A Project Setting
The L95-acre, unoccupied project site IS located at 995 Bay Boulevard, south of "L" Street and west
of Interstate 5 (refer to Exhibit A), The parcel is a triangular-shaped, relatively flat lot A swale runs
across the southern portion of the property in a westerly direction, The site frontage along Bay
Boulevard is approximately 596 feet and is approximately 400 feet along Interstate 5, The majority
of the propel1y is covered with non-native vegetation and overgrowth, Surrounding land uses consist
of the fol1owing:
North - (Across lnterstate 5 on-ramp) Undeveloped Parcel
East- Interstate 5
South - lndustnal Supply Warehouse
West-- (Across Bay Blvd,) SDG&E Power Plant
B, Project Description
The proposed project consists of a 31,781 square-foot, single-story concrete tiIt-up building for
warchouse and administrative office uses (refer to Exhibit B), Proposed improvements include
permanent paving, striping, perimeter and interior landscape treatments, exterior wal1lighting, minor
retaining wal1s and drainage improvements, The proposed business hours of operation are from 7:00
a,rn, to 6:00 p,m, The only business operations that would not occur within an enclosed building is a
single loading dock along the south elevation, The proposed project requires a Conditional Use
Pennit to be considered by the Planning Commission and Design Review by the Design Review
Committee, In addition, the proponent wil1 be required to obtain a Coastal Pennit from the California
Coastal Commission,
Previous tenant use included an auto wrecking facility (Logan Auto DismantlinglWrecking Yard) that
was in operation from 1969 to 1985, The site has been vacant since 1985,
C Compliance with Zoning and Plans
The property is zoned IP (Industrial) and is designated Limited Industrial (IL) by the City's General
Plan, Tlie proposed use of tlie site is consistent with the General Plan, zoning designation. and the
City's adopted environmental plans and policies,

D, Identification of Environmental Effects
An Initial Study conducted by the City of Chula Vista (including the attached Environmental
Chccklist fonn) detennined that the proposed project wi]] not result in a significant environmental
effect Therefore, the preparation of an Environmental Impact Report wi]] not be required. This
Mitigated Negative Dcclaration has bcen prepared in accordance with Section 15070 of the State
CEQA Guidelines,
Water/Drainage
The project site is not located within the FEMA Floodway Frequency Boundary and is outside the
500-year flood plain, No flooding impacts would result rrom development of the industrial building.
Existing on-site and off-sitc drainage facilities would not be adequate to serve the proposed project
The existing on-site drainage facility consists of an earthen swale along the southern portion of the
property, The preJiminary grading and improvement plans and drainage study that have been
submitted by the appJicant indicate that the following drainage improvements will be necessary:
· Rcplacement of the existing off~site 18-inch reinforced concrete pipe (RCP), that runs across Bay
Boulevard, with two 24-inch RCPs; and,
· Insta]]ation of rip-rap (drainage faciJity that contains large boulders to catch fast flowing water)
across Bay Boulevard to the west at the north and south end of property and;
· Insta]]ation of on-site drainage improvcments that includc installation of a dirt swale with catch
basin and 24-inch and 27-inch RCPs along the southern portion,
According to the Engineering Division of the PubJic Works Department, the proposed preJiminary
drainage improvements appear to be adequate to handle the increased on-site and ofT-site drainage
that will be generated by the proposed project Prior to the issuance of the grading penn it, the
Engineering Division wi]] detennine the required drainage improvements,
Compliance with National Pollutant Discharge EJimination System (NPDES) Order No, 2001-01 and
implementation of appropriate Best Management Practices (BMPs) to the satisfaction of the City
Engineer are required during and after development to prevent erosion and sedimentation, as we]] as
the discharge of other pollutants, into the downstream stonn drain system, NPDES Order No, 2001-
01 requires a]] parking lots of 5,000 square feet or more, or with 15 or more parking spaces, and
potentially exposed to urban runofTto provide appropriate BMPs,
All grading operations wi]] be performed in compliance with the City of Chula Vista Grading
Ordinance (Ordinance 1797, as amended). Short-term erosion of the cut and fill slopes would be
reduced to a less than significant level by the installation of temporary desilting and erosion control
devices to the satisfaction of the City EngineeL These devices include de silting basins, berms, hay
bales, silt fences, dikes, and shoring, Protective devices wi]] be provided at every storm drain inlet
to prevent sediment from entering the storm drain system, Additional erosion control measures will
be installed as required by the City EngineeL No significant impacts to ground water would result
because there would be no additions or withdrawals from the local aquifeL
Compliance with NPDES Order No, 2001-01, through the implementation of appropriate BMPs, as
specified below in Section F. would mitigate potentially significant water quality impacts tD belDw a
level Df significance,

Air Quality
Based upon the limited amount of site grading that will be necessary to accommodate the proposed
development and the projected amount of project-generated tTaffic, 231 Average Daily Trips (ADTs).
the proposal would not result in the violation of any air quality standard or contribute to an existing or
projected air quality violation, The proposed project would potentially generate sufficient
construction vehicle emissions and dust during construction-related operations to result in a short-
tenn significant, but mitigable, impact to air quality, Fugitive dust would be created during
construction operations as a result of clearing, earth movement, and travel on unpaved surfaces,
Although air quality impacts resulting from construction-related operations are potentially significant,
they are considered short-tenn in duration since construction-related activities are a relatively short-
term, one-time activity, Dust control during grading operations would be regulated in accordance
with the rules and regulations of the County of San Diego Air Pollution Control District (APCD) and
the California Air Resources Board, Construction operations will be subject to the mitigation
measures outlined below in Section F,
Geophysical
The project site, consisting of 1,95 acres, contains a building pad that has been sheet-graded to the
southwest, and no structures currently exist on the site, A geological investigation of the project site
was conducted to evaluate the on-site geology and potential geologic hazards that might affect the
proposed project According to the preliminary geotechnical study prepared by Geotechnical
Exploration, [nc" dated May 24, 2002, no faults were shown to cross the project site, To date, the
nearest known active fault to the subject site is the northwest Rose Canyon fault located
approximately 7,3 miles trom the site, According to the study, the risk of on-site liquefaction due to
seismic shaking is considered to be remote due to the high density of the natural ground matenaL
According to the study, there are no known geophysical conditions on the site that would expose
people to geologic or earth hazards,
A natural swale runs east to west across the south portion of the property. The swale feeds into a
cleanout and catch basin along the southwest portion of the project site, The proponent proposes to
install two desilting basins, one at the northwest comer and another at the southwest corner of the site,
The drainage would continue to flow into the drainage system at that location which travels under
Bay Boulevard and then above ground, further south along Bay Boulevard,
The project site will be graded and paved to accommodate the industrial building and parking lot
Minimal grading will take place closest to the freeway along the eastern portion of the project site.
The existing elevation of the project site is 27,5 feet above sea-level and the proposed elevation will
not differ much from the existing elevation. The applicant proposes to import 1,700 cubic yards of
fill to spread across the site, The fill soil would be obtained from the grading of the Phase 11 area of
the L Street Self Storage project located at 707 "L" Street, northeast of Interstate 5. Compliance with
the Traffic Engineering requirements regarding the transporting of soil along approved hauling routes
is required. The haulmg regulation IS suftìcient to mitigate any potential impacts to a level of less
than significant
Although grading operatlOns will be perfonned m compliance with the City of Chula Vista Grading
Ordinance (Ordinance 1797, as amended), significant erOSlOn Impacts could occur dunng the
excavation and construction period due to disruptions of the soiL Soil erosion could result in
sedimentation in the stonn drain system resulting in a significant impact unless mitigated to a level of

less than significant Compliance with National Pollutant Discharge Elimination System (NPDES)
Permit Order No, 2001-01 and the implementation of Best Management Practices (BMPs) during and
after construction to prevent erosion and the discharge of sediment into the downstream storm drain
system wi]] be required. Soils erosion impacts would be mitigated to below a level of significance
through implementation of the measures contained in Section F below,
Aesthetics
The project is located in an urbanized area, The proposed project consists of a 31,781 square-foot,
26-foot high single story concrete tilt-up warehouse building with wa]]s to separate individual units
for warehousing and administrative offices,
Proposed on-site improvements include landscaped treatments, paved parking lot, and retaining wa]]s,
There would be no building height impediments that would block any scenic vista or public
viewpoints on, or adjacent to, the property as the project meets the City's building height limitation,
The proposed project as designed would not result In signitìcant aesthetic Impacts or create addItIOnal
light spi]]age onto Interstate 5 or adjacent Bayfront properties and street segments,
Hazards
The proposed project would not involve operations involving hazardous substances at this time, As a
standard condition, upon tenant improvements a business plan that identifies the type, location,
storage and use of any hazardous materials sha]] be filed with the City Fire Department and County of
San Diego Environmental Health Department The development of the industrial building would not
interfere with existing emergency response or evacuation plans.
According to the Phase I Environmental Site Assessment (ESA) prepared by CERES Technologies,
Inc., dated June 12,2000, an area of stained soil (lO-feet x l2-feet) was reported, Based on this
finding a Phase II ESA, was prepared by the same consultant According to the amended Phase II
ESA report, dated October 9, 2001, measurable mitigation would be achieved with excavation and
removal of the soil by a licensed hazardous waste hauleL The amount of soil removed fi]]ed
approximately two Department of Transportation (DOT) approved 55-gallon drums, According to
an environmental assessment letter report sent to the Environmental Section, prepared by CERES
Technologies, dated November 12, 2001, the remediation and removal work was completed by a
licensed hazardous waste hauleL This remediation action rendered the soil contamination to a level
of less than significance, No mitigation measures are required,
E Public Comments
On August 5, 2002, a Notice of Initial Study was circulated to property owners within a 500-foot
radius of the proposed project sik The public review period ended August 16,2002,
F, Mitigation Necessary to Avoid Significant Impacts
Geophysical
L Prior to the commencement of grading, temporary desilting and erosion control devices sha]] be
insta]]ed, These devices include desilting basins, berms, hay bales, silt fences, dikes and shoring,

Protecti ve devices will be provided at every storm drain Inlet to prevent sedIment from entering
the storm drain system, These measures shall be reflected in the grading and improvement plans
to the satisfaction of the City EngineeL
2, Prior to the commcncement of grading, catch basin filters shall be installed to prevent trash and
silt from entering the stonn drain system, Catch basin filters shall be maintained and inspected as
scheduled by the City of Chula Vista Engineering Department. These measures shall be reflected
in the grading and improvement plans to the satisfaction of the City EngineeL
Water
}, Prior to the issuance of any grading pennit, the City Engineer shall verify that the final grading
plans comply with the provisions of California Regional Water Quality Control Board, San Diego
Region Order No, 2001-01 with respect to construction-related water quality best management
practices.
4, Prior to the issuance of any grading or building pennit, the City Engineer shall verify that the
grading or construction plans comply with the provisions of California Regional Water Quality
Control Board, San Diego Region Order No, 2001-01 with respect to permanent, post-
construction water quality best management practices (BMPs), If one or more of the approved
post-construction BMPs is non-structural, then a post-construction BMP plan shall be prepared to
the satisfaction of the City Engineer prior to the commencement of construction; compliance with
said plan shall become a pennanent requirement of the Mitigation Monitoring and Reporting
Program,
Air Quality
5, Dust reducing measures shall include watering of graded surfaces in accordance with the most
stringent County of San Diego Air Pollution Control District and California Air Resources Board
rules and regulations and the restriction of all construction vehicles and equipment to travel along
established and regularly watered roadways at specified speeds,
6, During construction, stockpiled materials that can potentially become airborne shall be covered or
watered in accordance with the most stringent County of San Diego Air Pollution Control District
and California Air Resources Board rules and regulations,
7, During construction, dirt and debris shall be washed down or swept up as SOOn as practicable to
reduce the resuspension of particulate matter caused by vehicle movement over such materiaL
Approach routes to the construction area shall be cleaned daily of construction-related dirt and
debris,
8, In accordance with California Vehicle Code Section 23114, vehieles transporting loads of
aggregate materials must cover/tarp the material, or ifnot covered, the material must be no nearer
than six inches from the upper edge of the container area where the material contacts the sides,
front, and back of thc cargo container area, and the load shall not extend, at its peak, above any
part of the upper edge of the cargo containcr area,
9, Construction equipment shall be tuned prior to the start of construction and shall be maintained in
proper working order in order to minimize air pollutant emissions; use of low pollutant-emitting
construction equipment, including electrical-powered equipment, shall be used as practicaL

This Mitigation Monitoring and Reporting Program has been prepared by the City ofChula Vista
in conjunction with thc proposed Bay View Industrial Centre project (IS-02-43), The proposed
project has been evaluated in an Initial Study/Mitigated Negative Declaration (IS/MND)
preparcd in accordance with the California Environmental Quality Act (CEQA) and City/State
CEQA Guidelines, The legislation requires public agencies to ensure that adequate mitigation
measures are implemented and monitored for Mitigated Negative Declarations, such as IS-02-43,
AB 3180 requires monitoring of potentially significant and/or significant environmental impacts.
The Mitigation Monitoring and Reporting Program for this project ensures adequate
implementation of mitigation for the following potential impacts(s):

MONITORING PROGRAM
Due to the nature of the environmental issues identified, the Mitigation Compliance Coordinator
shall be the Environmental Review Coordinator for the City of Chula Vista. The applicant shall
be responsible to ensure that the conditions of the Mitigation Monitoring and Reporting Program
are met to the satisfaction of the Environmental Review CoordinatoL Evidence in written fonn
confinning compliance with the mitigation measures specified in MND/IS-02-43 shall be
provided by the applicant to the Environmental Review CoordinatoL The Environmental Review
Coordinator will thus provide the ultimate verification that the mitigation measures have been
accomplished,
Table I, Mitigation Monitoring and Reporting Checklist, lists the mitigation measures listed in
Section E, Mitigation Necessary to Avoid Significant Effects, of the Mitigated Negative
Declaration, which will be implemented as part of the project. In order to detennine if the
applicant has implemented the measure, the method and timing of verification are identified,
along with the City department or agency responsible for monitoring/verifying that the applicant
has completed each mitigation measure, Space for the signature of the verifying person and the
date of inspection is provided in the last column,

Comments: According to the Engineering Division, the trip generation for the project is estimated to
231 average daily trips (AUf), The primary access roads are "L" Street and Bay Boulevard, Access to
the proposed industrial center would be via two driveways off of Bay Boulevard. The Engineering
Division reports that the primary access roads are adequate to serve the project.
"L" Street is a Class I Collector street with a capacity of 22,000 ADT at Level-of-Service C. The
existing traffic v01ume on "L" Street is 14,790 ADT and with the project would increase to 14,848
ADT. According to the Engineering Division, "L" Street currently operates at Level-of-Service A and
will continue to operate at a Level-of-Service A with the proposed development.
Bay Boulevard is a Class II Collector street and has a 12,000 ADT at Level-of-Service C. The existing
traffic volume is 3,160 ADT and with the project would increase to 3,391 ADT According (0 the
Engineering Division, Bay Boulevard currently operates at Level-of-Service A and will continue to
operate at a Level-of-Service A with the proposed development. Approximately 50% of project traffic
is projected to access the site from Interstate 5,
According to the State of California, Department of Transportation (Ca1trans) letter dated April 30,

2002, the initial review of the proposed project included comments regarding the location of the
northerly driveway being too close to the Interstate 5 off-ramp, The applicant redesigned the northerly
access driveway in accordance with the Highway Design Manual, Section 504,8 (access rights), to the
satisfaction ofCaltrans as noted in their written communication dated June 17, 2002.
The Engineering Division requires the widening of Bay Boulevard to 26-feet centerline to curb with
full-street improvements (curb, gutter and sidewalk) per City Class II standards, No additional
roadway facilities are required to serve the project site, The project is consistent with the criteria
established in the General Plan Traffic Element
The preparation of a traffic control plan to be implemented during eonstruction operations will be
