1a. The Board of Appeals and Advisors is legally empowered to (1) investigate and advise on the suitability of alternate
materials and types of construction, (2) provide reasonable interpretations of the building laws where the meaning may
be obscure, and (3) recommend new legislation to the City Council. The Board may recommend approval of minor
deviations of the building laws in certain cases.

Addendum to Application for a Code Modification or Use of
An Alternate Material or Method of Construction
This application is submitted to the Board of Appeals on behalf of Gateway Town
Center, LP to appeal Ordinance No. 2643 Section 15.36,090, Fire Extinguishing Systems-
Standpipe Requirements-Table 1004-A Amended (attached herein as Exhibits "A" &
"B"), This Section amends Table I 004-A of Article 10 of the 1994 Unifonn Fire Code
wherein standpipes are only required on sprinklered buildings of 4 stories or more but
less than 150' in height. Section 15.36,090 requires standpipes on "occupancies 3 stories
or more but less than 150' in height, except Group R, Division 3."
Not only is Section 15,36,090 inconsistent with the 4 story requirement of the 1994
Unifonn Fire Code, but it is also inconsistent with Section 904,6,2 and Table 9-A,
Standpipe Requirements, of the 1994 Unifonn Building Code (attached herein as Exhibits
"c" & "D") which also only requires standpipes on buildings of 4 stories or more,
The fact that all units are sprinklered as per the NFP A 13-R system, the standard for
residential occupancies up to and including 4 stories, and that the size of the buildings do
not lend themselves to fighting a fire from within utilizing a 2112" hose, and that the fue
trucks can park as close as 20' from the buildings, and that the hydrants are installed at
required distances, and that the alarms are sounded by the activation of the sprinkler
system, all indicate that the installation of standpipes appear to be redundant and
unnecessary.
Wenners Multi-Family Corporation, our General Contractor, has either completed or is
under construction on projects totaling 1,951 units in Northern California (Newark,
Dublin), Orange County (Rancho Santa Margarita, Mission Viejo, Aliso Viejo), and San
Diego, All of these municipalities adhere to the Unifonn Fire Code and the Unifonn
Building Code, and none require standpipes in 3 story apartment buildings. Requiring
standpipes on 3 story buildings does not therefore appear to be standard in the industry.
Gateway Town Center, LP therefore respectfully requests that our standpipe requirement
be held in compliance with both the 1994 Unifonn Fire Code and the Unifonn Building
Code, and that we be excluded from Section 15.36.090 ofChula Vista Ordinance 2643
and that our standpipes on our 3 story buildings be eliminated,

904.6 Buildings under Construction.
904.6.1 General. During the construction of a building and until the permanent fire-extinguish- ,I
ing system has been installed and is in service, fire protection shall be provided in accordance with 'I

904.6.2 Where required. Every building four stories or more in height shall be provided with not I
less than one standpipe for use during construction, Such standpipes shall be installed when the
progress of construction is not more than 35 feet (10 668 mm) in height above the lowest level of I
fire department access, Such standpipe shall be provided with fire department hose connections at
accessible locations adjacent to usable stairs and the standpipe outlets shall be located adjacent to
such usable stairs. Such standpipe systems shall be extended as construction progresses to within
one floor of the highest point of construction having secured decking or flooring.

STAFF REPORT
BOARD OF APPEALS
TOPIC: Proposed Ordinance Change to Section 15.36.090 of the Chula Vista
Municipal Code. The change will do away with requiring Standpipes
in structures three stories but less than 150 feet in height.

RECOMMENDATION: Staff recommends that the Board of Appeals grant the
requested change, requiring standpipes in structures four stories or more but less than 150
feet in height.
BACKGROUND: During the adoption of the 1991 Uniform Fire Code, the Fire
Marshal made an amendment to Article 10, The amendment made, in the
Chula Vista Municipal Code, are 15,36,090 (Fire Extinguishing Systems - Standpipe
Requirements - Table 1004-A amended). It reads as follows; the category of Group 2,
under the column labeled "Occupancy", Table 10-A of Article 10, of the UFC as it
applies to the City of Chula Vista, is hereby amended to read; 2, Occupancies 3 stories or
more but less than 150 feet in height, except Group R, Division 3,
DISCUSSION: During the 1991 Uniform Fire Code adoption process, Article 10 of the
Uniform Fire Code was amended locally to require standpipes in any structure three
stories or more but less than 150 in height, except in Group R, Division 3, When the
1994 Fire Code was adopted, the Fire Department retained the amendment as written
during the 1991 adoption,
The amendment change was made by the previous Fire Marshal, who believed that the
staffing and resources were limited when advancing lines above the first floor. The
Municipal Code amendment was implemented to mitigate a perceived tactical limitation.
This limitation has not been realized within our department. Our engine companies have
the resources and abilities to advance fire-fighting lines to the third floor without any
undo hardship on the fire fighters, There have been no noticeable time delays when
suppressing fires above ground level, especially when advancing lines to the third floor.
The Municipal Code amendment should have been changed during the adoption of the
1994 Uniform Fire Code, This was an oversight on the Fire Department's part, I have
reviewed the Municipal and Fire Codes and believe it is time to eliminate this part of the
Municipal Code, There are no hard facts, which support the need for the Municipal Code
amendment. We plan to adopt the 1997 Uniform Fire Code as written, which will do
away with the current Municipal Code amendment. By eliminating the Municipal Code
amendment, we will come into line with most of the fire departments within San Diego
County.
The requirement, for standpipes in the ] 994 and ] 997 Unifonn Fire Code, is standpipes
will be instalied in occupancies 4 stories or more but less than] 50 £1, in height and have
exempted occupancies Group R, Division 3. When trying to advance fire-fighting hose-
lines above the third floor it becomes very difficult for fire fighters. The time increases
drastically and the efficiency is almost none,
CONCLUSION: When the Fire Department adopts the 1997 Uniform Fire Code in July,
we normally will not require standpipes in structures less than four stories in height. This
is the recognized standard within the industry, By allowing the ordinance change at this
time, the City of Chula Vista will become consistent with most other fire agencies within
San Diego County. As the Fire Marshal, I highly recommend that the Board of Appeals
allow the requested change.
