1. RESOLUTION 455 AUTHORIZING PAYMENT OF $610,000 FOR THE PURCHASE OF
THE WHITEMAN PROPERTY AND APPROPRIATING FUNDS THERFOR
In a written report to the Agency, Community Development Director Desrochers
explained that in June 1982 the Redevelopment Agency deposited $990,000 with
the Superior Court and took immediate possession of the Whiteman property at
the Bayfront. Trial was set for October 18, 1983. Special Counsel Reed
discussed the matter of 1igitation in Closed Session with the members of the
Agency on numerous occasions. It was his recommendation a settlement of
$1.6 million dollars be agreed upon for the payment of the property. The
Agency members agreed; therefore, it is now necessary to approve the
additional $610,000 for the purchase of this property.
RESOLUTION OFFERED BY MEMBER McCANDLISS, the reading of the text was waived by
unanimous consent, passed and approved unanimously.
2. OTAY VALLEY ROAD
RESOLUTION 456 PRELIMI NARIL Y APPROVING OTAY VALLEY ROAD
REDEVELOPMENT PLAN AND PROJECT AREA, DIRECTING
TRANSMITTAL OF PLAN TO REQUIRED AGENCIES, AND
APPROVI NG DRAFT EIR AND DIRECTING TRANSMITTAL OF
NOTICE OF COMPLETION
In a written report to the Agency, Community Development Director Desrochers
explained that on September 14, the Agency approved the Otay Valley Road
Project Area Preliminary Plan and directed the draft Environmental Impact
Report (EIR) and the Final Redevelopment Plan to be compiled. These plans are
complete, ready for public review, and will be transmitted to the Commission
for a report and recommendation. The Commission will have 30 days to consider
the plan. The Agency will make a report and recommendation to the Council and
a joint-meeting will be called to consider approval of the plan.

Redevelopment Agency Meeting - 2 - October 25, 1983
Mr. Desrochers added this action will approve the circulation of the draft EIR
to all concerned agencies and individuals for a comment period of from 30-45
days. This review period will be at the discretion of the State Clearing
House. The Governor has not signed AB 322 and this presents a time element to
the Agency. In order to hold a public hearing for the redevelopment plan,
many hearings and dates must be considered. Mr. Desrochers stated by
distributing the plan this evening and the Agency approving the resolution, a
public hearing on the redevelopment plan can be scheduled for December 20. If
this plan is not distributed until November 3, the public hearing deadlines
cannot be assured. Discussion followed regarding the time element and deadline dates; suggestion
to cont inue all test imony to the Counci 1 Conference on Thursday; assurances
that the public will have ample review time; and counting on the good faith of
the County and taxing entities for the fiscal review period.

Henry Kohler, 1547 - 222 Sonora Drive, Chula Vista noted the Agency will be
spending 39 million dollars to redevelop the Otay Valley area. Mr. Kohler
stated he is distressed to find so much of the park land designated for
industria 1 use. He suggested the City hire a capable architect to do a master
plan of the entire area for specific zoning. Mr. Kohler submitted his
suggestions for the redeve 1 opment project, such as: olympic size swimming
~001; more park areas; Otay Valley Road having separate lanes with flowers;
ousing with sufficient parking and the area being clean of air pollution.
Mr. Larry McKenna, 1347 Mt. View Lane, Chu1a Vista objected to the Agency
considering the resolution this evening stating the general public has been
informed it would be considered at the November 3 meeting. Mr. McKenna noted
he and residents of the area will be meeting with Councilwoman McCandliss and
Mayor Cox on Friday, October 28, to discuss some of their issues. In
reviewing the EIR document, he feels there is very little substance in it -
the consultants have not addressed the issues and the qualifications of the
consultants are now being questioned. Mr. McKenna submitted 15 pages of
questions and concerns from the citizens of that area.
Michael Yee, Point Robinhood Area, also discussed the EIR stating it was a
"potentially defective document". He questioned whether the Agency would
allow public input into the document.
Agency discussion ensued reqarding including the 15 page document as submitted
by Mr. McKenna with the EIR process. Director of Planning Gray listed the EIR
process and the agencies reviewing it; Community Development Director
Desrochers described the legal time limits. Discussion continued regarding a
30 day review process or a 45 day review process.

Redevelopment Agency Meeting - 3 - October 25, 1983
Mr. Guy L itch ie, 1652 Point Sol Court, Chula Vista stated their comments
(referred to by Mr. McKenna) were submitted according to the legal publication
requirements with the draft EIR as a basis for their comments. In response to
the Agency's questions, City Attorney Harron stated it would be legal to
attach the comments presented by Mr. McKenna to the EIR which would be going
out to the various agencies.
Mr. Dick Kau, Realtor, Chu1a Vista, representing the property owners in the
Otay Valley area stated they are in favor of this project.
MSUC (Cox/Moore) to amend the resolution adding the provision that the
questions and comments raised by Mr. McKenna be included as a portion of the
draft EIR statement and a copy of those concerns and questions be included in
the EIR which will be disseminated to the public and various agencies.
Included in the motion was to have a cover memo with the EIR explaining that
those comments were submitted in response to the initial study which is a part
of the EIR - they were questions raised and should be considered in the
process of evaluating and commenting on the draft EIR.
The resolution, as amended, carried unanimously.
MSUC (Cox/Moore) to direct staff to get together with the various presidents
of the Homeowner's Associations and try to schedule a meeting within the next
two or three weeks at a suitable location for the residents of the Otay Valley
Road area so the Redevelopment Agency will have more input on the draft EIR
and the proposed Redevelopment District Plan.
Member Moore stated it would be helpful if the residents having any questions
would submit them to the City prior to the meeting. Cha irman Cox stated he
would include this in his motion. Member Moore agreed to the second and the
motion carried unanimously.
