MINUTES OF A REGULAR MEETING
BOARD OF APPEALS AND ADVISORS
CITY OF CHULA VISTA, CALIFORNIA
September 18, 1995 Conference Room No.1 5:15 p.m.
MEMBERS PRESENT: Chairman Triplette, Vice-Chainnan Gingerich, Board
Members Compton, Fabrick, Puzon and Harter
MEMBERS ABSENT: Board Member Coleman

CALL MEETING TO ORDER: Chainnan Triplette called the meeting to order at 5:16
p.m.
ROLL CALL: Members present constituted a quorum.
1. DECLARATION OF EXCUSEDIUNEXCUSED ABSENTEEISM:
A. MSC Fabrick/Compton (4-0-2) (Puzon and Harter arrived late) to excuse the
absence of Board Member Coleman. (Staff received notification of absence
via facsimile on September 18, 1995 at 1:19 p.m.)
2. APPROVAL OF MINUTES: MSC ComptonlFabrick (4-0-2) (Puzon and Harter
arrived late) to approve the minutes of August 21, 1995.
3. NEW BUSINESS:
A. Adoption of the 1994 Edition of the Uniform Fire Code
Chairman Triplette opened the discussion of this item and deferred to
Director of Building and Housing Larsen.

Director Larsen introduced Carol Gove, Fire Marshal, to Members of the
Board, and directed item to Fire Marshal Gove.
Fire Marshal Gove identified the following proposed changes:
1) Section 15.36.040 - Identifies the minimum rating of fire extinguishers
acceptable in the City of Chula Vista; and,
2) Section 15.36.080 - Limits the distance that fire alarm and fire
sprinkler system monitoring companies may be located from the City
of Chula Vista; and,
3) Section 15.36.130 - Adds "fireplaces" to the section identifying offensive
smoke emissions or that smoke which constitutes a hazardous
condition.
MSC Gingerich/Compton (4-0-2) (Puzon and Harter arrived late) to approve
the adoption of the 1994 Edition of the Uniform Fire Code as presented.
4. OLD BUSINESS:
A. Ordinance Amendment - Chula Vista Municipal Code, Chapter 10.80 -
Abandoned Vehicles (Continued from the Meeting of August 21, 1995)
Chairman Triplette opened the discussion of this item and deferred to
Assistant Director of Building and Housing Remp.
Assistant Director Remp stated that staff went back and researched the Chula
Vista Municipal Code further based upon the Board's comments and
questions from the August meeting. Staff has incorporated language found
in Chapter 19.58 which states that storage of vehicles or parts behind a six
foot high solid structure is acceptable. Staff is recommending the following
be added to Section 10.80.030, "... or otherwise stored in a lawful manner
behind a solid fence, gate or wall not less than six feet in height." This
recommendation is the minimum amount of change to meet the intent and
to clarify requirements to assist those enforcing the code.
Board Member Compton stated that Board Member Harter's concerns of
antique cars collection has not been addressed.

Assistant Director Remp replied that there are no restrictions on the number
of vehicles or parts as long as it is stored within a garage or behind a solid
structure.
Director Larsen added that the Board needs to exercise confidence in staff
to ascertain cases as we encounter them. Staff has been directed to enforce
in a reactive manner, not proactive.
Vice-Chairman Gingerich stated that the Board looks to the Chair to
determine whether staffs recommendation is sufficient to subside the
Member's concerns.
Hearing no other comments, Chairman Triplette requested a vote. MSC
Compton/Puzon (5-0-1) (Harter arrived late) to approve the Ordinance
amendments to Chapter 10.80 of the Chula Vista Municipal Code as
presented by staff.
5. CHAIRMAN'S COMMENTS/REPORT:
A. 73rd Annual Code Development and Education Conference of the
International Conference of Building Officials.
Chairman Triplette received information on a program implemented by the
City of San Diego, entitled "Process 2000". "Process 2000" has been
implemented on an experimental basis. One aspect of the program is to
assign Project Managers to advocate completion of projects during the plan
check/permit process. Chairman Triplette requested that the Department of
Building and Housing examine the feasibility of an equivalent program for the
City of Chula Vista.
Director Larsen provided additional information on the City of San Diego's
Program to the Members of the Board. Director Larsen stated that the City
of San Diego recognized the need for streamlining process and automation
due to the reduction/consolidation of developmental departments. The City
of San Diego approached the development community with a proposal for a
five percent (5%) surcharge on permit fees in exchange for an expedited
process which was supported by the development community. Director
Larsen also stated that the Department of Building and Housing will be
working with the Planning and Engineering Departments to analyze our
current process and provide recommendations for a similar program to
"Process 2000".

Vice-Chair Gingerich offered that this may be an opportunity to assess the
need for additional staff.
Director Larsen replied that we must find a balance by realignment of current
staff, utilizing contract employees, streamlining preliminary process steps
and/or upgrading our automation.
MSUC Triplette/Harter (6-0) to direct staff to explore the feasibility of a
program similar to "Process 2000" for possible implementation for the City
of Chula Vista.
Director Larsen reiterated that staff will need approximately 45 to 60 days to
perform the analysis and will be ready to report with findings at the
November meeting.
6. DIRECTOR'S COMMENTS/REPORT:
A. Permits by Fax Program - Presented a preliminary brochure on the program
for the Board's infonnation. Final copies will be available for Members at
the next meeting.
Board Member Compton suggested that staff put together a list of all
contractors who have been approved for the program.
Assistant Director Remp stated that contractors interested in the program
must establish deposit accounts with the City. Also the City must be careful
not to endorse/recommend contractors. Staff will need to research the legal
consideration of providing a list with the Attorney's Office.
Board Member Compton requested staff to clarify with the Attorney's Office
whether such a list could be provided.
Board Member Harter agreed with the recommendation. Mr. Harter stated
the program should save money for the homeowners if Iess time is required
for contractors to pull pennits.
Director Larsen confirmed that staff will look into the matter.

B. 73rd Annual Code Development and Education Conference - The City of
Chula Vista was well represented by Chainnan Triplette, Assistant Director
of Building and Housing Remp and Plans Examiner Mandery. Mr. Mandery
was able to attend the Conference for one day and witnessed the code change
process. Staff will provide a full report on the activities of the Conference at
the next meeting.
C. Application for Appeals - Staff anticipated an appeals for approval to replace
single glazed windows with dual glazed windows. The current height of the
windows is 48 inches and the applicant is proposing to reduce the height to
44 inches. The project will effect approximately 120 windows. The applicant
is aware that the next Board of Appeal and Advisors meeting is scheduled for
Monday, October 9, 1995 and may be coming forth with an appeals at the
next meeting.
D. Suspension of Investigative Fees - This program has been approved by City
Council and is anticipated to run from October 12, 1995 through April 1,
1996. Staff will create a flyer announcing the program and will distribute to
members of the Board of Realtors and the general public.
E. Pennit Drop Off Station - Informed the Board that staff is currently
considering the possibility of utilizing the Telecenter at the Otay Lakes Plaza
(East "H" Street) as a drop off point for pennit applications. Infonnation will
be provided to developers who will pass along the infonnation to
homeowners. Staff will provide findings on expansion of services to the
Telecenter at the next meeting.
7. COMMUNICA nONS (PUBLIC REMARKSfWRITfEN COR RESPONDENCE):
A. Department of Building and Housing Monthly Activities Report - Board
Member Harter pointed out to staff that the Rental Housing Report noted
an unusually high number of nuisance violations and requested staff to
confirm the infonnation.
Director Larsen replied that staff will research the infonnation and report
back to the Board as soon as possible.
8. ADJOURNMENT: Chairman Triplette adjourned the meeting at 6:17 p.m. to the
next regular meeting scheduled for October 9, 1995.
