HomeMy WebLinkAbout1983/05/09 Board of Appeals & Advisors Minutes MINUTES OF REGULAR MEETING BOARD OF APPEALS AND ADVISORS CITY OF CHULA VISTA, CALIFORNIA May 9, 1983 Conference Room 1, Public Services Building 5:00 p.m. MEMBERS PRESENT: Vice Chairman Kimball, Board Members Lee, Kaya, Burke, Winchell and Schafer MEMBERS ABSENT: Chairman Winkelman (Excused) CITY STAFF PRESENT: Director of Building and Housing Grady, Chief Building Inspector Hansell and Fire Marshal Monsell ALSO PRESENT: Mr. Foon Tam, Mr. Bob Higgins and Mr. Dick L. Ryser l. CALL MEETING TO ORDER: Vice Chairman Kimball called the meeting to order at 5:03 p.m. 2. ROLL CALL _ Members present constituted a quorum for the transaction of business. 3. APPROVAL OF MINUTES - MSUC (Burke/Lee) to approve the minutes of the regular meeting of March 14, 1983. 4. APPEALS: (a) CASE NO. 9-83 - 399 Broadway The applicant requested an exemption from installing restrooms for the mechanics inasmuch as they would not be hiring handicap employees confined to a wheelchair to perform the duties of a mechanic. The Administrative Office area does have restrooms for each sex fully complying with the standards for handicap persons. Director of Building and Housing Grady told the Board Members that in reviewing this case, Title 24, Section 2-17ll stated that all sanitary facilities are not required to comply with these building standards when the enforcing agency determines that sanitary facilities are accessible to and usable by physically handicapped persons within a reasonable distance of accessible areas. Based on these facts, Mr. Grady recommended that the restrooms for the mechanics be exempt. Board Members Winchell and Schafer arrived at 5:15. MSUC (Lee/Kaya) to grant the appeal. (b) CASE NO. lO-83 - l008 Industrial Blvd. The applicant (Toys "R" Us, Inc.) requested the Control Tower and Service Platform office area be exempt from the handicap access requirement. They felt it was a hardship to provide the necessary length of ramp up to the Tower and Platform office area considering the small amount of office area (approximately 50' of ramp would be required). BOARD OF APPEALS AND ADVISORS MINUTES OF MAY 9, 1983 Page 2 Director of Building and Housing Grady explained Section 2-710(3), Title 24, (1) General Sales display and office area together with related toilet rooms. 2-70lb(2) states that offices, in sales facilities that do not exceed 5,000 sq. ft. in total area, that are located on non-accessible levels, Section 2-710(3) and b(2) would appear to exempt the control tower area and the employee side of the service platform. Mr. Grady recommended that the control tower and employee side of the service area be exempt from the handicap access requirement and the floor of the service area extend only to the public side of the service platform. MSUC (Kaya/Winchell) to grant appeal based on the fact the applicant will submit the height of the barrier (cabinets) to plan check. UNANIMOUS CONSENT ITEM Director of Building and Housing Grady requested that the Board consider an additional item. MSUC (Lee/Kaya) to consider the unanimous consent item. CASE NO. 11-83 - 300 Third Avenue, B-5 The applicant requested that handicapped sanitary facilities be waived for this take-out restaurant. Patrons have unlimited use of the common area restroom facilities located in this area. Director of Building and Housing Grady stated that a food service of the i I type proposed could not possibly hire handicapped persons that would have I to depend on aids to get around. The restroom within the take-out restaurant is a public health requirement for employees and is not for use by the public. Public restrooms meeting the requirements for handicap access are located 32 feet from the restaurant. Based on the facts stated and Section 2-710-1, Title 24, Mr. Grady recommended approval of the applicant's request. MSUC (Kaya/Burke) to grant the appeal. I 4. UNFINISHED BUSINESS: I Director of Building and Housing Grady informed Board Members that the City Manager deleted the request for funds for a Board Member to attend the ICBO Annual Meeting. Discussion followed and it was determined that the Chairman would draft a letter to the City Council on behalf of the Board's request for funds to attend the meeting. 5. NEW BUSINESS: Director of Building and Housing Grady distributed Revisions to the 1983 Uniform Building Code and informed Board Members this was a pictorial view of the revisions. STAFF REPORT: Director of Building and Housing Grady told Board Members that both the Uniform Fire Code and Uniform Building Code, 1982 Edition is now effective. 7. BOARD MEMBERS COMMENTS: The Board discussed the number of handicap requests and exceptions coming before them. Mr. Grady told the members the exceptional cases were being brought to them in order to establish guidelines. Mr. Grady further commented that once we have a compilation of cases, he would bring this back to the Board so they could pass a resolution for the Building Official to make administrative approvals on routine requests. 8.
