MINUTES OF REGULAR MEETING
BOARD OF APPEALS AND ADVISORS
CITY OF CHULA VISTA, CALIFORNIA

l. CALL MEETING TO ORDER:
Chairman Pro Tem Lee called the meeting to order at 5:05 p.m.
2. ROLL CALL - Members present constituted a quorum for the transaction of business.
3. APPROVAL OF MINUTES - MSUC (Emmons/Kaya) to approve the minutes of the regular
meeting of September 13, 1982.
4. APPEALS:
(a) APPEAL NO. 82-10-0l - Nigal Incorporated, 525 Telegraph Canyon Road
Board Member Kaya withdrew from Commission consideration of this appeal due
to conflict of interest.
The applicant requested a waiver for unreasonable hardship to allow the
existing rest room to remain unchanged in the occupancy B-2 building.
Title 24, Part II, Section 2-105(b)(11) pertains to remodel work where
the valuation is less than $50,000. The floor plans submitted revealed
the removal of the existing door to the rest room and hinging it on the
inside to open in front of the existing laboratory which would still make
it accessible to the physically handicapped oerSon. Staff recommended
approval with the changes mentioned above since the intent of the State's
regulation for handicapped access has been met.
MSUC (Burke/Emmons) to grant the appeal.
(b) APPEAL NO. 82-10-02 - Girls' & Boy's Club of Chula Vista _ l301 Oleander
Director of Building and Housing Grady told the Commission the applicant
has requested the use of Celotex "Thermax" Insulation Board in Pre-Engineered
Metal Buildings to be used as insulation in the open frame roof of the
gymnasium portion. Mr. Grady and the Fire Marshal recommended disapproval
because of contradicting statement in the company's brochure.

Mr. Howard Sherrer, representing the applicant, gave Board Members additional
literature pertaining to Thermax and a Research Report from the International
Conference of Building Officials (leBO) approving "Thermax" foam plastic
insulation boards which complies with Section 1812(c) of the 1982 Uniform
Building Code.
MSUC (Kaya/Winchell) to approve appeal with the following stated stipulations.
The manufacturer provide a letter stating that this produce is applicable for
this specific project and that paragraph 4 on page 6 of the catalogue does not
apply. Director of Building and Housing Grady suggested an amendment to the
motion to incorporate the ICBO Research Report No. 3223 into the letter.
Mr. Sherrer agreed to these terms.
(c) APPEAL NO. 82-l0-03 - Starlight Center - l280 Nolan
The applicant has requested a modification of the 2-hr vertical area separation
wall to allow an offset in the separation wall itself by providing a 2-hr floor
ceiling assembly.
Staff noted the Code states that a 2-hr fire wall is a vertical wall only and
runs from the floor to the roof line. The Gypsum Association has an approved
2-hr floor ceiling assembly system. If the applicant used this system where
he must offset at the floor line, it is assumed that the intergrity of the
2-hr fire wall is in tact. Gypsum Association file number for the wall is
FC5720.
MSUC (Burke/Emmons) to grant the appeal based on the findings of the Director
of Building and Housing Grady.
3. NEW BUSINESS:
Chairman Pro Tem Lee discussed the llth Annual Board/Commission/Committee
Banquet and it was felt any new Commissioners should attend at some time.
4. STAFF REPORT:
Director of Building and Housing Grady told the Commission he would be
recommending a change to the adoption of the 1982 Edition, Uniform Building
Code concerning residential exterior balconies projecting into the yard area
where openings.are not permitted.
5. COMMUNICATIONS (PUBLIC REMARKS/BOARD MEMBER COMMENTS/WRITTEN CORRESPONDENCE)
None
6. ADJOURNMENT - MSUC (Chairman Pro Tem Lee/Burke) to adjourn the meeting at 6:00 p.m.
to the regular meeting scheduled for Monday, December 13, 1982 at 5:00 p.m.
