MINUTES OF REGULAR MEETING
BOARD OF APPEALS AND ADVISORS

l. SPECIAL ORDER OF THE DAY - Mr. Richard A. Reynolds and Richard P. Welsh, newly
appointed Board Members, replacing Board Members Burke and Kaya, were introduced
and welcomed.
2. CALL MEETING TO ORDER:
Chairman Kimball called the meeting to order at 5:10 p.m.
3. ROLL CALL - Members present constituted a quorum for the transaction of business.
4. APPROVAL OF MINUTES - MSUC (Winchell/Schafer) to approved the minutes of
August 8, 1983
5. APPEAL: CASE NO. 30-83 - Pacific Scene, Inc., Charter Point I Development
The applicant, Pacific Scene and Lorimer-Case Architects, requested approval of
the addition of vents which are fitted with a fire-dampered grill through a
2 l-hour wall assemble be allowed. The addition of the vents would facilitate
cross ventilation to eliminate the excess moisture and mildew problem that is
present in the crawlspace. The problem, however, is described as having a
property line centered in the airspace of the double stud party wall.
Table No. SA, Chapter 5, UBC, 1982 Edition, requires building walls that are
constructed less than 3 feet to the property line to be l-hour fire resistance
construction. Installing vents in the property line separation wall violates
the fire resistance integrity of the wall. Since the applicant did not present
a satisfactory proven alternate to a solid fire resistance wall, staff recommended
the appeal be denied and the vents be removed and the wall repaired.
MSUC Schafer/Winchell (5-0) to deny the appeal as written.
Director of Building and Housing Grady told the architect they could come back
to staff if they have a proven solution and they would discuss it and make
every attempt to help resolve their problem.

6. NEW BUSINESS - Report on 1983 I.C.B.O. Conference held in San Antonio, Texas
A brief discussion was held on the conference. Chairman Kimball commented
on the excellent and conscientious job Director of Building and Housing Grady
did and the long hours he put in at the conference.
7. REVISION OF SECTION 1710, UBC, 1983 EDITION
Mr. Grady stated a problem has been created not only in Chula Vista, but
other cities as well that when they did away with the fire zones in the
Building Code, a problem arose in R-type residential buildings. Also our
zoning laws allowed appendanges, particularly balconies, that go within
12 inches of the property line extended beyond the face of the building.
The change would allow in residential construction for an architectural
appendage or balacony to come within 12 inches of the property line.
Fire Marshal Monsell suggested that only non-combustible materials such as
steel or heavy timber be used.
MSUC Welch/Reynolds (5-0) to approve the revision to Section 1710, UBC, with
the following exceptiQn: Change paragraph 3 to read "Projection from wall of
Type III, IV or V construction shàl1 be on non-combustible materials."
8. STAFF REPORT - Director of Building and Housing Grady told Board Members on
November 8, 1983, the City Council passed two resolutions commending Messers.
Kaya and Burke for their fine work as members of the Board of Appeals and
Advisors.
9. COMMUNICATIONS (PUBLIC REMARKS/BD. MEMBER COMMENTS/WRITTEN CORRESPONDENCE)
Chairman Kimball noted that he would present a letter along with the ICBO
Conference Report to City Council.
10. ADJOURNMENT - MSUC (Winchell/Schafer) to adjourn the meeting at 6:42 p.m.
to the regular scheduled meeting for Monday, December 12, 1983 at 5:00 p.m.
