National Dav of Mournina (President Reaaan) - Summary of various listsery recHes - The following were received Tuesday, June 8: Yesterday the responses were mostly no but that was before the state proclaimed it a Day of Mourning and that it will be a state holiday. A lot of cities were waiting for that information before making a decision. We are stiii not sure. Some cities and counties are encouraging their dept. heads to allow employees to take personal time for Friday. I have received word from several other cities today that they will follow the state as well. Michelle Schafer, California City San Marino will decide at its CC meeting tomorrow. The City of Sand City will be closed Beverly Hills will be closed The City of Palm Desert will be closed on Friday. Pomona will be open South Pasadena is not closing. City of Monterey Park is not closing. South Lake Tahoe is not closing! Last night, City of Simi Valley City Council authorized this city to be closed on Friday. City of Moorpark City Council will consider closing on Friday at its Council meeting on Wed. Simi- Rancho Park District will be closed on Friday. Thousand Oaks City Council will likely consider closing on Friday at tonight's City Council meeting. Hope this info is helpful. Scott Mitnick, Asst. Sorry, I thought we responded. We will be closing per language in both our MOUs and Personnel Regulations. Steve Adams, City of Arroyo Grande This issue came up a few times in early and mid 1980's when Johnson and Truman died and the Challenger accident. Many agencies then changed their holiday language to state that only the City Council could declare such holidays. Prior language usually stated that "or any holiday declared by the Governor or the President". If your agency did not change the definition then, now is the time to revisit the issue. Supervisory staff will be encouraged to allow subordinate staff to utilize personal time to honor former President Reagan on Friday if they so choose. We do not have any employee associations, so that is not an issue for us. The day will be paid as a holiday. The holidays in this state are: (a) Every Sunday. (b) January 1 st. (c) The third Monday in January, known as "Dr. Martin luther King, Jr. Day." (d) February 12th, known as "Lincoln Day." (e) The third Monday in February. (f) March 31 st known as "Cesar Chavez Day." (g) The last Monday in May. (h) July 4th. (i) The first Monday in September. U) September 9th, known as "Admission Day." (k) The second Monday in October, known as "Columbus Day." (I) November 11th, known as "Veterans Day." (m) December 25th. (n) Good Friday from 12 noon until 3 p.m. (0) Every day appointed by the President or Governor for a public fast, thanksgiving, or holiday. Except for the Thursday in November appointed as Thanksgiving Day, this subdivision and subdivisions (c) and (f) shall not apply to a city, county, or district unless made applicable by charter, or by ordinance or resolution of the governing body thereof. If the provisions of this section are in conflict with the provisions of a memorandum of understanding reached pursuant to Chapter 12 (commencing with Section 3560) of Division 4 of Title 1, the memorandum of understanding shall be controlling without further legislative action, except that if those provisions of a memorandum of understanding require the expenditure of funds, the provisions shall not become effective unless approved by the legislature in the annual Budget Act. Culver Heaton, Glendora City of Eureka...the answer is no...today. The City Council has to approve Presidentially proclaimed holidays as City holidays before employees get the day off. Randy Nickolaus, Eureka Chico's MOUs have specific holidays designated and "such other days as may be prociaimed by Council as public holidays. These holidays currently constitute the entire and exclusive list of legal holidays observed by City." Gov. Code Section 6700 speaks to the fact that MOUs pursuant to MMBA will control. Alicia M. Eric Berry, EI Monte The following responses were from Monday, June 7: The consensus is that it is a National day of Mourning and the only imposition on cities is to fly the flag at half-staff. Otherwise closing city halls on Friday in Memoriam is a policy decision. Thank you all for your replies. Carol Cowley, Administrative Services director/City Clerk, City of La Puente We have a clause in our MOU's that provides for a day off if the Governor and President declare a day of national prayer or thanksgiving. Because of the late notice, we will be placing a resolution for a floating holiday on our June 15 agenda. If approved, employees will be given a floating holiday to take within the fiscal year. We have a skeieton crew on Friday anyway due to alternative work schedules. Belinda B. Espinosa, City Manager, Pinole We are on a 4-10 work schedule with most offices closed on Friday. We will not be doing anything different. Paul Berlant, Town Manager, Windsor, California Per the City Manager of the City of Coalinga, we will be open for business. Sharon M. Pace, Human Resources Manager, City of Coalinga The City of La Palma currently does not close for every federal holiday (like Martin Luther King's Birthday), and all of our holidays are designated in our MOUs. As significant as the national day of mourning on Friday is, I'm reluctant to start a precedent in declaring it a holiday--it opens the door to debate of what else we will "suspend" in the MOUs. Consequently, we'll be open on Friday. We're a 9/80 city, and it's our regular "open" Friday. Cathy Standiford, La Palma :) We will not know until tomorrow night's Council meeting to see if they decide to close.... D. Christine Hach, Gardena Our City Council meets tomorrow night. In the absence of Council direction to close (I'm not planning to make one), we'll be open as usual on Friday. Our agreements identify the specific holidays observed by the city. We're not required to automatically grant holidays deciared by the state or federal governments nor am I inclined to recommend that we incur the cost of doing so in these tight budget times. The REALLY interesting question Is how this will be handled by cities that are reguiarly closed on Fridays and those cities working a regularly scheduled 9/80. THEN the question will be whether the employees get overtime for not working on a holiday they weren't scheduled to work on anyway. Eric G. Ziegler, City Manager, City of Glendora I received a lot of responses for this request. Most of the answers were no. Some were waiting to see what the Governor would do and as far as we can tell the State offices will remain open. Other agencies were waiting to see what their councils decided over the next couple of days. There was some concern regarding holidays outlined in MOU's but ours along with a couple of others allow for a Governor or President pronounced holiday for such things as mourning with adoption by City Council. At this time we will remain open and honor him with a moment of silence on Friday morning. Michelle Schafer, California City RðsE~íLLE IRA omaN' PII DE' PROGRESS HUMAN RESOURCES DEPARTMENT INTEROFFICE MEMORANDUM TO: AIL EMPLOYEES FROM: HUMAN RESOURCES SUBJECT: FRIDA Y,JUNE 11,2004 DECLARED Cny HOLIDAY DATE: JUNE 4, 2004 Due to the passing of President Ronald Reagan over the weekend, the President of the United States designated Friday, June 11, 2004, as a national day of mourning. As a result of the declared holiday City offices will be closed on Friday with the following stipulations: 1. Employees who work in emergency and utility services that must be staffed 24-hours a day will continue to work their normal schedules. 2. This non-recurring holiday cannot create overtime. For example, an employee cannot be off on Friday and then come in on overtime on Saturday to catch up on work. 3. Finally, due to the short notice of this declaration, the closure of the City offices cannot cause disruption in service. If your department! division must conduct services that cannot be rescheduled on Friday then you must work. The Civic Center will be closed. 4. Shift workers, employees on their flexible day off, and other employees who are required to work on June 11, 2004, will be granted eight hours of holiday pay (pro-rated for less than full-time employees). Employees can use the granted hours at a time that is appropriate for their work schedules during calendar year 2004. CRAIG ROBINSON City Manager RESOLUTION NO. 2004- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROCKLIN DECLARING FRIDAY, JUNE 11,2004 A DAY OF REMEMBRANCE AND MOURNING FOR PRESIDENT RONALD WILSON REAGAN WHEREAS, President Ronald Wilson Reagan, 40th President of the United States, and 33'd Governor of California, died the 5th day of June, 2004; and WHEREAS, the City Council finds that it is appropriate to set a day aside in the memory of President Reagan and in recognition of a great American patriot who had a highly profound impact in the course of history by making the world freer and who gave hope and opportunity to millions of people. NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Rocklin as follows: Section 1. The City Council hereby declares Friday, June 11,2004 a day of remembrance and mourning for President Ronald Wilson Reagan. Section 2. Bush, has by executive order directed that executive departments, independent establishments, and other federal governmental agencies be closed on Friday, June 11, 2004, as a mark of respect for former President Reagan; and WHEREAS, the Governor of California, Arnold Schwarzenegger, has declared Friday, June 11, 2004 as a day of remembrance of the extraordinary life of President Reagan.
