MINUTES OF REGULAR MEETING
BOARD OF APPEALS AND ADVISORS
CITY OF CHULA VISTA, CALIFORNIA

MEMBERS PRESENT: Board Members Winkelman, Lee, Kimball and Winchell
MEMBERS ABSENT: Chairman Reynolds and Vice Chairman Welsh (Excused)
CITY STAFF PRESENT: Director of Building and Housing Grady
l. CALL MEETING TO ORDER:
In the absence of the Chairman and Vice Chairman, Board Member Winchell
assumed Chairmanship. He called the meeting to order at 5:05 p.m.
2. ROLL CALL - Members present constituted a quorum.
3. APPROVAL OF MINUTES: MSUC Kimball/Lee to approved the minutes of April 14, 1986.
4. NEW BUSINESS:
a. CASE NO. 7-86 - Gunpower Point, Chu1a Vista
Director of Building and Housing Grady displayed a lot layout site plan
for the Nature Interpretive Center on Gunpower point. He stated it is
a 3-story building. The applicant is requesting:
l. To provide only one means of egress from the 3rd story observation
deck whereas the Code requires two exits. The occupant load of the
3rd floor is less than 10 occupants and to require 2 exits will not
improve the safety within 16 feet of each other in exiting from the
3rd floor. With exits so close, a fire or other natural disaster
would render both exits unusable. Staff recommended applicant's
request for one exit be approved.
MSUC Winkelman/Kimball to approved the request by granting a single exit.
2. The applicant requested a waiver for handicap access requirements.
The viewing facilities are provided on the first floor by a TV screen
from a video camera mounted on the top floor of the tower. Staff's
findings and recommendations noted all the facilities on the first
floor are available to handicap persons, however does a television
screen provide equivalent viewing in contrast to direct viewing from
the 3rd floor. It is questionable and as such, staff recommended
that the observation tower not be available to the general public but
only to the staff. The Board discussed that a member of staff could
be handicapped and a handicap person can do all the functions that
will be available in the building.
MSUC Lee/Winkelman to deny the request to waive handicap access
requirements.

b. CASE NO. 6-86 - 1220 Tobias Dr.
Director of Building and Housing stated the applicant has been licensed
for l2 children for a Home Day Care Center. They have deadlocks on the
doors. A day care home for l2 children is classed as an E-3 occupancy.
Section 3304-C, Uniform Building Code states when serving more than lO
occupants, exit doors shall be openable from the inside without the use
of a key or any special knowledge of effort. There are electronic devices
that can be employed to protect doors that will not interfere with door
hardware. Staff recommended denial of the request. Also, the water
heater is equipped with a P&T valve and a high energy cutoff. This is
not the problem with the heater. In checking with the Fire Marshal,
Title 19 requires any appliance that generates heat from a burner to be
protected so children cannot fall onto the appliance and be burned.
Staff cannot make a recommendation as the requirement to enclose the
water heater is a State law and the local Appeals Board cannot hear an
appeal of Title 19. During the meeting a letter was delivered to the
Board stating the applicant is going to comply with the exit hardware
requirement. On that basis the Board made a finding that the applicant
has agreed to comply, therefore the request was denied.
MSUC Winkelman/Kimball recommended no action be taken because of the
legal jurisdiction under State law.
5. STAFF REPORT:
Director of Building and Housing Grady told the Board that the 1986-87
budget schedule will be held on Thursday, June 5, 1986 from 7 to 9 p.m.
for Boards and Commissions.

7. ADJOURNMENT: Chairman Pro Tem Winchell adjourned the meeting to the next
regular scheduled meeting for Monday, June 9, 1986.
