RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING CHANGE ORDER NO. I FOR
THE DAVID E. WERGELAND SHARK AND RAY
EXPERIENCE PHOTOVOLTAIC SYSTEM, IN THE CITY OF
CHULA VISTA (PROJECT GG-176A), AND AUTHORIZING
THE DIRECTOR OF GENERAL SERVICES TO EXECUTE
SAID CHANGE ORDER ON BEHALF OF THE CITY
WHEREAS, on November 18, 2003,. the City Council approved Resolution No.
2003-491 awarding a contract in the amount of $27,324.95 to Independent Energy Solutions, Inc.
for the David A. Wergeland Shark and Ray Experience Photovoltaic System, in the City of
Chula Vista (Project GG-176A); and
WHEREAS, the work included all labor, material, equipment, protection and restoration
of existing site, design documentation, coordination and supervision necessary for a complete
and operating system in accordance with the contract documents; and
WHEREAS, the work provided for a fully functional 7.1KW (STC) grid connected
Photovoltaic (PV) System to be installed at the recently renovated David A. Wergeland Shark
and Ray Experience located at the City's Nature Center; and
WHEREAS, included in the scope of work to install the PV system is the need to provide
for aluminum structural support, which has increased in cost since the original estimate for the
project; and
WHEREAS, the California Energy Commission (CEC) program offers a rebate to
contractors who install PV systems under 10KW; and
WHEREAS, the PV system installed at the David E. Wergeland Shark and Ray
Experience is 7.IKW; and
WHEREAS, the contractor, Independent Energy Solutions, has taken advantage of the
rebate program, as described in the contract documents, with approval from San Diego Gas &
Electric; and
WHEREAS, energy generated from a solar power (such as a PV system) is a substantial
cost savings to the operation of the David A. Wergeland Shark and Ray Experience and all
facilities of the Nature Center; and
WHEREAS, in accordance with Council Policy 574-01, staff is recommending the
approval of Change Order No. 1 in the amount of $5,000 to cover the difference in the CEC
rebate and unanticipated increase in the costs of structural supports necessary to complete the
project; and
WHEREAS, per Resolution 2000-451, Change Order No. I exceeds the amount
allowable to be approved by the Director of General Services.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby approve Change Order No. I for the David A. Wergeland Shark and Ray
Resolution 2004-337

Experience Photovoltaic System, in the City of Chula Vista (Project GG-176A), in the amount of
$5,000 and authorizes the Director of General Services to execute said change order on behalf of
the City.
