MINUTES OF REGULAR MEETING
BOARD OF APPEALS AND ADVISORS
CITY OF CHULA VISTA, CALIFORNIA
December 12, 1983 Conference Room l, Public Services Building 5:00 p.m.
MEMBERS PRESENT: Chairman Kimball, Vice Chairman Winchell, Board Members Lee,
Winkelman, Welsh and Reynolds
MEMBERS ABSENT: Board Member Schafer (Unexcused)
CITY STAFF PRESENT: Director of Building and Housing Grady and Chief Building
Inspector Hansell

l. CALL MEETING TO ORDER:
Chairman ~imball called the meeting to order at 5:07 p.m.
2. ROLL CALL - Members present constituted a quorum for the transaction of business.
3. APPROVAL OF MINUTES: MSCU (Welsh/Winchell) to approve the minutes of
November 14, 1983
4. APPEALS: CASE NO. 31-83 - 398 "C" Street
Existing is a nonresidential 1-story frame and stucco structure housing a
restaurant that was constructed in the early 1950's. The applicant stated it
is located within the flood plain, making it physically impossible to make the
building floodproof. Director of Building and Housing Grady told Board Members
they must make findings on the 8 conditions under Section 15.08.040 of the
Municipal Code and they are authorized to grant exceptions to the provisions.
Chairman Kimball made a recommendation that paragraph 8 be deleted in that it
would be an inconvenience to the owner. A unanimous vote was taken on all
8 items, and it was determined the plans comply. Board Member Welsh made an
amendment to the motion that Item 8 "The new addition would have all electrical
equipment outlets and switches located above the 100 year flood level" be
deleted. The 8 conditions are attached and are part of these minutes.
MSUC Winkelman/Welsh (6-0) to grant the appeal.

Chairman Kimball requested that staff prepare a 15-minute dissertation on
Floodplain Regulations.
8. ADJOURNMENT - MSUC (Winkelman/Reynolds) to adjourn the meeting at 6:25 p.m. to
the regular scheduled meeting for Monday, January 9, 1984 at 5:00 p.m.
