for the definite programming of these modifications. ALTERNATIVE METHODS FOR SERVICE DELIVERY: By utilizing alternative methods for effective service delivery, the City is expected to reduce the estimated amount required for full ADA compliance costs by at least $130,000. Minimal costs are anticipated for implementation of this policy, and have been included in the proposed Transition Plan. 4. ESTABLISHMENT OF ACCESSIBLE PARKS AND RECREATION FACILITY: While the cost for incorporating ADA specifications at the design stage for new facilities is minimal, a relatively small alteration to an existing facility could significantly increase the total cost for the project, as new elements serving the modified area may be required to be modified to current accessibility standards as well. For example, if accessibility is met in a play area through the installation of resilient surfacing, then the restrooms serving that area would have to be modified as well. 5. APPENDIX B City of Chula Vista Americans with Disabilities Act Public Grievance Policy POLICY STATEMENT It is the policy of the City of Chula Vista to prohibit discrimination based on disability. The City of Chula Vista must ensure that all programs, facilities and services that are offered to the public are free from barriers that would impede the utilization of such programs, facilities and services by individuals with disabilities. d -.;2 ~ "- -.-- - "--._._~.-- ---_._-~-_.~-~-.,---_.__..- GRIEVANCE PROCESS 1. A job applicant, or member of the public who believes they have been discriminated against on the basis of disability by the City of Chula Vista may make a written complaint as soon as possible after the incident to the compliance officer (Risk Manager, Personnel Department, 276 Fourth Avenue, Chula Vista, 91910). The Compliance Officer has been designated by the City of Chula Vista to coordinate the City's efforts to comply with Federal and State laws concerni,lg discrimination in the areas of employment, public services, programs or activities that discriminate on the basis of disability. In order to facilitate the investigation, the complainant is encouraged to submit the complaint within 30 days of the alleged incident(s). Where reasonable circumstances prevent the filing of the complaint within this time period, complaints received after this time period may be accepted. 2. The complaint shall include: a. A description of the offending behavior(s) or violations of the ADA; b. Date(s), time(s) and location(s) of incident(s); c. Name(s) of alleged offender(s) and/or the City department that is responsible for the public service, program or activity; d. Name(s) of witnesses, if any and/or name(s) of individuals contacted to resolve this issue on an informal basis; and e. If you (the complainant) are being represented by another person please include their name and phone number. f. Remedy desired. g. Your signature (complainant), your name printed, a phone number and address at which you can be reached. 3. Upon receipt of a complaint, the compliance officer or their designee shall work with other City department staff as necessary to investigate all charges. The investigation shall include interviews with: (a) The complainant (b) the person(s) or department allegedly engaged in discrimination; and (c) any other person the compliance officer believes to have relevant knowledge concerning the complaint. 4. Upon completion of all the investigation, the compliance officer or designee shall review the factual information gathered through the investigation to determine dZ -,;2 5 .-.-. ---. --~.__.,--,,---, ..--.-.--.-.-..----..--..-- whether the alleged conduct, program or facility constitutes discrimination, taking into consideration all factual information, the totality of the circumstances, including the nature of the alleged discriminatory conduct, program or facility and the context in which the alleged incident(s) occurred. 5. The compliance officer or designee shall then prepare a written report setting forth the results of the investigation and the determination as to whether discrimination occurred. The results of the investigation shall be conveyed to the appropriate persons including to the complainant, the person(s) or department(s) allegedly engaged in discrimination, the Director of Personnel and the City Manager's office. If the complainant is satisfied with the investigation and its result, the complainant will sign the report to that effect. 6. If it is determined that discrimination occurred or that public services, programs, or activities were denied, taking into consideration the concepts of reasonable accommodation and undue hardship as stated in the ADA law, appropriate action will be taken. 7. If the complainant is not satisfied, a request for appeal to the City Manager must be submitted within 10 calendar days after the ADA compliance officer issues the written report. 8. Upon receipt of the request for appeal, the City Manager (or his/her designee) will arrange a meeting with the complainant and/or the complainant's representative, if any. The City Manager or designee will review the grievance, alternative solutions, financial consequences, and other relevant issues. The City Manager or designee will issue a final determination within 15 calendar days, unless pertinent persons involved in the issue or incident are not available. A copy of the final determination will be sent to the complainant for review, written comments and signature. If the complainant is satisfied and the issue is resolved, the compliance officer will seek to obtain written verification from the complainant. 9. Overview The Americans with Disabilities Act ("ADA") was intended to integrate individuals with disabilities into the mainstream with respect to employment, public accommodation, communication and transportation. The ADA is organized into five titles, or sections. Each title deals with a specific aspect of obligation. 1- What does the ADA prohibit? Generally speaking, the ADA prohibits discrimination against disabled persons in employment, public services, public accommodations and public transportation.' In the context of employment, the ADA prohibits discrimination against a qualified individual with a disability. The ADA places special obligations on public sector employers under title II, which deals with "public entities." A public entity includes any state or local government, and any department, agency or district of state or local government. Not only must public entities refrain from discrimination in employment and accommodations, but they must also undertake certain affirmative obligations with respect to individuals with disabilities. Public entities are specifically prohibited from subjecting any qualified individual with a disability to discrimination. This , Facilities and businesses receiving federal aid have been prohibited from discriminating on the basis of disability since the enactment of the federal Rehabilitation Act of 1973. Many of the standards of the ADA are borrowed from the Rehabilitation Act. 1 c:l-47 """ -.- _._______~__.... ..._______..___ ·~~··_m_..·."._·_"_ means that a public entity, in providing any of its services, may not either directly or through contractual arrangements -- Deny a qualified individual with a disab il i ty the opportunity to participate in or benefit from the services provided; -- Give a qualified individual with a disability an opportunity to participate that is not equal to the opportunity afforded others; -- Provide a qualified individual with a disability with an aid, benefit or service that is not as effective in obtaining the same result as that provided to others; -- Provide different or separate services to any class of individuals with disabilities than is provided to others, unless that action is necessary to provide services that are as effective as those provided to others; -- Aid or perpetuate discrimination by providing significant assistance to an agency, organization or person that discriminates on the basis of disability; -- Deny a qualified individual with a disability the opportunity to participate as a member of planning or advisory boards; -- otherwise limit a qualified individual with a disability in the enjoyment of any right, privilege, advantage or opportunity enjoyed by others. A pUblic entity may not use criteria or methods of administration that have the effect of discriminating against qualified individuals with disabilities. Finally, a public entity may not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of measures that are required to provide that individual or group with non-discriminatory treatment required by the ADA. 2. Who must complv? A. All private employers with twenty-five or more employees will become subject to the employment provisions of the ADA on July 26, 1992. Employers with fifteen to twenty-four employees will have an additional grace period, until July 26, 1994, until they are subject to the employment provisions of the ADA. (California is currently considering legislation which would extend the requirements of the ADA to small employers and would authorize local prosecution for failure to comply. See AB 1077 and AB 1286.) B. with respect to employment by public entities, no qualified individual with a disability may, on the basis of the disability, be subjected to discrimination in employment under any service, program, or activity conducted by the public entity. This applies to all activities of public entities, and coverage is not based upon size or number of employees as it is for private employers. Moreover, the employment provisions of title II of the ADA became effective on January 26, 1992. C. The ADA's public accommodations provisions apply to a broad range of entities, without regard to size or number of employees. A public accommodation is defined to include any public or privately owned establishment that is used by the general 3 c:¿ -~9 ---..- _.-_.....-,--_.._........_....__._-----.---_.~...__.- public. A potential place of employment is considered a public accommodation. The public accommodations provisions of the ADA became effective on January 26, 1992. 3. Who is entitled to Drotection? Title II of the ADA, directed specifically at public entities, provides that no "qualified individual with a disability" may be excluded from participation in, or be denied the benefits of, the services, programs or activities of a public entity, or be subjected to discrimination by any public entity. For the purposes of title II, a "qualified individual with a disability" is someone who meets the essential eligibility requirements for the receipt of the services or participation in the program, with or without (1) reasonable modification to rules, policies, or practices, (2) removal of architectural, communication or transportation barriers, and/or (3) provision of auxiliary aids and services. The employment section of the ADA also prohibits discrimination in all aspects of employment for "qualified individuals with disabilities." The public accommodations section of the ADA prohibits discrimination against any individual with a disability in the full and equal enjoyment of the goods, services, privileges, advantages, or accommodations of any place of public accommodation. This part of the ADA protects customers, clients, applicants for employment, vendors and visitors in a place of public accommodation. 4 .=< -5ð .-.........-.-.-.... ---.----- --- --..---..... 4. What affirmative obliqations are imposed bv the ADA? A. Aside from the general duty to refrain from discrimination in providing services, benefits or employment, public entities have three additional affirmative obligations under the ADA: (a) The obligation to draft a self-evaluation and to allow interested people to participate in that evaluation process; (b) The obligation to disseminate information regarding rights and protections under the ADA; and (c) The obligation for public entities employing fifty or more people to designate a particular person to be responsible for ADA administration, and to establish a grievance procedure. B. Additionally, employers are required to reasonably accommodate applicants and employees with disabilities, unless to do so would impose an undue hardship on the business. Employers are also required to modify hiring practices to accommodate the needs of applicants with disabilities. The purpose behind these requirements is to allow individuals with disabilities full and equal opportunities to compete in the job market.> A reasonable accommodation is a change in the work environment, or in the employer's regular practices, that enables a qualified individual with a disability to enjoy an equal employment opportunity. Reasonable accommodations apply to the job application process, the essential functions of the job and to all 3 Sixty-six percent of working-age disabled persons who are not working would work if they could find a job. Making facilities readily accessible to individuals with disabilities; 2. Restructuring jobs; 3. Al tering when or how essential job functions are performed; 4. Modifying work schedules; 5. Obtaining special equipment or devices; 6. Modifying examinations, training materials or policies; 7. Providing qualified readers or interpreters; 8. Reassigning employees to vacant positions; 9. Permitting use of accrued paid leave; 10. Permitting use of unpaid leave; II. Providing designated reserved parking for people with mobility impairments; and 12. Allowing the employee to provide equipment or devices that the employer itself is not required to provide. Employers are encouraged to be creative when selecting reasonable accommodations -- accommodations do not need to be expensive or elaborate as long as they are effective. C. The public accommodations section of the ADA also requires action from business owners and operators: there is an affirmative duty on the part of owners and operators of public accommodations to modify any practices and procedures that impede individuals with disabilities, and to remove architectural and communication barriers. 5. Enforcement of the ADA. The Equal Employment Opportunity Commission ("EEOC") will have the same powers to enforce the employment discrimination provisions of the ADA as it has under Title VII and the Age Discrimination in Employment Act. Employees may pursue complaints with the EEOC to recover back pay, reinstatement and attorney's fees, as well as 6 ~ - S.;L ---.-....-...-.--.-.--..--.- ----,.._._._...._~_.._-~_. compensatory and punitive damages under the new Civil Rights Act of 1.991. The public accommodations provisions of the ADA will be enforced by the Attorney General's office. The Attorney General is authorized to bring lawsuits in cases of general public importance or where a "pattern or practice" of discrimination is alleged. Individuals may also bring private lawsuits to obtain court orders prohibiting discrimination and seeking reasonable attorney's fees. Under some circumstances, a court may order a business owner or operator to make its facilities readily accessible and usable by persons with disabilities. In addition, fines may be levied against business owners and operators who are not in compliance with the ADA. Individuals who wish to file title II complaints may either file an administrative complaint with an appropriate federal agency' or a lawsuit in federal district court. Complaints must be filed within one hundred and eighty days of the alleged acts of discrimination, unless the time for filing is extended by the federal agency for good cause. The complaint may be filed with (1.) any federal agency that provides funding to the public agency that is the subject of the complaint; (2) a federal agency designated to investigate title II complaints; or (3) the Department of Justice. , The designated federal agencies for investigation of title II complaints are the Department of Agriculture, Department of Education, Department of Health and Human Services, Department of Housing and Urban Development, Department of the Interior, Department of Justice, Department of Labor and the Department of Transportation. 7 oZ-S3 ->,.- "-----.--.-..---.-.- The ADA does not require complainants to exhaust administrative remedies prior to instituting litigation. If more than one designated agency has responsibility for a complaint because it concerns more than one department or agency of a public entity, such complaints may be filed with the Department of Justice -- the Attorney General for civil Rights will then determine which of the agencies is the designated agency for the purposes of that complaint. 6. EEOC requlations: What is a disabilitv? The EEOC regulations explain key terms used in the ADA legislation and offer practical guidance on how the EEOC will analyze discrimination claims under the ADA. The ADA defines "disability" broadly to include: (1) a physical or mental impairment that substantially limits one or more major life activities; or (2) a record of such an impairment; or (3) being regarded as having such an impairment. The EEOC takes the position that whether or not an individual has a disability will be determined without regard to mitigating measures. For example, a person with a hearing impairment will be considered to have a disability even if the condition is correctable through the use of . a hearing aid. The ADA covers both phvsical and mental disabilities. The EEOC regulations also discuss conditions which are not a disability. For example, the term disability does not include physical characteristics such as eye color, hair color, left handedness, or height, weight or muscle tone that are within the 8 d-5¿¡' -" --------..-- ... ...-----..---"..- normal range and are not the result of a physiological disorder. Temporary, non-chronic impairments of short duration with little or no long-term or permanent impact are usually not considered to be disabilities. Some examples of such temporary impairments include broken limbs, sprained joints, concussions, appendicitis and infl uenza. ' The EEOC regulations also explain that disabilities arise from "impairments." Advanced age, and environmental, cultural, and economic disadvantages are not impairments and, therefore, are not disabilities. For instance, an individual who is unable to read because he or she was never taught to read does not have a disability, because lack of education is not an impairment. To constitute a "disability" under the ADA, an impairment must substantial Iv limit one or more maior life activities of the individual. A major life activity is a function such as caring for oneself, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning and working. The inability to perform a single particular job does not constitute a substantial limitation on the major life activity of working. The following factors are considered in determining whether an individual is substantially limited in a major life activity: (1) the nature and severity of the impairment; (2) the duration or expected duration of the impairment; and , Title II of the ADA specifically states that the term "disability" does not include transvestism, transsexualism, pedophilia, exhibitionism, voyeurism, compulsive gambling, kleptomania, pyromania or psychoactive substance use disorders resulting from current illegal use of drugs. 9 ¿-55 .-.---...---..-- -_....._.---..~._~_.. -....-------- (3) the permanent or long-term impact or the expected permanent or long-term impact of the impairment. In determining whether an individual is substantially limited in the major life activity of working, the following factors should also be considered: (a) the geographical area to which the individual has reasonable access; (b) the class of jobs (those jobs requiring similar training, knowledge, skills or abilities, within the applicable geographical area) from which the individual is disqualified because of impairment; and (c) the broad range of jobs (those jobs that do not require similar training, knowledge, skills, or abilities within the applicable geographical area) in various classes from which the individual is disqualified. In addition to defining key terms, the EEOC regulations contain some substantive provisions that expand the scope of the law itself. For instance, the EEOC regulations specifically provide as follows: It is unlawful to discriminate against any individual because that individual has opposed any act or practice made unlawful by this part or because that individual made a charge, testified, assisted, or participated in any manner in any investigation, proceeding, or hearing to enforce any provision contained in this part. The regulations also make it unlawful to "coerce, intimidate, threaten, harass or interfere with" individuals who have exercised rights under the ADA, or who have assisted or encouraged others to exercise their rights. 7. Department of Justice reaulations The Department of Justice ("DOJ") has promulgated the rules dealing with title II compliance for public entities. Public 10 c2 -.5b .~._..--~-~.- . ,'-----,- .-'---.-..-- hearings were held to elicit participation in the development of these rules. Many of the administrative requirements ultimately adopted by the DOJ were adapted from Section 504 of the Rehabilitation Act of 1973. The DOJ has also issued regulations which interpret the pUblic accommodations provisions of the ADA. This section of the ADA requires business owners and operators to remove architectural and communication barriers from existing facilities when it is "readily achievable." "Readily achievable" is defined by the ADA as easily accomplishable and able to be carried out without much difficulty or expense. The DOJ regulations provide that barrier removal is not readily achievable if it would result in a significant loss of profit or significant loss of efficiency or operations. The DOJ regulations list a number of steps that businesses can take to remove structural barriers to accessibility: l. Installing ramps; 2. Making curb cuts in sidewalks and entrances; 3. Lowering shelves; 4. Rearranging tables, chairs, vending machines, display racks and other furniture; 5. Lowering telephones; 6. Adding raised letter markings on elevator control buttons; 7. Installing flashing alarm lights; 8. Widening doors; 9. Installing off-set door hinges to widen doorways; 10. Eliminating turnstiles or providing alternative accessible paths; ll. Installing accessible door hardware; 12. Removing high pile, low density carpeting; and 13. Modifying vehicle hand controls. When a public accommodation can demonstrate that barrier removal is not readily achievable, it is still obligated to make 11 d;-57 ------_._"- -_._-,-,~-_.__. goods, services, facilities and advantages available through alternative methods, if those methods are readily achievable. Examples of alternatives to barrier removal include, but are not limited to, the following actions: (1) providing curb service for home delivery; (2) retrieving merchandise from inaccessible shelves or racks; and (3) relocating activities to accessible locations. The barrier removal requirements of the ADA apply to anYone who owns or leases a place of public accommodation. B. Special Obliqations of Public Entities As mentioned earlier, title II of the ADA places special obligations on public entities and public sector employers. 1. Self evaluation: By January 26, 1993, all public entities must have evaluated their services, policies and practices in order to determine whether those services, policies and practices meet the requirements of title II of the ADA. If modification of any services, policies and/or practices is required, the public entity must begin to make those necessary modifications. As a practical matter, this means that each public entity must carefully review all its services, programs and facilities, department by department. (See Appendix A.) The ADA also requires the public entity to provide to interested members of the public an opportunity to participate in the self-evaluation process by submitting comments." Any public " When the DOJ solicited comments from the public concerning its own proposed rules, it received over ten thousand pages of comments, occupying almost six feet of shelf space. 12 d1. -58 ---- .-..-."".-------- --~,- -- ...._._..".,_.~---~-- enti ty employing fifty or more persons must maintain this self- evaluation on file and have it available for public inspection for at least three years. The self-evaluation must include a list of the interested persons consulted, a description of the areas examined and the problems identified, and a description of any modifications that were made.7 The purpose of including participation by the public is to encourage a working relationship between public entities and individuals with disabilities. Although the self-evaluation need not be completed until January 26, 1993, this requirement does not stay the effective date of title II -- in other words, public entities are not shielded from discrimination claims during the time that they are involved in the self-evaluation process. 2. Notice Public entities must make certain information regarding the ADA available to applicants, participants, beneficiaries and all other interested persons. That information must include the rights and protections created by the ADA. Methods of providing the information are to be left to the public entity's discretion; however, suggested methods include publication of the information in handbooks, manuals and pamphlets that are distributed to the public, informative posters, and/or broadcast of information by television or radio. 7 If the public entity has already complied with the self- evaluation requirement of Section 504 of the Rehabilitation Act of 1973, then the ADA self-evaluation would only apply to those policies and practices that were not included in the previous self- evaluation. 13 dl-59 .__m___..___._ ~.-.-._-----~~--."...__. .. ---.-- 3. Desiqnation of responsible emplovee and arievance procedures Public entities employing fifty or more people must designate at least one employee who will coordinate ADA compliance efforts. This designated person will also be responsible for investigation of any complaints alleging non-compliance with the ADA. The public entity must make the name, office address and telephone number of this designated employee available to all interested individuals. Any public entity employing fifty or more people must also adopt and publish a grievance procedure which provides for prompt resolution of complaints of ADA non-compliance. The purpose of this requirement is to allow public entities to investigate and resolve complaints themselves, without the intervention of federal agencies. However, complaining parties are not required to exhaust the public entity's grievance procedure before filing an official complaint. c. Emplovment Practices For public sector employers, the prohibition against discriminatory employment practices went into effect on January 26, 1992, regardless of the number of employees. The ADA prohibits employment discrimination for "qualified individuals with disabilities." A "qualified individual with a disability" is a person who has the skills, experience and other job-related requirements for the job, and who can perform the job's essential functions, with or without reasonable accommodation. The prohibition against discriminating against qualified individuals with disabilities extends to job applications, hiring, 14 02 - 60 ---- -""--_.._-.. -------- advancement, discharge, compensation, training and/or all other terms and conditions of employment. These "other terms and conditions of employment" may include social activities and training opportunities. The duty to provide a reasonable accommodation arises when it is requested by the qualified individual. The EEOC recommends that when a reasonable accommodation is requested, the employer follow a four step problem solving analysis. First, the employer should ANALYZE the particular job involved and determine its purpose and essential functions. In determining whether a job function is essential, employers should consider three factors: first, whether the position exists for the purpose of performing that function; second, the number of other employees available to perform that function or among whom the performance of that job function can be distributed; and third, the degree of expertise or skill needed to perform the function. The determination of whether a particular job function is essential is made on a case-by-case basis, including analysis of the following: l. The employer's judg1l1ent as to what functions are essential; 2. Written job descriptions which have been prepared before advertising or interviewing applicants for the position; 3. The amount of time spent on the job performing the particular function; 4. The consequences of not requiring the person to perform that function; 5. The terms of any relevant collective bargaining agreements; 15 ...< - ~I -..__..._.~ ^ . ..._---~_. .---- "--- 6. The work experience of previous holders of the job; and 7. The current work experience of individuals holding similar jobs. Second, the employer should CONSULT with the disabled applicant or employee to find out the precise job-related limitations imposed by the person's disability, and how those limitations can be overcome, by reasonable accommodation. If consulting with the disabled individual does not reveal potential appropriate accommodations, an employer may need to seek technical assistance.· This type of assistance is available through the EEOC, state or local rehabilitation agencies, or from non-profit organizations like the Job Accommodation Network (JAN) . Third, the employer should IDENTIFY potential accommodations and determine how effective each would be in enabling the person to perform the essential functions of the job. Finally, the employer should consider the preference of the person with the disability and SELECT AND IMPLEMENT the accommodation that is most appropriate for both the employer and the person with the disability. An employer has the ultimate discretion to chose between effective accommodations. The EEOC Regulations also discuss the issue of when a reasonable accommodation poses an undue hardship. The EEOC states that the term "undue hardship" refers to any accommodation that would be unduly costly, extensive, substantial, or disruptive, or 8 The EEOC takes the position that an employer's failure to obtain technical assistance will not excuse the employer's failure to comply with the reasonable accommodations obligation. 16 d. - ~¿¿ - ---..,- '-"-"-"-'~""'- --------..-.-...----------.'.-- . that would fundamentally alter the nature or operation of the business. The following is a list of those factors to be considered in determining undue hardship: 1- The nature and net cost of the accommodation: 2. The overall financial resources of the facility or facilities involved in the provision of the reasonable accommodation: 3. The effect on expenses and resources, or the impact otherwise of such accommodation, upon the operation of the facility: 4. The overall financial resources of the covered entity: 5. The overall size of the covered entity with respect to the number of its employees: 6. The number, type and location of the facility: 7. The type of operation or operations of the covered entity, including the composition, structure, and function of the workforce of such entity: and 8. The geographic separateness, administrative or fiscal relationship of the facility or facilities in question to the covered entity. Because of the emphasis these factors place on the financial reality of a particular employer, the application of the regulations will probably sometimes result in different standards of treatment for different employers. For example, an accommodation that is an undue hardship for a small, struggling employer may not be an undue hardship for a larger, wealthier employer. An employer is obligated to make hiring decisions without regard to an individual's disability or the individual's need for reasonable accommodation. However, this does not mean that an employer is obligated under the ADA to prefer applicants with disabilities over other applicants. The ADA also places restrictions on an employer's ability to inquire about disabilities in the pre-hire process. Applicants may 17 c::l - ~.3 .___.. __._.__...__~.....__n·."________· not be asked about their medical history or whether they are disabled, and they may not be asked about the nature of any obvious disabil i ties. Furthermore, pre-hire questions may not even be phrased in terms of a disability (for example, "Do you have a physical or mental disability that would substantially limit your ability to perform the job you are applying for?"). Applicants should not be asked anything about their worker I s compensation claim history or how much leave the individual might require for treatment or incapacitation. Nor should employers inquire as to the physical or mental condition of the applicant's spouse or dependents. Applicants may only be asked if they have the ability to perform jOb-related functions. The ADA specifically prohibits pre-hire medical examinations. However, an employer may require new-hires in a specific job category to take a medical examination after the job offer has been made, and provided certain conditions are met. The job offer may be made contingent upon the new-hire successfully passing a medical examination." If a medical examination is job related and consistent with business necessity, employers may require the medical exam if (1) all new-hires must go through the same examination, and (2) information obtained from the medical exam is kept confidential and is maintained in separate medical files. . A drug test is not considered a medical examination under the ADA, and pre-hire drug screening is not, therefore, prohibited. 18 0< - 6.tf _"_ .. ___".. n___ An employer is permitted to require that an individual not impose a direct threat to the health or safety of other individuals in the workplace by reason of an illness. An applicant with an illness must pose a significant health or safety risk to himself or to others in the workplace which cannot be eliminated or reduced by a reasonable accommodation. This determination must be based upon objective, factual evidence; generalized fears may not be used to disqualify an individual. Employers should review their employment practices to verify that qualified individuals with disabilities do not experience discrimination in either (1) the job application and interview process, or (2) the actual employment relationship.
