REPORT MEMORIAL PARK PANHANDLE/FINE ARTS FEATURE /""' In a written report to the Agency, Director of Community Development Desrochers stated that the obligation for the developer to improve the panhandle is created by the supplemental Disposi tion and Development Agreement (SDDA) between the Agency and Center City Associates, dated December 3, 1981. The portion of the panhandle currently at issue is corridor B on the Corridor Plan. Corridor B shall be an open area, closed to vehicles other than the provisions necessary for emergency vehicles, with park-like landscaping and a sidewalk with a minimum 5-foot width. The landscaping shall be compatible with landscaping on adjoining parcels. The landscaping plan shall be prepared by the Agency, subject to approval of the developer. Director of Parks and Recreation Mollinedo indicated concern with how the panhandle improvements would coordinate with Memorial Park, particularly in light of a significant elevation difference. He felt that incorporating the development with the Memorial Park Master Plan would assure that the coordination was proper ly addressed. Addi tionally, Cor r idor B improvements should be coordinated with Corridor A improvements from F Street to Center Street. Director Mollinedo estimated that the Memorial Park Master Plan, which includes the panhandle, will be completed and available for implementation by July. ----..-.-------------- ----- Redevelopment Agency Minutes - 2 - May 26, 1987 The developer indicates that he intends to develop the panhandle comparably with the One Park landscaping and indicates a budget of approximately $18,000, exclusive of the disputed turf block and of security lighting or barriers. The SDDA calls for "park-like landscaping". At issue is the requirement for a minimum of 20 feet width of some combination of sidewalk and turf block. A separate memo was submitted to the Agency from the Fire Marshal addressing this issue in which she stated that the Uniform Fire Code requires access to within 150 feet of all portions of a building. Director Desrochers' recommendation was that the Agency give the developer the choice of the following two options: (a) Provide the Agency a letter of credit or similar security for $40,000 for the developer's cost obligation for the panhandle improvements, with actual improvement to follow a Master Plan for Memorial Park; or (b) allow the developer to proceed with installation of panhandle improvements after submittal and expedited review/approval of plans by the City and the Parks and Recreation Commission, improvements to include grading, drainage, soil preparation, irrigation, turf, water service, security lighting service, security barriers, and a 20 foot wide combination of sidewalk and turf block. MSUC (Cox/McCandliss) to allow Mr. Zogob to temporarily place the feature of the fine art within his property adjacent to One Park and to direct staff to incorporate a permanent location in conjunction with the Memorial Park Master Plan. Under the design of the Panhandle, Agency discussion followed regarding the memo from the Fire Marshal in which she stated that the Uniform Fire Code Section 10. 207b requires access to within 150 feet of all portions of a building and the availability of access from the north and east does not put the fire apparatus within the 150 foot requirement. The Fire Department is concerned about access from the south; however, based on those requirements and the west side access, adequate access is provided. Agency discussion followed regarding the 20 foot combination of sidewalk and turf block; emergency vehicle access for the panhandle; concern with the cost of this installation; and options for the improvements. Michael Cowett, attorney for Me zogob stated that the developer has had no discussions with the Fire Marshal and no chance for negotiations as to any solution to this problem; the issue is the 150 foot access and it will be a problem at this stage to design something along those lines that would be architecturally acceptable. The developer has budgetary constraints and feels that they can construct the improvements faster and cheaper than the City can. Redevelopment Agency Minutes - 3 - May 26, 1987 MSUC (McCandliss/Moore) to accept the staff recommendation with a modification of the 20 foot wide combination of sidewalk and material acceptable to the Fire Marshal. Chairman Cox noted the lack of landscaping around the Parkway Community Center Building which was constructed seven years ago. He asked staff to complete the plans for the landscaping. MS (McCandliss/Nader) that the Chairman be designated to attend the meeting tomorrow evening on the Memorial Park Master Plan to monitor that meeting and report back to the Agency. Attorney Rudolf stated the motion was out of order since the item was not docketed on the agenda. Member McCandliss withdrew her motion. second. Member Nader withdrew the Mr. Dick zogob expressed his frustrations with the procedure (processing his plans) up to this point; stating it is a "piece-meal" approach to the permit process; the Fire Marshal is involved and they find out they need a different kind of emergency access which will cost $3,000. 2. Interpretive The Agency recessed to Closed Session at 11:22 p.m. to discuss Sierra Club v. Marsh; Sierra Club v. Coastal Commission et. a1.; and items of potential litigation. The City Clerk was excused and the City Manager reported that the session ended at 11:29 p.m. ADJOURNMENT AT ll:29 p.m. to Thursday, June 4, at 7 p.m. the regular meeting scheduled for 0936C
