HomeMy WebLinkAboutrda min 1982/07/08 MINUTES OF A REGULAR MEETING OF THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA, CALIFORNIA Thursday, July 8, 1982 Council Chambers 7:00 p.m. Public Services Building ROLL CALL MEMBERS PRESENT Chairman Cox; Members Malcolm, Moore, McCandliss, Scott MEMBERS ABSENT None STAFF PRESENT Executive Director Cole, Redevelopment Coordinator le91er, Development Services Administrator Robens, Special Counsel Reed, Agency Attorney L i ndber9 ALSO PRESENT Michael Cowett, James Cappos, Howard Susman ITEM NO.1 - APPROVAL OF MINUTES MSUC (McCand1iss/Moore) to approve the mi nutes of June 3 and 17, 1982 as mailed. (Chairman Cox, Member McCand1iss and Member Malcolm abstained from voting on the minutes for June 3.) ITEM NO.2 - REPORT: RECOMMENDATION TO APPOINT MR. PATRICK JUDD TO THE TOWN CENTRE DESIGN REVIEW BOARD On June 3, 1982, the Town Centre Project Area Committee reviewed a list of app 1 icants to fi 11 the current 1y vacated Des i gn Revi ew Board seat and voted to recommend that the Redeve 10pment Agency appoi nt Mr. patri ck Judd to the vacancy. In response to Member McCandl i ss I questi on concerni ng the compos it i on of the Design Review Board, Redevelopment Coordinator leg1er stated that one member is a registered architect, another member is a former planner for the City of Chu1a Vista who is currently employed with a private consulting firm, the thi rd member is from the Chul a Vi sta Pl anni ng Department, and the fourth member is a member from the community at large who shall represent the Third Avenue interest. Member Moore commented that Mr. Judd also has an office off of Third Avenue, and most of his career has been as a school teacher. MOTION TO ACCEPT STAFF RECOMMENDATION. MSUC (McCandliss/Scott) to accept the recommendation of the Town Centre Project Area Committee and appoint Mr. Patrick Judd to the Town Centre Design Review Board. Redevelopment Agency Meeting - 2 - July 8, 1982 ITEM NO.3 - REPORT: CAPPOS/"J" STREET ISSUE Thi s report addresses the issue of the land use designation that is most suitable for development of the property at the foot of "F" Street and the City-owned property at "J" Street. The report was prepared withi n the broader context of the City's adopted planning policies affecting the Bayfront. Special Counsel Reed i ndi cated that several items of litigation are to be di scussed thi s eveni ng. Therefore, he advi sed that the Agency adjourn to closed session to discuss the status of each. At this time, Mr. Mi chae 1 Cowett, Jenni ngs Engstrand and Henri kson, 2255 Camino del Rio South, San Diego (representing San Diego Shipbuilding and Repair), requested to address the Agency. He briefly discussed the contents of the 1 etter submi tted to Agency staff concerni ng 1 ease negot i at ions with his client. After talking with Agency Special Counsel, the conclusion was that the only problem evolves around the rental amendment - or, basis for determining the rent would be a liberal reimbursement to the Agency for the cost incurred to take possession of the property. Therefore, Mr. Cowett indicated that his letter is self explanatory, and he is looking for guidance from the Agency in order to negotiate the rental agreement. MOTION FOR CLOSED SESSION MSUC (McCand1iss/Scott) to recess to closed session. The Agency recessed at 7:15 p.m. to closed session and reconvened at 8:27 p.m. ITEM NO.3 - REPORT: CAPPOS/"J" STREET ISSUE Following the closed session, the Agency took the following actions. MOTION TO DIRECT STAFF TO PROCEED WITH "J" STREET STUDY MSUC (Scott/Cox) to direct staff to begin planning studies on the "J" Street property with the possibility of that property being rezoned as expeditiously as possible. ITEM NO.4 - REPORT: WHITEMAN PROPERTY CONDEMNATION Chairman Cox indicated that during closed session the Agency recei ved an update on pending litigation concerning the Whiteman property condemnation. MOTION TO DISCONTINUE NEGOTIATIONS MSUC (McCand1iss/Scott) to discontinue negotiations on the proposed lease of the Whiteman property. Redevelopment Agency Meeting - 3 - July 8, 1982 MEMBERS' COMMENTS Member Scott, referring to a Star-News article, requested clarification concerni ng the importance of the I ocatl on of the SANDER project near water as was originally presented by Supervisor Tom Hamilton's office. Member Malcolm discussed SDG&E's reimbursement pol i cy for homeowners whose homes and cars are damaged by thei r po II ut ion. Discussion followed regarding SDG&E's possible part in polluting Chula Vista, the indemnification because of the possible pollution problem by SDG&E, the need for SDG&E to come before the Agency to explain the composition of the pollution problem, and staff to contact the Air Pollution Control Board. MOTION DIRECTING STAFF TO LOOK INTO POLLUTION PROBLEM MSUC (Malcolm/Scott) to direct staff to look into the po II ut i on problem possi b 1y caused by SDG&E, the indemnification of the pollution, and have SDG&E staff come before the Redevelopment Agency to speak on these issues.
