MINUTES OF REGULAR MEETING
BOARD OF APPEALS AND ADVISORS
CITY OF CHULA VISTA, CALIFORNIA
December l3, 1982 Conference Rooms 2 & 3, Public Services Building 5:00 p.m.

CITY STAFF PRESENT: Director of Building and Housing Grady, Chief Building Inspector
Hansell and Fire Marshal Monsell
ALSO PRESENT: Mr. John L. Nash and Tim Oxford (Oxford Construction)
l. CALL MEETING TO ORDER:
Chairman Winkelman called the meeting to order at 5:00 p.m.
2. ROLL CALL - Members present constituted a quorum for the transaction of business.
3. APPROVAL OF MINUTES - MSUC (Emmons/Lee) to approve the minutes of the regular
meeting of November 8, 1982. (Chairman Winkelman abstained due to his absence
from that meeting.)
4. APPEALS:
(a) APPEAL NO. 82-11-01 - Lou's Gym, 25 Naples
The applicant stated that the use is not in the same category as a Gym as
the memberships are open to professional body builders only, and that there
are 17 spaces for body building equipment. There are noactivities that are
normally associated with a Gym. The proposed use is not the same as an A3
occupancy, but more closely related to a B2 occupancy. Based on the actual
use and the actual occupant load, staff recommended approval of the request.
(Board Member Kaya arrived at 5:04)
MSUC (Emmons/Lee) to grant the appeal.
Fire Marshal Monsell opposed the appeal inasmuch as he felt it qualifies as
a Group A3 occupancy.
MSUC (Lee/Emmons) to reconsider the appeal.
Board Member Kaya stated he would like the maximum occupancy load to be
added. One person to 50 square feet, Occupancy B2, and that the occupancy
load be posted.
MSUC (Emmons/Lee) to approve the appeal classifying this use as Occupancy B2
on the stipulation of the parties that the occupancy load be posted according
to the Uniform Building Code on the rating of 50 square feet per person.

(b) CASE NO. 82-l1-02 - 584 E Street
Director of Building and Housing Grady told the Commission that this appeal
is based on Section 2-l05(b) of Title 24, State of California. The appli-
cant is doing minor remodel work for access into a bathroom, but access
into the building does not meet the requirements for handicap persons.
However, the repairs are under the $50,000 as spelled out in Title 24 and
would be an unreasonable hardship to require access ramps to the building
due to the addition of the bathroom.
MSUC (Kaya/Winchell) to grant the appeal as sufficient evidence has been
presented to constitute an unreasonable hardship.
(c) CASE NO. 82-11-03 - 40 North 4th Avenue
The applicant (Target Stores) is requesting that exposed wiring be per-
mitted below the 100 year plain datum for electrical devices. Director
of Building and Housing Grady explained that the Target Store operation
will be the same as the former Fed Mart operation and the building was
constructed prior to flood plain requirements. Mr. Grady met with Federal
representatives of the flood plain regulations and was informed that exist-
ing buildings do not have to meet flood plain regulations, except for new
additions and major remodels consisting of more than 50% of the valuation
of the building. Therefore, staff recommended approval of the request.
MSUC (Burke/Lee) to grant the appeal due to the fact that this is a con-
tinuation of the same type retail sales and the building is existing, and
it does not appear that additional hazards would be created.
3. NEW BUSINESS:

Chairman Winkelman told the Commission that they received an invitation to
attend a Retirement Dinner Reception honoring City Manager Lane F. Cole on
December 30, 1982.
4. STAFF REPORT:
Director of Building and Housing Grady told the Commission he hopes to bring
the Uniform Building Code for adoption to January's regular scheduled meeting.
5. (COMMUNICATIONS PUBLIC REMARKS/BOARD MEMBER COMMENTS/WRITTEN CORRESPONDENCE)
Board Members discussed the possibility of Ms. Patricia Schafer serving on
the Commission.
Mr. Burke suggested the Chairman send a thank you letter to Vice Chairman
Kimball for the Electrical Code Manual he presented to all Board Members.
6. ADJOURNMENT - MSUC (Emmons/Lee) to adjourn the meeting at 6:10 p.m. to the
regular meeting scheduled for Monday, January lO, 1983 at 5:00 p.m.
