RESOLUTION NO. 2004-391
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ACTING IN ITS CAPACITY AS THE
LEGISLATIVE BODY OF COMMUNITY FACILITIES
DISTRICT NO. 2001-01 (SAN MIGUEL RANCH), ADOPTING
AN ANNEXTION MAP SHOWING PROPERTY PROPOSED
TO BE ANNEXED TO SUCH COMMUNITY FACILITIES
DISTRICT AND IMPROVEMENT AREA B THERETO
WHEREAS, the City Council of the City of Chula Vista, California (the "City Council"),
desires to initiate proceedings to annex territory to an existing Community Facilities District and
Improvement Area B thereto pursuant to the terms and provisions of the "Mello-Roos
Community Facilities Act of 1982", being Chapter 2.5, Part I, Division 2, Title 5 of the
Govemment Code of the State of California, and specifically Article 3.5 thereof. The existing
Community Facilities District has been designated as Community Facilities District No. 2001-01
(San Miguel Ranch) (the "District"); and
WHEREAS, there has been submitted a map entitled "Armexation Map No. 1 to
Community Facilities District No. 2001-01 (San Miguel Ranch), City of Chula Vista, County of
San Diego, State of California" (the "Armexation Map") showing the territory proposed to be
annexed to the District and Improvement Area B thereto (the "Territory").
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
SECTION 1. The above recitals are all true and correct.
SECTION 2. The Armexation Map showing the Territory proposed to be annexed to the District
and to Improvement Area B thereto and to be subject to the levy of a special tax is hereby
approved and adopted.
SECTION 3. A certificate shall be endorsed on the original and on at least one copy of
Armexation Map, evidencing the date and adoption of this resolution, and within fifteen days
after the adoption of the resolution fixing the time and place of the hearing on the intention to
annex or extent of the annexation to the District and Improvement Area B thereto, a copy of such
map shall be filed with the correct and proper endorsements thereon with the County Recorder,
all in the manner and form provided for in Section 3111 of the Streets and Highways Code of the
State of California.
