MINUTES OF A REGULAR MEETING
BOARD OF APPEALS AND ADVISORS
CITY OF CHULA VISTA, CALIFORNIA
October 14, 1996 Conference Room No, 1 5:15 p,m,
MEMBERS PRESENT: Chairman Triplette, Vice-Chairman Gingerich, Board
Members Compton, Harter, Fabrick, Puzon and O'Neill .
MEMBERS ABSENT: None
CITY STAFF PRESENT: Director of Building & Housing Larsen, Assistant
Director of Building & Housing Remp, and
Administrative Secretary Uybungco
CALL MEETING TO ORDER: Chairman Triplette called the meeting to order at 5:15
p,m,
ROLL CALL: Members present constituted a quorum,
1, DECLARATION OF EXCUSED/UNEXCUSED ABSENTEEISM: N/A
2, APPROVAL OF MINUTES: MSUC Puzon/Fabrick (5-0-2) (Harter and O'Neill
abstained) to approve the minutes of July 15, 1996,
3, NEW BUSINESS: None

A. Introduction of New Board Member - M, Kevin O'Neill
Director of Building and Housing Larsen introduced Mr. O'Neill, followed
by self-introductions around the table.

B. Report on the 74th Annual Education and Code Development Conference
of the International Conference of the Building Officials - St. Paul,
Minnesota
Director of Building and Housing Larsen informed the Board that the
Conference held in St. Paul was the last Conference to vote on code
changes to the 1997 Edition of the Uniform Building Code, The 1997
Edition, Uniform Building Code, will be the last edition published for the
Uniform Building Code, Starting in the year 2000, publication of the
International Building Code will represent a combined effort of the three
model code groups, ICBO, BOCA and SBCCI. The IBC will bring about
consistent standards across the nation,
C. Overview of Citation Authority Program
This item was tabled to the end of the Director's Comments/Reports,
D, Status Report of Proposed Housing Inspection Program for R-3
Occupancies
This program is proposed to assess a fee for cost recovery for single
family dwellings and duplexes, which are non-owner occupied, A direct
nexus has been drawn between the 1,600+ complaints received by the
Department and non-owner occupied properties, In meeting with various
groups within the community, concerns were expressed that such a
program is an unnecessary tax, The program allows for enforcement of
property maintenance standards by assessing a fee for services rendered,
Board Member O'Neill inquired whether the program will only cover
enforcement of vehicles and trash, or all health and safety issues,
Director of Building and Housing Larsen replied that it will cover
enforcement of Model Codes, Property Maintenance Standards and the
Chula Vista Municipal Code,
Board Member O'Neill suggested that fees should also be assessed to
tenants and not just the owners.
Board Member Harter concurred that tenants should also be held liable for
their actions. He further stated that many items are addressed within the
rental agreements; therefore, the owners should not be the only
responsible parties,

Director of Building and Housing Larsen acknowledged sensitivity to Board
Members O'Neill and Harter's concerns; however, responded that owners
are ultimately responsible for the conditions of their rental properties.
Director Larsen stated that the Department will develop the parameters of
the program and will bring it back to the Board for review,
E. Sunbow Development
United Enterprises developed approximately 500 homes and filed for
bankruptcy in 1991, A new developer will be continuing/completing the
project. The development will connect Medical Center Drive through to
Palomar Street. The first phase will include approximately 600 homes.
The City is also negotiating with the new developer to relocate the City's
Corporation Yard, The Grading Plans are being reviewed for approval and
it is anticipated to be presented to Council approximately in December.
Grading is anticipated to begin in January, 1997; and construction to begin
in Spring of 1997.
C, Overview of Citation Authority Program
Assistant Director of Building and Housing Remp provided a slide
presentation of the program, (See attached for presentation contents),

7. ADJOURNMENT: Chairman Triplette adjourned the meeting at 6:22 p,m, to the
next regular meeting scheduled for November 11, 1996
