HomeMy WebLinkAboutrda min 1984/02/21 AN ADJOURNED REGULAR MEETING OF THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA, CALIFORNIA Tuesday, February 21, 1984 - 7:03 p.m. Council Chamber (During Council meeting) Public Services ijuilding ROLL CALL MEMBERS PRESENT: Chai nnan Cox, Members Scott, Malcolm, Moore, McCandliss MEMBERS ABSENT: (None) STAFF PRESENT: Executi ve Di rector Goss, Community Oevelopment Director Desrochers, Agency Attorney Harron ITEM NO. 1 - PUBLIC HEARING: ACQUISITION OF PROPERTY OWNED BY NURIAN CORPORATION Communi ty Development Di rector Desrochers reported he tel ephoned and wrote a letter to the Nubian Corporation informing them of the meeting this evening. Mr. Donal d Deti sch, attorney representi ng the Corporati on, responded to the letter asking that he be allowed to speak on the issue thi s eveni ng. Mr. Detisch however, is not present this evening. Mr. Desrochers presented the following testimony as evidence of why the option to aquire the subject parcel was necessary: The subject parcel requires replanning and assembly in the interest of the General Welfare in accordance with the State Heal th and Safety Code Section 33000 et seq. because of the need to construct Tidelands Avenue. The original right-of-way bisected the FIG Street marsh to the east. The City, as a result of the Coastal Act, is presently prohibited from intruding upon the marsh. The only other route is through the subject property. A 120' ri ght-of-way is requi red to accommodate auto traffi c, bicycles and pedestrians. The acquisition of the entire parcel is necessary for the implementation of the Bayfront Pl an. Ti de 1 ands Avenue cannot remain in its present configuration due to increased traffic demands brought about by the project. Because of the curve radii required for the construction of the 120' right-of-way, the subject parcel would be divided in such a manner that severance damages are estimated to cost as much as the enti re parcel. The roadway woul d require removal of a portion of the main structure and would greatly change the operation of the property from its present usage. . . ~_.__.._--_._~--_. Adjourned Regular Meeting - 2 - February 21, 1984 Redevelopment Agency The Bayfront project is planned in a manner which is most compatible with the greatest good by: A. Preserving the FIG Street marsh. B. Providing safe automobile circulation. C. Providing parks and public open space on the remaining portion of the property not taken up by the road. The least private i nj u ry results from taking of the subj ect parcel inasmuch as there is not an alternate route that is economically feasible. The Rohr Buil di ng--a 1 arge complex structure cannot be partially acquired. The cost to purchase and relocate woul d resul tin cost many times over the value of the subject property. By 1 ocati ng the property further to the west, Tidelands Avenue coul d not function as a safe auto circulation route. The public interest and necessity requi re the taking inasmuch as the Bayfront Redevelopment Plan is dependent upon safe automobile access. The public benefit to the City from a fully developed Bayfront Plan is: A. Economic - over 3,200 new jobs and close to $1,000,000 in new taxes generated. B. Ci ti zens of the City and regi on will have 40 new acres of publ ic parks to enjoy. C. The environmental sensi ti vity of the Sweetwater Marsh Compl ex wi 11 be protected and enhanced. D. The public will have access to the bay and environs and provided an opportunity to enjoy this resource. The taking is necessary in order to accomplish construction of Tidelands Avenue for unrestricted publ ic use. The present ri ght-of-way is subject to a rental agreement. It is necessary that each and every part of the property be taken because of the wi dth of the ri ght-of-way for safety purposes; a parti al taking woul d result in severance damages costi ng as much as total acquisition and severely alter the usage of the property as presently known. There being no further comments, either for or against, the public hearing was declared closed. MSUC (Cox/Moore) to move on the staff recommendation schedul i ng a public hearing for the Redevelopment Agency at the March 1, 1984 meeting. ---..-.-- Adjourned Regular Meeting - 3 - February 21, 1984 Redevelopment Agency City Attorney Ha rro n noted it woul d not be a public hearing at the Redevelopment Agency; it will be the consideration of the motion to bring this back as a result of the public hearing held this evening. The motion was clarified to this extent.
