MINUTES OF REGULAR MEETING
BOARD OF APPEALS AND ADVISORS
CITY OF CHULA VISTA, CALIFORNIA

1. CALL MEETING TO ORDER:
Chairman Reynolds called the meeting to order at 5:05 p.m.
2. ROLL CALL: Members present constituted a quorum.
3. INTRODUCTION OF NEW MEMBER:
Mr. John L. Nash, newly appointed Board Member, replacing Mr. Roy E. Winchell,
was introduced and welcomed.
4. APPROVAL OF MINUTES:
MSUC Kimball/Winkelman to approve minutes of December 8, 1986
MSUC Winkelman/Boget to approve minutes of January 20, 1987
5. NEW BUSINESS:
a. CASE NO.3 - 4450 Otay Valley Road
The applicant made a request for reduction in size of window from 2l.8
square feet to 20 square feet. Section l205a, Uniform Building Code,
requires glazing for natural light equal to 1/10 the floor area of the
guest room. The interior square footage area of the room is 218 square
feet of window area. Ventilation is considered to not be an issue since
the rooms are all air conditioned. The appellant maintains that since
this is a motel unit, the guest rooms would be used primarily at night
when there is no natural light available. Also, when used during the day
the drapes are usually drawn for privacy. For this reason, it was stated
that the 1.8 square feet would not be missed.
The Board found that this 1.8 square feet of glazing would be a miniscule
loss compared to the additional expense involved in ordering special
sized windows (over 40x 50) due to the slightly additional length of the
guest room.

b. CASE NO.4 - 82 Montebello
The applicant is appealing the requirement of 7'6" ceiling height for
existing family room. The patio enclosure of room in question was con-
structed without the benefit of a permit or inspection. It appears
that a patio cover with steps down from the house was enclosed into a
room. A wooden floor was built up to meet the floor level of the exist-
ing house. The elevated floor reduced the floor to ceiling height to
approximately 7 feet to the dropped ceiling. This is 4-1/2 inches lower
than the minimum 7-1/2 feet required by Section 1207a, Uniform Bldg. Code.
The existing ceiling height with the dropped ceiling is now way below the
code requirement. Removal of this dropped ceiling would provide a sloping
ceiling which has to maintain a 7-1/2 foot ceiling height in only one-half
of the room. The ceiling height in this sloping area would be only 7-1/2"
to 7'-4-1/2". The appellant is basing the appeal on the hardship on the
sellers of the house.
The Board found special circumstances in the construction and use of this
structure warrant the reduced ceiling height be approved as is without the
removal of the dropped ceiling. This approval was made specifically for
this structure and is not to be interpreted as precedent setting in the
approval of any other ceiling heights in violation of Section 1207a, UBC.
