PUBLIC HEARING CONSIDERATION OF TAKING OF PARCEL OWNED BY GEORGE MERZIOTIS (Community Development Director) a. RESOLUTION 577 DETERMINING AND DECLARING THE PUBLIC NECESSITY OF THE ACQUISITION OF THE MERZIOTIS PROPERTY AT THE NORTHWEST CORNER OF IIEII STREET AND 1-5 AND AUTHORIZING THE CONDEMNATION PROCEEDINGS TO ACQUIRE SAID PROPERTY This being the time and place as advertised, Mayor Cox opened the public hearing. Two months ago, the Redevelopment Agency took title to the property owned by Joeneal Street. The subject parcel is approximately 625 feet north of the intersection of Bay Boulevard and E Street. In addition, the Agency assumed a lease from the Securities and Exchange Commission that runs for another 62 years on the parcel immediately adjacent to the Joeneal Street property. Furthermore, the Agency acquired the sublease from Joeneal Street on the lease attached to the Securities and Exchange Commission leasehold interest. However, the fee title, owned by George Merziotis, et aI, has not been acquired. A good faith offer, based on an appraisal by the Lee C. Johnson Company, was made and refused by the owners of the subject property. Therefore, in accordance with the State Community Redevelopment Law, this is the date, time, and place to hold a public hearing relative to the Agency instituting the condemnation of said property. Mr. Merziotis, 9343 Crest, Drive, Casa de Oro stated the property has been in his family for over 50 years. They sublet it 12 years ago. To date they had given portions of the property (over 12 acres) to freeway, Caltrans, Santa Fe, and City for publi c use. He is not against the property being condemned for freeway park or public use - they cannot stop this. If, however, it is being condemned for other uses, then the owners would like to retain it. Redevelopment Agency - 2 - April 9, 1985 Meeting There being no further comments ei ther for or against, the public hearing was declared closed. Chairman Cox stated he doesn't know exactly what the off-ramps will be on 1-5 and 54. He would like to get some more information from Caltrans as to this configuration. Community Development Director Desrochers stated he would report back to the Agency after contact with Caltrans. RESOLUTION OFFERED BY MEMBER MOORE, the reading of the text was waived by unanimous consent, passed and approved unanimously. 2. RESOLUTION 578 APPROVING ENVIRONMENTAL CONSULTANT SERVICES TO ASSIST IN PROCESSING APPLICATIONS FOR FEDERAL CLEARANCE AND APPROPRIATING FUNDS THEREFOR (Community Development Director) The plans for the causeway to Gunpowder Point have been approved by the State Coastal Commission in accordance with the approved Land Use Plan and Implementation Plan. However, because they bisect an environmentally protected area as designated by the Endangered Species Act, a Section 404 permit from the Corps of Engineers in association with the U.S. Fish and Wildlife Service is required. The application for a federal permit for Gunpowder Point access was submitted concurrently with the Coastal Commission request. The federal review period is not in process and it is important that a consultant who understands federal bureaucracy be retained to assist the Agency. These same services will be required for the portion of Tidelands Avenue that crosses the Sweetwater Marsh and for the Least Tern preserve on the liD" Street fill. co~unity Development Director Desrochers suggested that since no one had yet been selected to provide environmental consultant ser- vices, the Jones & Stokes contract be extended for an additional $10,000 for this purpose.
