1. RESOLUTION NO. 657 AUTHORI ZING AN EXTENSION OF THE LEASE
AGREEMENT WITH SAN DIEGO SHIPBUILDING
AND REPAIR, INC. FOR A PERIOD OF ONE
YEAR TO JANUARY 31, 1987 FOR A LEASE
AMOUNT OF $75,600
The Redevelopment Agency acquired the Whiteman property on
September 21, 1982, and approved a three-year lease agreement with
San Diego Shipbuilding and Repair, Inc. This agreement will
expire on January 31, 1986, and requires Agency action in order to
extend or terminate the lease.
Communi ty Development Director Desrochers recommended the Agency
au thor ize an extension of the lease wi th San Diego Shipbuilding
and Repair, Inc. for one year at a lease rate of $75,600 due in
monthly installments of $6,300. A determination of whether
further extensions are possible will be made in six months
pursuant to provisions in the lease.
RESOLUTION OFFERED BY MEMBER SCOTT, the reading of the text was
waived by unanimous consent.
Agency Attorney Harron explained the Agency is asked to approve a
one-year extension. The lessee is being given six months to
notify the Agency of any further extensions and the Agency must
either affirm or deny this request within 60 days. provisions for
expiration of this lease will be made by the lessee's attorney.
Member Malcolm requested that included in the lease should be a
statement that the lessee waives any cause of action that may
arise from any denial of extension of the lease. Agency Attorney
Harron remarked this could be made part of the agreement.

In answer to Member Malcolm's question, Community Development
Director Desrochers stated the appraisal fee as determined by the
Court is the rent charged to the lessee. Since the Agency paid
more for the property, a 5% increase in the lease in accordance
with the Consumer Price Index is suggested.
The motion to adopt the resolution passed unanimously.
