HomeMy WebLinkAbout1999/04/12 Board of Appeals & Advisors Agenda Packet - , if; /'¡ "3 BOARD OF APPEALS AND ADVISORS STAFF REPORT Item No.: Meeting Date: 4/12.199 ITEM TITLE: Review and Recommendations for Adoption of the Following Codes: California Uniform Building Code, 1998 Edition Uniform Building Code, 1997 Edition with Amendments California Mechanical Code, 1998 Edition Uniform Mechanical Code, 1997 Edition with Amendments California Plumbing Code, 1998 Edition Uniform Plumbing Code, 1997 Edition with Amendments California Electrical Code, 1998 Edition National Electrical Code, 1996 Edition with Amendments California Fire Code, 1998 Edition Uniform Fire Code, 1997 Edition with Amendments California Energy Code, 1997 Edition California Referenced Standards Code, 1998 Edition Uniform Housing Code, 1997 Edition with Amendments Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition with Amendments Urban-Wildland Interface Code, 1997 Edition with Amendments SUBM11U.;D BY: Assistant Director of Planning and Building Adoption of the 1998 Edition of the California Codes and the 1997 Editions of the Unìfonn Codes is a routine action undertaken by the Planning and Building Department every three years in response to newly published Codes, The adoption of this Code is in conformance with City Council Policy 500-04 as adopted by Resolution 5656 which endorses the establishment and maintenance of Unifonn Building Regulations within the jurisdictions of the County of San Diego, RECOMMENDATION: THAT THE BOARD OF APPEALS AND ADVISORS ENDORSE COUNCIL ADOPTION OF THE ABOVE REFERENCED CODES AS AMENDED, DISCUSSION: As mandated by the Building Standards Commission, State of California, each jurisdiction within the State shall enforce the 1998 Editions of the California Building Standards Codes commencing on July I, 1999. The Califomia Building Standards Codes adopt the 1997 Editions of the Unìfonn Codes, published by the International Conference of Building Officials, with amendments, The City of Chula Vista has traditionally adopted these Unifonn Codes with further local amendments, Building Officials representing - jurisdictions throughout San Diego County have met collectiveJy to discuss suggested modifications to the local codes and have reached a consensus to work toward minimizing the number and scope oflocal amendments, This package of proposed Ordinance changes reflects that philosophy by eliminating existing local amendments wherever possible. New to this cycle of the code adoption process is the actual adoption of the California Building Standards Codes. In previous cycles these Codes have not been specifically adopted, though the City has always been responsible for their enforcement at the local level. On the advice of the City Attorney and the California Building Standards Commission, staff is recommending these State Codes also be specifically adopted in order to avoid possible challenges to the City's ability to enforce these codes using the enforcement methods identified elsewhere in the Municipal Code, In addition to specifically adopting the State Codes, the Fire Department is also recommending Council adopt the 1997 Edition of the Urban-Wildland Interface Code, Regulations in this code are intended to mitigate the risk to life and structures fiom intrusion of fire from wildland fire exposures and fire exposures from adjacent structures and to mitigate structure fires fiom spreading to wildland fuels. FISCAL IMP ACT: None. There is no increase in fees being proposed in conjunction with this adoption. The Building Division anticipated the need for additional code books and training guidebooks and has secured them using funds fiom the current fiscal year's budget. Limitaôons of Authority-Section 105.2 is added. Section 105.1 of the UBC, as it applies in the City of Chula Vista, is hereby amended to read as follows: Section 105.1 Board of Appeals and Advisors. To determine the suitability of allernate materials, methods of constmctinn and to provide for reasonable interpretation of the provisions of this code, there shall be and is bereby created a Board of Appeals and Advisors consisting of seven members who are qualified by experience and II3ining to pass upon matters pertaining to building construction. Section 105.2 Limitations of Authority, The board of appeals shall have no authority relative to interpretation of the administrative provisions of this code nor shall the board be empowered to waive requirements of the code. 15.08.040 Exempted Work-Section 106.2 is amended to delete exempôons for certain types of constmction from the requirement to obtain a building permit. Standards of Quality- Section 1701.4 is added. Section 106,2 of the Uniform Building Code as it applies in Chula VISta shall read as follows: Section 106.2 EXEMPTED WORK No person, firm, or corporation shall erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish any building or structure in the city of Chula Vista or cause the same to be done without first obtaining a separate building permit for each such building or structure from the building official except as follows: 2 A. Fences up to seventy-two incbes and free stJInding masonry walls up to forty-eight inches in height above the highest adjacent grade. B, Detached patio covers, not exceeding twelve feet in height, with a projected roof area not to exceed one-hundred forty-four square feet and at least six feet ftom any building or structnre on the same property. C. One-stoIy detached accessory buildings, not exceeding twelve feet in height used as tool and stornge sheds, playbooses and similar uses, provided the projected roof area does not exceed one-hundred fourty-four square feet and are located so as to comply with the provisions of Chula VlStI Municipal Code. Secticm 19.58.020. D, Oil derricks E. Movable cases, counters, and partitions not over five feet, nine inches in height F. Retaining walls which are not over three feet in height measured ftom the top of the footing to the top of the walL unless supporting a surcharge or impounding flammable liquids. G, Television and radio antennas less than thirty-five feet in height, H. Awnings projecting not more than fifty-four inches and attached to, and supported by, the exterior walls of buildings of Group R-3, Division 3 or U Occupancy, L Platfunns, walks and driveways not more than thirty inches above grade and not over any basement or story below. 1. Temporary motion picture, television and theater stage sets and scenery. K Prefabricated swimming pools accessory to a Group R, Division 3 Occupancy in which the pool walls are entirely above the adjacent grade and if the capacity does not exceed five-thousand gallons, L Fish ponds, reflective pools or other decorative water containers with a wet swface area of one-hundred square feet or less and a maximmn depth of eighteen inches to the flood rim M. Repairs which involve only the replacement of component parts of existing work with similar materials for the pmpose of maintenance, and which do not aggregate over $5()(),()() in valuation in any twelve- month period, and do not affect any electrical, plumbing or mechanical installations, Repairs exempt from pennit requirements shall not include any addition, change, or modification in consInictiOn, exit facilities, or pennanent fixtnres or equipment Specifically exempted from permit requirements withont limit to valuation are: 1. Painting, papering, decorating and similar worl<. 2, Jnstallation of floor covering, 3. Cabinet work. 4, Outside paving of R-3 and U Occupancies paIking swfaces. (CCR Title 24 Disabled Access Required.) 5, Re-roofing buildings of Group R and U Occupancies of less than five-hundred square feet or less than fifty percent of roof covering replacement 3 TIris section shall not be construed to require separate building permits for dwelling and accessory buildings or structures on the same property which are described in the building permit application, plot plan and other drawings. Exemption fimn the permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of the City of Cbu1a VISta. 15.08.050 Section 107 amended by adding subsection 107.8 Exceptions, waiving fees for government entitia Section 107,7 Exceptions, The Uuited States Government, State of California, school districts, cmmties. cities and other public agencies shall not be required to pay any fees for filing an application for a building permit pur.;uant to this code. Section 107.8 Retention of Plans, The retention of plans, specifications and permits are for the life of the building. Therefore, the applicant shall be charged a fee to cover the actual cost of microfilming such documents as specified in the master fee schedule, 15.08.060 Subsection 108.L1 added to Section 108.1 to authorize compliance survey inspections. Subsection 108,1.1 is hereby added to Section 108.1 of the Unifmm Building Code, as it applies in Cbu1a VlSta, and said subsection (h) shall read as follows: Section 108, Ll Compliance Smvey Inspection. Upon receipt of a written request for a compliance survey from the owner and payment of the fee specified in the master fee schedule, the building official may inspect an existing structme to ascertain its compliance with the provisions of this code and other applicable laws and orrlin""""", and report fintli'W' in writing to the Owner, 15.08.070 Subsection 709.4.1 amended to add an exception to the requirement for parapets. EXCEPTION 6 is hereby added to subsection 6 of Subsection 709.4,1 of the Uniform Building Code, as it applies in Chula Vista, which EXCEPTION 6 shall read as follows: Exception 6. Conversion of existing Group R occnpancies to offi=, 15.08.080 Subsection 904.2.1 amended to require installation of automatic fire-extinguishing system in buildings greater than certain height. Subsection 904.2,1 of the Uniform Building Code is hereby amended, as it applies in Chula Vista, by the addition of the following: In every building reganlless of occupancy, group or type of construction, when such building is more than forty feet or four stories or more in height 15.08.090 Section 1503 amended to provide for more restrictive roof coverings. Section 1503 of the Uniform Building Code as it applied in Chula VISta is amended as follows: 4 Section 1503. That a new Chapter 15.10 of the Chula Vista Municipal Code is hereby added to read: Chapter 15.10 REFERENCED STANDARDS CODE Sections: 15.10.010 California Referenced Standards Code, 1998 Edition, adopted by reference. 15.10.020 Subsection 12.1.105.1 of Sedion 12.1.105 amended to Designate Board of Appeals and Advisors as Board of Appeals. 15.10.010 California Referenced Standards Code, 1998 Edition, adopted by reference. There is hereby adopted by reference that certain document known and designated as the California Referenced Standards Code, know as California Code of Regulations Title 24, Part 12, 1998 Edition as copyrighted by the International Conference of Buildiog Officials. Said document is hereby adopted as the California Referenced Standards Code of the City of Chula Vista, California for the ¡n¡rpose of providiog minimum standards to safeguard life or limb, health, property and public welfare by regulating and controlling the design, construction, quality of materials, use and occupancy, location and maintenance of all buildings and sttuctures within this jurisdiction and certain equipment specificaJJy regulated herein, 15.10.020 Subsection 12.1.105.1 of Section 12.1.I05 amended to Designate Board of Appeals and Advisors as the Board of Appeals. Subsection 12,1.1 05.1 of Section 12.1.1 05 of the California Referenced Standards Code, 1998 Edition, and the title precedent thereto, as it applies in Chula Vista, is hereby amended to read as follows Board of Appeals and Advisors Section 12.1.1 05.1 Genera1. In order to hear and decide appeals of orders, decisions or determinations made by the building official or fire chief relative to the application and interpretations of this code, there is hereby established a Board of Appeals and Advisors consisting of seven members who are qualified by experience and training to pass upon matters pertaining to building construction, use and occupancy. The assistant director of planning and building and the fire marshal shall be ex- officio members who shall not be entitled to vote. The assistant director of planning and building shall act as secrewy to the Board, The Board of Appeals and Advisors shall be appointed by the mayor and confirmed by the city council. The Board shall render all decisions and findings in writing to the assistant director oJ:planniog and building with a duplicate copy to the appellant. Appeals to the Board shall be processed in accordance with the provisions contained in Chapter 5 of this code or in accordance with such procedures as may be prescribed by the City Attorney of the City of Chula Vista. The decision of the Board is finaJ. The Board of Appeals and Advisors shall recommend to the city council such new legislation deemed necessary to govern construction, use and occupancy of structures, in the City of Chula Vista SECTION n. Said docmnent is hereby adopted as the Plumbing Code of the City of ChuIa VISta for regulating the complete ind»Tlation, lt1aint....ance and repair of plumbing, drainage systems, water systems, gas systems, private sewage disposal systems on all properties and within all buildings and structures in the City, Providing for the issuance of permits and collection of fees therefor and each and all such regulations, provisions, penalties, conditions and tenns of the r,,1;fomia P11Dnbiru>: Code ]998 Edition and Unifonn Plumbing Code, -l994 1997 Edition, and Appendices A, B, D and H are hereby referred to, adopted, and made a part thereof as though fully set forth herein, excepting such portions as are hereinafter deleted, modified or am....nen 15.28.020 Section 102.1 amended to designate building otrtciaL Section 102.1 of the UPC as it applies in ChuIa Vista shall read as follows: Administrative Authority. Section 102,1 The Administrntive Authority shall be the assistant director of n¡annin" and buildin" DHaeler of BuiIèing aOO IIoHSiHg the Authority duly appointed to enforce this code. 15.28.030 Section 103.4.1 ammded to have fees reference city's Master Fee Schedule. Subsection 103.4.1 of Section 103.4 "Fees" of the UPC as it applies in Chula Vista shall read as follows: 103.4.1 Permit Fees, The fee for each pennit shall be set forth in the Master Fee Schedule of the City of ClwIa Vista. 15.28.040 Sedion 103.4.4 ammded to exempt imposition of investigation fees for emergency worl<. Subsection 103.4,4 of Section 103.4 "Fees" of the UPC as it applies in Chula Vista shall read as follows: Section 103.4.4 Investigation Fees, Subsection 103.4.4.1 Whenever any wOIk for which a permit is required by this code has been comm"",,".d without fin;( obtaining said permit, a special investigation shall be made before a pemrit may be issued for such work Subsection 103.4.4.2 An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The investigation fee shall be equal to the amount of the pemrit fee that would be required by this code if a pemrit were to be issued. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code, nor from any penalty prescribed by law. Subsection 103.4.4.3 This provision shall not apply to emergency work when it shall be proven to the <:Iri.m.criQll of the Administrntive Authority that such wOIk was urgently necessary and that it was not praclical to obtain a permit before cnmm""""II1ent of the work In all such cases, a permit must be obtained as soon as it is prnctical to do so, and if there be an IIIlreaSOnable delay in obtaining such permit, the investigation fee as herein provided for shall be chaIged 15,28.050 Sedion 103.5.6 ammded to reference the city's Master Fee Schedule. Section 103.5.6 of the UPC as it applies in Chula VIsta shall read as follows: Section 103.5,6 Reinspections, A reinspection fee may be assessed for each inspection or reinspection when such portion of work for which inspection is called is not completed or when required corrections have not been made, This provision is not to be interpreted as requiring reinspection fees the fin;( time a job is rejected for failure to comply with the requirements of this code, but as controlling the prnctice of calling for inspections before the job is ready for inspection or reinspection. Reinspection fees may be assessed when the approved plans are not readily available to the inspector, for failure to provide access on the date for which the inspection is required, or for deviating from plans requiring the approval of the Administrntive Authority. To obtain a re-inspection, the applicant shall file an application in writing upon the form furnished for that pwpose and pay the re-inspection fee in acconIance with the Master Fee Schedule of the City of Chula VIsta. In indJmres where reinspection fees have been assessed, no additional inspection of the work will be performed until the required fees have been paid. SECTION II, FINDINGS AND DECLARA nON The City Council of the City of CbuIa Vista specifically and expressly finds and declares that the nature and uniqueness of the climate, temIin, and location does necessitate and demand specific .mP.nrlments to the California Plumbing Code, 1998 Edition and the Unifmm Plumbing Code, 1997 Edition which are noted in the CbuIa VISta Mnnicipal Code and restated in this Ordinance.
