It is expected that the legal documents will be finally closed in an escrow by the end of November 1992. MTDB intends to begin bus service and maintenance by the beginning of January 1993. ATC/V ANCOM is the MTDB bus contractor that will service and operate 31 transit buses. The target date for bus service operations is January 3, 1993. The bus operation requires approximately 8,000 to 9,000 gallons of diesel fuel per week. During the 1960's and 1970's San Diego Gas and Electric operated a heavy truck repair facility at the same location with underground fuel tanks at this location. The tanks were removed during the 1970's. Request to Board of Appeals MTDB requests that a 10,000 gallon above ground diesel fuel tank be installed at 3650 Main Street Chula Vista. All required precautions would be taken including proper installation, maintenance, and operating policies acceptable to the City of Chula Vista Fire Department and the Board of Appeals. The current city policy limits the size of above ground diesel fuel tanks to 1,000 gallons. This size is unacceptable due to the quantity of fuel used and the delivery of fuel. MTDB's contract requires that fuel be purchased and delivered in large quantities so as to take advantage of price discounts. With public transit budgets extremely constrained due to decreased funding, it is paramount that fuel be purchased in large bulk loads. Underground Fuel Tank Option MTDB has investigated the option of installation of an underground fuel tank. This option is the most expensive option and will require additional ongoing testing of the tanks for leaks. While this is always possible, it will take longer to accomplish and will result in substantial costs for MTDB. As part of the long-range upgrading of the 3650 Main Street facility, MTDB will consider the options for underground fuel tanks. However, this is not possible in the near term without substantial cost implications and delays. Above Ground Fuel Tank Installation MTDB proposes to install a 10,000 gallon diesel fuel above ground fuel tank at 3650 Main Street. The tank has been located by San Diego Petroleum, a diesel fuel supplier. The tank is owned by Sannipoli Tanks and has been cleaned, reconditioned and tested according to U.L. Specifications 142. The tank will be located on the northeast corner of the site more than 20 feet from the building on the site and more than 20 feet from the property line. Item 113A Page 5 of 19 The tank will be the only above ground tank on the site. The tank will be used for dispensing only diesel fuel. A containment of concrete and block will be constructed surrounding the tank and shall be sealed to prevent any fuel leakage in the event of a leak. The containment shall also have a drain valve which can be reached from outside the containment wall. Required "No Smoking" and "Stop Engine" signs shall be placed near the tank and dispenser. Additional bollards will be placed on each side of the containment wall to prevent damage from vehicles to containment walls and supports for tank. An emergency shut-off switch within 75 feet of, but not nearer than 15 feet to the tank shall be located. The building is equipped with a fire prevention system including hoses and standpipes. However, a fire extinguisher with a minimum rating of 40 BC shall be located within 50 feet of the fuel dispensing station. Dispensing nozzles shall be provided with a listed automatic closing type with or without a latch open device. No gravity flow system is proposed. All dispensing nozzles will be attached to a dispensing pump that will be under pressure. Required grounding wires or straps will be installed per city requirements. The facility will also have any required permits from City of Chula Vista Fire Department and Regional Water Quality Board or any other agency that requires permits. Ownership and Operation of the Facility MTDB's bus contractor A TCN ANCOM will own and operate the fueling facility at the MTDB owned bus maintenance facility. All required safety procedures will be followed by operating staff. Buses may be fueled 24 hours per day seven days per week. Approximately 25 buses per day will be fueled. All required precautions will be implemented to insure that fuel operation is safe, that air quality is not compromised and that any water supply is not contaminated. (,A, To___...," ...,........ - Item 113A Page 7 of 19 REPORT OF CONDITIONS & APPLICABLE CODE SECTIONS The propert~· at 3650 Main Street was at one time a maintenance facility for San Diego Gas and Electric, Since its vacancy by San Diego Gas and Electric, it was used for several years by an Auto Auction Firm. The property has been unused for some time except for periodic use of the parking area for the storage of impounded vehicles. Occupancies surrounding the property consist of a storage facility to the north, a rental equipment company to the east, an office warehouse building and a lunch wagon service building and parking area to the ",-est, and an office and light warehousing building to the east. The Ci t~- of Chula Vista Fire Code Articles regarding aboveground storage and dispensing of flammable and combustible liquids include Articles 79 and 80 of the 1991 Cniform Fire Code adopted b~- City Ordinance 2516 in 1992. Chapter 15.36 of the Municipal Code. specifically Section 15.36.130 amends Section 79.501 to permit aboveground storage of Class I & I I liquids under certain conditions and restrictions. See attachment for fire code amendments. The flash points of diesel fuel according to \FPA 325 ~f , are as fo110\\"s: Diesel Fuel Oil I-D. 100 degrees F. Diesel Fuel Oil 2-D. 125 degrees F. Diesel Fuel Oil 4-D, 130 degrees F. Diesel Fuel, according to Section 9.1 DE. is classified as a combustible liquid and depending on the flash point can either be a Class II, or IlIA liquid. See attachment. I f the flashpoint of the diesel fuel classifies it as a Class IlIA or greater combustible liquid the proposed tank does not faE within the restrictive amendment to the 1991 Uniform Fire Code. Ho\\'€,yer, the fire code regulations regarding aboveground storage of combustible liquids would have to be adhered to, See attachments from Article 79 of the Fire Code. On \ovember 5, 1992 some Fire Departments were contacted in order to obtain information regarding their regulation of aboveground tanks. In summar:" the fire departments position of disallo...-ing the proposed 10,000 gallon abo,-eground fuel tank is justified by the Amendment of the 1991 rniform Fire Code. If the flashpoint of the diesel fuel makes it a Class IlIA combustible liquid then the amendment restricting Class II liquids does not apply. Ho\o:€yer, there is no guarantee that the proposed tank ...-ould not have a Class II liquid in it at a later date. If the proposed tank is a single wall metal tank then there is a possibility of flame impingement on the unprotected metal; tank failure and injury to \I,'orkers and safet~- personnel. The fire departmE'nt feels that a 10,000 gallon tank is too large for abo\'eground storage and dispensing. When spill control is required, floors of rooms, buildings or areas containinq flammable or combustible liquids shall be recessed a minimum of 4 inches or shall be provided with a liquid-tight, raised sill to a minimum height of 4 inches so as to prevent the flow of liquids to adjoining area. When raised sills are provided, they are not required at perimeter openings which are provided with an open qrate trench across the opening that connects to a~ approved drainage control system. Uniform Fire Code Standard No. 79-3 shall be placed at entrances to locations where hazardous materials are stored, dispensed or handled ift q~afttities req~irift' a permit. Page 16 of 19 - . tþ ORDINANCE 88-1 AN ORDINANCE TO ESTABLISH LIMITS IN WHICH STORAGE OF FLAMMABLE OR COMBUSTIBLE LIQUIDS IN OUTSIDE ABOVE GROUND TANKS IS PROHIBITED The Board of Directors of the Bonita Sunnyside Fire District ordains as follows: SECTION I The limits referred to in 1985 Uniform Fire Code, Section 79.501 and 79.1001, in which the storage of flammable or combustible liquids in outside above ground tanks is prohibited, and are established as follows; The bulk storage of Class I and Class II flammable liquids in above ground tanks in any residential, business or commercial zone except: SECTION II The bulk storage of Class II flammable liquids may be allowed on a temporary basis '-' in above ground tanks not to exceed 550 gallons in areas where new construction is taking place and when approved by the Fire Chief. (DIESEL FUEL) SECTION III When approved by the Fire Chief, crankcase drainings removed from internal combustion engines may be stored in an approved above ground container. The capacity shall not exceed 550 gallons. UFC Table 79.403 setbacks requirements from property lines shall apply. DEPARTMENT Operations Policy FP-05 Fire SUBJECT Above Ground Flammable PAGE EFFECTIVE DATE Liquid Containers/Tanks 6 9/1/92 With the approval of the Fire Chief, Class I and II liquids may be stored above ground outside of buildings in specially designed, approved and listed containers wf¡ich have features incorporated into their design which mitigate concerns for exposure to heat (two-hour fire resistance), ignition sources and mechanical damage. Containers must be installed and used in accordance with their listing, and provisions must be made for leak and spill containment, Storage in such tanks on any site shall not exceed 550 gallons for Class I or 1100 gallons for Class II liquids. PROCEDURES 1. Replacement tank may not exceed existing tank in size. Tank shall not exceed 1000 gallons in capacity. 2. There shall be a maximum of one above ground fuel tank per occupanc~' or property parcel, not to exceed 1000 gall ons, 3. Abo'"e ground fuel tanks may be used for dispensing diesel fuel only. 4 . An,' above ground tank shall have a containment capable of holdIng 110% of the capacity of the tank. A. Containment shall be of concrete or block and shall be fue 1 tight. B. Containment shall have a means of draining with a valve h'h i ch can be reached from outslde the containment.
