HomeMy WebLinkAbout1995/06/12 Board of Appeals & Advisors Minutes MINUTES OF A REGULAR MEETING BOARD OF APPEALS AND ADVISORS CITY OF CHULA VISTA, CALIFORNIA June 12, 1995 Conference Room No. 1 5:15 p.m. MEMBERS PRESENT: Chairman Gingerich, Vice-Chairman Triplette, Board Members Harter and Puzon MEMBERS ABSENT: Board Members Compton and Fabrick CITY STAFF PRESENT: Director of Building and Housing Larsen, Assistant Director of Building and Housing Remp and Administrative Secretary Uybungco CALL MEETING TO ORDER: Chairman Gingerich called the meeting to order at 5:15 p.m. ROLL CALL: Members present constituted a quorum. 1. DECLARATION OF EXCUSED/UNEXCUSED ABSENTEEISM: MSUC Triplette/Puzon (4-0) to excuse the absence of Board Member Compton due to vacation (letter received June 5, 1995). MSUC TriplettelPuzon (4-0) to excuse the absence of Board Member Fabrick due to illness (call received June 12, 1995). 2. APPROVAL OF MINUTES: Motion made and seconded TriplettejPuzon (3-0-1) (Harter abstained) to approve the minutes of March 13, 1995. (A majority vote was not obtained. Approval of the March 13, 1995 Minutes will need to be carried over to the next meeting.) Board of Appeals & Advisors -2- June 12, 1995 3. NEW BUSINESS: A. Election of Chair and Vice-Chair for FY 1995-96: Chairman Gingerich opened the floor for nominations of Chair for FY 1995-96. Chairman Gingerich nominated Vice-Chair Triplette as Chair for next fiscal year. Hearing no other nominations, MSUC (Gingerich/Puzon) (4-0) to close nominations. MSUC Puzon/Harter (4-0) to elect Vice-Chair Triplette as Chairman for FY 1995-96. Chairman Gingerich opened the floor for nominations for Vice-Chair for FY 1995-96. Board Member Harter nominated Chairman Gingerich as Vice-Chair for next fiscal year. Hearing no other nominations, MSUC (Puzon/Triplette) (4-0) to close nominations. MSUC Harter/Puzon (4-0) to elect Chairman Gingerich as Vice-Chair for FY 1995-96. 4. CHAIRMAN'S COMMENTS/REPORTS: A. Chairman Gingerich provided Sensor-Flush water closet pamphlets for review. B. Chairman Gingerich asked for clarification from staff as to the purpose and intent of the International Code Council article in the Building Standards Newsletter. Director of Building and Housing Larsen stated that there are three code groups recognized currently and the Country is headed for nationally recognized standards. The American Architects Association asked that all three be put into one format: 1) International Conference of Building Officials (ICBO) - Uniform Codes; 2) Building Officials and Code Administrators (BOCA) - National Building Code; and 3) Southern Building Code Congress Inc. (SBCCI) - Southern Building Code. Board of Appeals & Advisors -3- June 12, 1995 Director of Building and Housing Larsen further stated that the goal is to have one national building code by the year 2000. The International Plumbing Code is already available. The International Mechanical, Fire and Building Codes are forthcoming. The State of California will publish the 1994 editions of the Uniform Building Code, Uniform Plumbing Code, Uniform Mechanical Code, and Uniform Fire Code on July 1, 1995. Local cities and counties will have 180 days from July 1, 1995 to adopt the codes. C. Chairman Gingerich noted the press release in the Star News soliciting applications for the Access Appeals Board. 5. DIRECTOR'S COMMENTS/REPORTS: A. Board of Appeals and Advisors - Proposed Budget for FY 1995-96: Director of Building and Housing Larsen informed the Board that all Boards/Commissions/Committees Budgets will be heard on Wednesday, 6/14/95 from 6:00 p.m. to 9:00 p.m. in the Council Conference Room. The targeted goal followed by each department of a 10 percent reduction also is applicable to B/C/C's. The Board's Budget for FY 1995-96 was reduced by 10 percent. Funding is still available next fiscal year for the Chair of the Board to attend the Annual Code Development and Education Conference of the International Conference of Building Officials. Board Member Harter stated that the duties of the Board of Appeals and Advisors have expanded quite a bit and the description on the budget does not do justice to the Board and advised staff to expand the definition of the Board. Director of Building and Housing Larsen stated that Board Member Harter's comments are well taken. B. Access Appeals Board - Status Update: Just as an informational item, the Access Appeals Board's budget has been recommended by the Manager's Office in the sum of $250.00, since there is no benchmark to gauge the activity of this newly created board at this time. This Board's budget may go into the red dependent upon the activity and number of hearings. Board of Appeals & Advisors -4- June 12, 1995 Director of Building and Housing Larsen has communicated with the Mayor and expect the Mayor to make appointments to the Access Appeals Board within the next 30 days. C. Adoption of Model Codes: State law mandates the adoption of the codes by January, 1996. The Board was advised that there is a 60-day waiting period after the second reading before the adoption goes into effect. Therefore, the Codes need to be heard for a first reading by Council by mid-October. The Board will need to take final action by the October meeting. Copies of proposed Ordinances to adopt the codes will be available for review by August for the Board to take final action at the September meeting. Director of Building and Housing Larsen informed the Board that the regular meeting of September (second Monday - 9/11/95) conflicts with the Annual Code Development and Education Conference; therefore, staff would like to request a postponement through the Chair for the meeting to be held on 9/18/95. D. Improving Code Enforcement Effectiveness Program - Status Update: Director of Building and Housing Larsen informed the Board that staff will be ready to bring the item back to the next meeting. 6. COMMUNICATIONS (PUBLIC REMARKS/WRITTEN CORRESPONDENCE): A. On behalf of the Board of Appeals & Advisors and the Department of Building & Housing, Chairman Gingerich congratulated Board Member Puzon for receiving an Associate of Arts Degree from Southwestern College. B. Vice-Chair Triplette extended his appreciation to the Members of the Board for electing him as Chairman for FY 1995-96. 7.
