HomeMy WebLinkAbout1994/12/12 Board of Appeals & Advisors Minutes MmU~SOFAREGUURMEgmG BOARD OF APPEALS AND ADVISORS CITY OF CHULA VISTA, CALIFORNIA December 12, 1994 Conference Room No. 1 5:15 p.m. MEMBERS PRESENT: Chairman Gingerich, Vice-Chairman Triplette, Board Members Fabrick, Compton, Harter and Puzon MEMBERS ABSENT: Board Member Coleman CITY STAFF PRESENT: Director of Building and Housing Larsen, Assistant Director of Building and Housing Remp, Administrative Secretary Uybungco and William Ullrich, Senior Civil Engineer (Guest) CALL MEETING TO ORDER: Chairman Gingerich called the meeting to order at 5:15 p.m. ROLL CALL: Members present constituted a quorum. 1. DECLARATION OF EXCUSED/UNEXCUSED ABSENTEEISM: A. MSUC Puzon/Fabrick (6-0) to excuse the absence of Board Member Coleman from the Meeting of December 12, 1994. B. MSUC Compton/Puzon (6-0) to excuse the absence of Board Member Coleman from the Meeting of October 10, 1994. MSUC Compton/Puzon (Fabrick - Abstained) (5-0-1) to excuse the absence of Board Member Fabrick from the Meeting of October 10, 1994. MSUC Compton/Puzon (Harter - Abstained) (5-0-1) to declare the excuse of Board Member Harter as unexcused from the Meeting of October 1O, 1994. Board of Appeals & Advisors -2- December 12, 1994 2. APPROVAL OF MINUTES: MSUC Compton/Puzon (Fabrick and Harter _ Abstained) (4-0) to approve the minutes of October 10, 1994. 3. NEW BUSINESS: A. Hearing of Appeal to Flood-Proofing Requirements _ Parcel North of "C" Street and Adjacent to North Fifth Avenue (Channelside Shopping Center) _ C.V.M.C., Section 18.54.100 Director of Building and Housing Larsen presented the application before the Board and reminded the Board that a similar item was entertained back on April 7, 1992. The flood control channel has been completed and the area should no longer be designated as being in a flood plain zone. However, the issue before the Board is that the channel has not been recognized by the Army Corp of Engineers' Map (FEMA) as being flood- proofed. Senior Civil Engineer Ullrich informed the Board that in order to grant an exception from the Municipal Code, the Board of Appeals and Advisors must make findings as listed in items #1 through #8 on staff's report. Board Member Harter questioned whether there would be any barriers separating the property from the drainage trench. Senior Civil Engineer Ullrich explained that the drainage trench would be realigned slightly; however, barriers were not noted on the Grading Plan. Director of Building and Housing Larsen confirmed that Board Member Harter's statement to add a condition for barriers to the proposal before the Board. Director of Building and Housing Larsen stated that the issue may not be legally enforceable and that staff can research the condition. It was recommended to the Board to continue the hearing to the January Meeting. Motion Made and Seconded (Harter/Fabrick) to refer this item back to staff to research the potential impact of the proposed project on the safety of the exposed drainage trench. Motion Made (Compton) to table the item to the next meeting with staff returning with the report on the property division wall. Chairman Gingerich recommended the withdrawal of the above motions. MSC Gingerich/Triplette (4-0) (Harter and Fabrick - Against) to withdraw the motions. Board of Appeals & Advisors -3- December 12, 1994 MSUC Triplette/Compton (6-0) to approve the item as presented without attaching any conditions. The Board directed staff to conduct a research to determine whether mitigation of a potential hazard will be necessary. Senior Civil Engineer Ullrich stated that staff will address the issue separately and report back to the Board. The Board was further informed that Council has approved the site plan; the parcel map approval and Building Permit approval are pending. Director of Building and Housing Larsen confirmed that the condition may still be placed upon the process of the Building Permit issuance. 4. CHAIRMAN'S COMMENTS/REPORT: A. Chairman Gingerich recognized Board Member Fabrick as the recipient of the 1994 Humanitarian of the Year Award at the Boards/Commissions/Committees Banquet on November 30, 1994. B. Review of Boards/Commissions/Committees Attendance Policy Chairman Gingerich reviewed the Attendance Policy as outlined in the Boards/Commissions/Committees Handbook. The Members were reminded that he or staff are available to be reached in the event of an absence. 5. DIRECTOR'S COMMENTS/REPORT: A. Status of Access Appeals Board Director of Building and Housing Larsen reminded the Board that any members interested in applying for the Access Appeals Board to please submit an application to the City Clerk's Office. B. Report on the Status of the Plans Examiner and the Code Enforcement Officer Positions Plans Examiner - The Department is optimistically looking for a Registered Professional Engineer to fill this position. Approximately 25 applications have been submitted; 17 candidates will be invited to take a written examination on Saturday, 12/17. Code Enforcement Officer - This position will close on December 16, 1994. The Department is anticipating that it will be filled in Mid-January. 5. COMMUNICATIONS (PUBLIC REMARKS/WRITTEN CORRESPONDENCE}.:. None 6. ADJOURNMENT: Chairman Gingerich adjourned the meeting at 6:16 p.m. to the next regular meeting scheduled for January 9, 1995. ~C;; ~.
