MINUTES OF A REGULAR MEETING
BOARD OF APPEALS AND ADVISORS
CITY OF CHULA VISTA, CALIFORNIA
December 9, 2002 Conference Room No.1 5:15 p.m.
MEMBERS PRESENT: Chairman Jim Monaghan, Board Members Ty Compton,
Edward Nagorski, Jose Romo, and Ben West

CALL MEETING TO ORDER: Chairman Monaghan called the meeting to order at 5:21
p.m.
ROLL CALL: Members present constituted a quorum.
1. DECLARATION OF EXCUSED/UNEXCUSED ABSENTEEISM:
2. APPROVAL OF MINUTES: MSUC Compton/Romo (5-0) to approve the minutes of
August 12, 2002.
3. NEW BUSINESS:
Assistant Director Remp requested items be moved from New Business to Building
Official's Comments/Report as no action was necessary by the Board members at this
time.

4. CHAIRMAN'S COMMENTS/REPORT:
A. Code Enforcement Request Hotline
Chairman Monaghan requested changes be made to the code enforcement
request hotline due to the fact that if you have more than one request for
investigation you must make a separate call for each one. Staff agreed to look
into making changes to the hotline.
5. BUILDING OFFICIAL'S COMMENTS/REPORT:
A. Special Inspection Program
Asst. Director Remp deferred to Lou EI-Khazen, Deputy Building Official, to
present the special inspection program procedure. The draft procedure was
handed out to the board members. DBO EI-Khazen went through the packet with
the members and talked about the procedure and handouts that the special
inspector gets and needs to complete prior to a special inspector beginning.
DBO EI-Khazen gave a brief overview of what is required of a special inspector
and why the program is going into effect. Our inspectors cannot be there at all
times, so the special inspector observes and reports back to us that the work is
done properly. There are required inspections by the special inspector, in
addition to typical inspections that our building inspectors do. There is also
inspection work that is somewhat specialized and requires an inspector to
observe the work on a continuous or periodic basis.
Welding, structural masonry, high strength bolting, and spray applied fireproofing.
are some examples of specialty types of work that requires special inspection.
This procedure will also apply to HERS (Home Energy Rating System) raters.
Final approval is still by the City inspectors. A contractor cannot hire a special
inspector. The owner or the owner's agent, for conflict of interest reasons, hires
them.
DBO EI-Khazen went over the quality control portion of the procedure to make
the board members aware that part of the program deals with disciplining and
possibly disqualifying inspectors from doing business in C hula Vista. If the
Building Official or Deputy Building Official makes that decision, the individual
can come to the Board of Appeals 'to appeal the decision. ,In the event of an
appeal, staff will prepare a report of chronological events.

The purpose is to make sure we get special inspections on all work requiring
special inspections, and that special inspectors performing the work are qualified
and that they are performing their duties in accordance with the law and the City
requirements.
Implementation is expected for early February.
B. Code Enforcement Strategic Plan
Asst. Director Remp distributed and went over a summary of the Code
Enforcement Strategic Plan that will be presented to Council in January 2003.
This strategic plan goes over where Code Enforcement has been, where it is
going, and where we hope to go with it in the future.
This came about because we were getting feedback from community, Council,
boards and commissions indicating that there are a lot of areas where we need
to improve. Generally, the amount of code enforcement activity citywide was not
what was anticipated or what the community expects. We realized that it was not
only code enforcement's concern, but it was a much broader issue that required
several different individuals and departments throughout the City for it to be
effective.
We included the normal sections in the report: mission and values statements;
history of the program; review of the existing setting; analysis of strengths,
weaknesses, opportunities and threats associated with the program;
comparisons with other jurisdictions; summary of program improvements;
proposed organizational framework for the future; proposed code enforcement
program action plan based on a "balanced scorecard" approach; and a
recommended action plan that phases in the addition of the new staff that will be
required to implement the proposed programs.
One of the programs we will be doing is a Multi-Housing Inspection program.
Right now we do not have a routine inspection program to verify that the 18,000
units in this community comply with the State Housing Law. We will be adding
staff to make sure that we can do this program every three years. This program
includes hotels/motels. The first motel inspections are scheduled for February
2003,
There are some roles specifically for the Board of Appeals and Advisors that
exist right now. With the Housing Inspection Program, you may be asked to hear
appeals of decisions from our housing inspectors. We are taking a more
aggressive stand with the Public Nuisance Abatement. A property owner has the
option of fixing the problem, and if they don't, the City will fix it and place a lien on
the property. The property owner would then have an opportunity to appeal that

cost, and this board might be the one to hear that appeal. Abatement of
substandard buildings or public nuisances could also be appealed and heard by
this board.
C. General Plan Update
Workshops were held, cards were passed out, and comments were gathered into
a Preliminary Issues Report. The reports are available to the board members
who are interested.

7. ADJOURNMENT: Chairman Monaghan adjourned the meeting at 6:36 p.m, to the next
regular meeting scheduled for January 13, 2003.
