SUBMITTED BY: Director of Building and HOUS~v/ REVIEWED BY: City Manager (4/5ths Vote: YeS___No>(> In accordance with City Council policy to streamline and consolidate, where appropriate, the City's regulatory and permit procedures, staff has reviewed sections 15.08.050, 15.16.050, 15.24.060, and 15.28.050 of the Chula Vista Municipal Code having to do with investigation fees, and is proposing an amendment to this code to suspend these fees for a six month period following the second reading and adoption of this ordinance. RECOMMENDATION: That Council approve the ordinance to suspend aforementioned investigation fees for a six month period following the second reading and adoption of this ordinance. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Under existing Municipal Code, property owners who commence or complete construction work without a required permit, are subject to an investigation fee, which is in addition to the cost of any required permit(s). This proposed amendment to the Municipal Code would suspend investigation fees, and provide property owners a six-month period of regulatory relief. During this 'window of opportunity', homeowners would be able to obtain required permits and inspections based on standard fees set forth in the Master Fee Schedule. Similar programs in the City of San Diego and San Diego County have been very popular, resulting in increased compliance with building codes and recording improvements for increased property values. The timing of this amendment has been coordinated to coincide with similar programs being introduced by the other major jurisdictions within San Diego County. FISCAL IMPACT: Unknown at this time. Of total building fees collected each month, the slight decline in investigation fee revenue would be more than offset by the increased number of permit applications this same program would generate. This would also be a consideration in any future decision to extend this program. ORDINANCE NO. AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING SECTIONS 15.08.050, 15.16.050, 15.24.060, AND 15.28.050 OF THE CHULA VISTA MUNICIPAL CODE ALL RELATING TO INVESTIGATION FEES. The City Council of the City of Chula Vista does ordain as follows: Item 1- Subsection 304{e) of Section 15.08.050 is hereby amended as follows: 1. [No change] 2 . Fee. An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The investigation fee shall be equal to the amount of the permit fee required by this code. The minimum investigation fee shall be the same as the minimum fee set forth in the Master Fee Schedule. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalty prescribed by law. The investiqation fee imposed bv Municipal Code section 15.08.050. subsection 304(e). shall be suspended for a six month period followinq the second readinq and adoption of this ordinance for anv work that has been started or completed prior to April 1. 1995 without the necessary permit or permit. if an application for such permit is submitted to the Buildinq Official durinq the effective period of this suspension. Notwithstandinq the foreqoinq. no person shall be relieved from fully complvinq with the requirements of the Municipal Code in the execution of the work or from anv other penalties that may be prescribed bv this Municipal Code. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalty prescribed by law. The investiqation fee imposed bv Municipal Code section 15.24.060. subsection (C) . shall be suspended for a six month period followinq the second readinq and adoption of this ordinance for any work that has been started or completed prior to April 1. 1995 without the necessary permit or permit. if an application for such permit is submitted to the Buildinq Official durinq the effective period of this suspension. Notwithstandinq the foreqoinq. no person shall be relieved from fully complvinq with the requirements of the Municipal Code in the execution of the work or from any other penalties that may be prescribed by this Municipal Code. Item 4. Subsection 30.4(d) of Section 15.28.050 is hereby amended as follows: (1) [No change] (2) An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The investigation fee shall be equal to the amount of the permit fee that would be required by this Code if a permit were to be issued. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this Code, nor from any penalty prescribed by law. The investiqation fee imposed by Municipal Code section 15.28.050. subsection 30.4(d). shall be suspended for a six month period followinq the second readinq and adoption of this ordinance for any work that has been started or completed prior to April 1. 1995 without the necessarv permit or permit. if an application for such permit is submitted to the Buildinq Official durinq the effective period of this suspension. Notwithstandinq the foreqoinq. no person shall be relieved from fully complyinq with the requirements of the Municipal Code in the execution of the work or from any other penalties that mav be prescribed bv this Municipal Code. Item 5. This ordinance shall take effect an be in full force and effect 30 days after its second reading and adoption, and shall expire six months after it takes effect. Item 6. The City Clerk is hereby instructed to remove the language provided by Ordinance____ from the Chula Vista Municipal Code six months after this ordinance takes effect.
