MINUTES OF REGULAR MEETING
BOARD OF APPEALS AND ADVISORS
CITY OF CHULA VISTA, CALIFORNIA

MEMBERS PRESENT: Chairman Reynolds, Vice Chairman Welsh, Board Members Lee,
Winkelman and Kimball
MEMBERS ABSENT: Board Member Boget (Excused Illness)
CITY STAFF PRESENT: Acting Director of Building and Housing Hansell and
Fire Marshal Gove
l. CALL MEETING TO ORDER:
Chairman Reynolds called the meeting to order at 5:03 p.m.
2. ROLL CALL: Members present constituted a quorum.
3. APPROVAL OF MINUTES: MSUC Welsh/Kimball to approve the minutes of
September 8, 1986.
4. NEW BUSINESS:
a. CASE NO. l3-86 - 416 Third ~venue, El Primero Hotel

Acting Director of Building ~nd Housing Hansell stated the applicant
requested a code modification so that 3 rooms with less than 7 feet
minimum width be allowed to be rented.
Substandard condition as def~ned in Uniform Housing Code, Section
100l (b)9 "Room and space ditnension less than required by this code."
The Code requires in Section, 503(c) width "no habitable room other
than a kitchen shall be less than 7 feet in any dimension." The
7-foot minimum dimension req~irement has been in the State Housing
Code since 1923. These rooms were never legal. It is felt that the
rooms were made into sleeping rooms sometime between the tenure of
the previous owner and the present owner. Since these rooms are
defined as substandard under the State Housing Law, staff recommended
against approval of further occupancy.
MSUC Welsh/Kimball to deny the appeal.
b. Adoption of Ordinance for Uniform Fire Code, 1985 Edition
Fire Marshal Gove noted chan~es that are new to the ordinance are
Section lO.210 Pre-Fire and mergency Planning; Section 10.306;
Section lO.207(b) and Sectio~ lO.308(b).

Discussion ensued on Section 10.306, Subsections (a) 3 which is to be
added and amended.
MSUC Winkelman/Kimball recommended City Council adopt the ordinance
for the Uniform Fire Code with a modification to read as follows:
"When an approved fire alarm system is required by the provisions
of this section, any and all buildings constructed after the
effective date of this ordinance on the same property regardless
of height or size shall be provided with an approved fire alarm
system. "

7. ADJOURNMENT: Chairman Reynolds adjourned the meeting to the next regular
scheduled meeting for Monday, January 12, 1987.
