SUBJECf: MASTER FEE SCHEDULE - DEPOSIT ACCOUNT FOR BOARD OF
APPEALS AND ADVISORS
As you may recall, the actions of the Board at the November 18, 1991 meeting was to
approve staffs recommendation for adjustments to the Department of Building and
Housing's contributions to the City-Wide Master Fee Schedule, subject to the following
conditions:
1. Incorporate the fee for Plan Check Services into schedule, based upon 304(c),
Uniform Building Code; and,
2. Staff to examine the feasibility of establishing a deRosit account for a~p]ications
submitted for hearings before the Board, rather than t e proposed rate of 440.
The Department is complimentary of the Board's intended direction, that of basing costs of
service to specific delivery of such services, In order to fully explore both administrative and
operational aspects of incoóorating ·a deposit account versus a t1at fee amount, staff is
recommending that the ecember 9, 1991 regular meeting be re-scheduled to
Monday, December 16, 1991. Staff is recommending an additional week to provide the
Board with applicable back-up information to coincide with appropriate recommendation,
As previously reported to the Board, the anticipated date to have the recommended
adjustments to the City-Wide Master Fee Schedule was to be heard before the City Council
at their first meeting in December. Since this report, staff now anticipates the Master Fee
Schedule to be heard approximately January 14, 1992, Hence, the delay of one week to
December 16, 1991 for the Board will not adversely affect the City-Wide Master Fee
Schedule City Council Hearing date.
Again, my compliments to the Board for your insight and sensitivity to this issue of fee
deposit versus a flat rate amount. I will look forward to our recommended change of
meeting date to December 16, 1991 to discussing this further with you, In the event further
information or clarification should be necessary, please do not hesitate to contact me.

REVISIONS

Our recent review of the Master Fee Schedule has revealed the need to make several
changes to our existing ordinances, These changes will incorporate the language
necessary to authorize charging the fees established in the proposed Master Fee
Schedule, In addition, I have taken this opportunity to delete the chapter that adopts the
1979 edition of the Qne and Two-Family Dwelling Code, I see this as being editorial in
nature,
Proposed changes to accommodate proposed revisions to Master Fee Schedule
Add new Section 15,080,015
Uniform Building Code Section 105 amended by addition of the following to the end of
the section:
Approvals of alternate materials and methods shall be throuoh an administrative
hearino process, The application fee for an administrative hearino shall be as set
forth in the Master Fee Schedule,
Section 15,08,030 Uniform Building Code Section 204(a) is amended to read:
Section 204(a) General. In order to hear and decide appeals of orders, decisions
or determinations made by the building official relative to the application and
interpretation of this code, there shall be and is hereby created a Board of Appeals
and Advisors consisting of seven members who are qualified by experience and
training to pass upon matters pertaining to building construction, The Director of
Building and Housing shall be an ex-officio member who shall not be entitled to
vote and who shall act as Secretary to the Board, A fee as set forth in the Master

Fee Schedule Ordinance Changes
Fee Schedule shall be charqed for processinq all applications for an appeals
hearinq before the Board of Appeals and Advisors.
The Board of Appeals and Advisors shall be appointed by the City Council; From
the qualified electors of the City in accordance with the provisions of Section 600
et. seq, of the Charter, The Board shall render all decisions and findings in writing
to the Director of Building and Housing with a duplicate copy to the appellant. The
decision of the Board is final. The Board of Appeals and Advisors shall
recommend to the City Council such new legislation deemed necessary to govern
construction in the City of Chula Vista,
15,080,060 Section 304(b) is amended to read:
Section 304(b) PERMIT FEES, The fee for each permit shall be as set forth in the
Master Fee Schedule Tabla No, 3 ^,
In addition to permit fees, a fee as established by the State of California to support
the State manåated Stronq Motion Instrumentation Proqram will be collected prior
to permit issuance,
The Buildinq Official mav issue a foundation onlv permit based on the fee set forth
in the Master Fee Schedule, Such fee is intended to offset the additional costs
associated with administerinq multiple permit system and shall not be credited
toward overall buildinq permit.
15,080,060 Section 304(c) is amended to read:
Section 304(b) PLAN REVIEW FEES, When a plan or other data are required to
be submitted by Subsection (b) of Section 302, a plan review fee shall be paid at
the time of submitting plans and specifications for review. Said plan review fee
shall be a minimum of 65% of the building permit fee shown in the Master Fee
Schedule Tabla ~Jo, 3 A.
The plan review fees specified in this subsection are separate fees from the permit
fees specified in the Master Fee Schedule Soction 304 (a) and are in addition to the
permit fees.
Where plans are incomplete or changed so as to require additional plan review,
an additional plan review fee shall be charged at the rate shown in the Master Fee
Schedule T3blo No, 3 A.
An additional plan review fee as set forth in the Master Fee Schedule shall be
charqed for those proiects havinq State mandated Enerqy Conservation and/or

Revise section 15,08,060 Section 304(g) to read:
Section 304(g) COMPLIANCE SURVEY FEE, The fee for conducting a
compliance survey of an existing structure shall be as set forth in the Master Fee

Section 304(i) RETENTION OF PLANS, State law requires the retention of plans.
specifications and permits for the life of some tHe buildingª. Therefore, the
applicant shall be charged a fee as set forth in the Master Fee Schedule to cover
the actual cost of microfilming such documents,

Uniform Building Code Section 307(c) amended by addition of the following to the end
of the section:
The fee for issuance of a Certificate of Occupancv shall be as set forth in the
Master Fee Schedule and shall be collected at time of buildina permit issuance,

Uniform Building Code Section 307(d) amended by addition of the following to the end
of the section:
The fee for issuance of a Temporarv Certificate of Occupancv shall be as set forth
in the Master Fee Schedule and shall be collected upon submittal of a Temporary
Certificate of Occupancv application,
Section 15,16.030 Uniform Mechanical Code Section 203(a) is amended to read:

Housing shall be an ex-officio member who shall not be entitled to vote and who
shall act as Secretary to the Board, A fee as set forth in the Master Fee Schedule
shall be charqed for processinq all applications for an appeals hearina before the
Board of Appeals and Advisors,The Board of Appeals and Advisors shall be
appointed by the City Council from the qualified electors of the City in accordance
with the provisions of Section 600 et. seq, of the Charter, The Board shall render
all decisions and findings in writing to the Director of Building and Housing with
a duplicate copy to the appellant. The decision of the Board is final. The Board

In order to hear and decide appeals of orders, decisions or determinations made
by the Fire Chief or Fire Marshal relative to the application and interpretation of this
code, there shall be and is hereby created a Board of Appeals and Advisors
consisting of seven members who are qualified by experience and training to pass
upon matters pertaining to fire safety, The Fire Chief shall be an ex-officio member
who shall not be entitled to vote and who shall act as Secretary to the Board when
it is hearing matters related to application of the Uniform Fire Code, A fee as set
forth in the Master Fee Schedule shall be charqed for processina all applications
for an appeals hearinq before the Board of Appeals and Advisors,The Board of
Appeals and Advisors shall be appointed by the City Council from the qualified
electors of the City in accordance with the provisions of Section 600 et. seq, of the
Charter, The Board shall render all decisions and findings in writing to the Fire
Chief with a duplicate copy to the appellant. The decision of the Board is final.
The Board of Appeals and Advisors shall recommend to the City Council such new
legislation deemed necessary to govern fire safety issues in construction in the
City of Chula Vista,
Section 15.44,070 Revise section to read as follows:
15.44,070 Appeals,
The applicant may appeal the findings and recommendations of the building and
housing department to the board of appeals and advisors, The appeal shall be
in writing, For all appeals, the fee shall be ono half of tho original application foo

Section 15.48.060 Revise section to read as follows:
The owners, occupants or persons in possession or control of the property
wherein a swimming pool is located subject to the provisions of this chapter may
apply for modification or variance of the terms and regulations set forth in this
chapter, The application fee for a hearinq before the Soard of Appeals and
Advisors is as set forth in the Master Fee Schedule. The application submitted to
the DEiepartment of -ªeuilding and HMusing im:poction shall be reviewed by the
GAieI Director of the DEiepartment of -ªeuilding and H:¡ousing im;poction to
determine whether or not the modification as requested would adversely affect the
public health, safety, or general welfare, The GAieI Director of -ªeuilding and
H:¡ousing inopootion shall forward his report and recommendation to the Sward
of 6appeals, The -ªeoard of 6appeals shall review the report, allow and provide
for specific modifications of terms of the chapter when it shall be determined that
strict compliance with the terms of the chapter will not materially benefit or
safeguard the public and that the work to be done will result in undue hardship to
the owners or occupants or persons in possession or in control of the property,
