SMITH, CWHY RECORDER FEES: 0.00 After recording return to: City Clerk's Office City of Chula Vista 276 Fourth Avenue Chula Vista, CA 91910 This space for Recorder's use only RESOLUTION NO. 2íJO4-102 Document TiJle RESOLUTION NO. 2004-102 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DESIGNATING AND SETTING ASIDE CERTAIN CITY-OWNED REAL PROPERTY AS RlGfIT-OF-WAY FOR STREET AND PUBLIC UTILITY PURPOSES AS NECESSARY FOR THE COMPLETION OF THE EAST H STREET WIDENING PROJECT WHEREAS, the City of Chula Vista is the fee owner of that certain real property, situated in the City of Chula Vista, County of San Diego, State of California, more particularly described as Lot T of Chula Vista Tract No. 80-15, according to Map thereof No. 10051 filed in the Office of the County Recorder of said County, April 3, 1981; said land currently designated as Assessors Parcel No. 592-220-12, and Parcell according to Map thereof No. 13006 filed in the Office of the County Recorder of said County, November 15, 1983; said land currently designated as Assessors Parcel No. 592-191-19; and WHEREAS, the public need and convenience required that certain public street and highway improvements and appurtenant works be constructed and placed through, in, on, across, over, under and above a portion of the above described real property, for the widening and improvement of East H Street, said portion of said Lot T and said Parcell as more particularly described in a legal description thereof, marked Exhibit "A", and as shown on a sketch thereof, marked Exhibit "ß", both attached hereto and incorporated herein by this reference; and WHEREAS, the City Council desires to designate and set aside said real property described in said Exhibit "A" as right-of-way for street and public utility purposes. NOW, THEREFORE, the City Council of the City of Chula Vista does resolve as follows: SECTION 1. That the City Council hereby designates and sets aside a perpetual right-of-way for street and public utility purposes through, in, on, across, over, under and above the real property described in said Exhibit "N'. SECTION 2. That said right-of-way is to continue in full force and effect so long as said property is used for the above stated purposes and uses and until such time that said right-of-way has been lawfully vacated or abandoned by the duly constituted public authorities, at which time said property shall revert to the person, persons or entity entitled thereto. SECTION 3. That the City Clerk shall cause a certified copy of this resolution to be recorded in the Office of the County Recorder of the County of San Diego evidencing this action. SECTION 4. That said designation and set aside shall be effective upon the filing of said certified copy in the official records of San Diego County.
