RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA WAIVING PARKLAND DEDICATION AND
IN-LIEU FEE REQUIREMENTS FOR A 96-UNIT
AFFORDABLE RENTAL HOUSING PROJECT LOCATED
WITHIN OTAY RANCH VILLAGE 2
WHEREAS, the Quimby Act authorizes cities to require the dedication of land, the
payment of in-lieu fees, or a combination thereof for park and recreational purposes as a condition
of residential development; and
WHEREAS, Chapter 17.10 of the Chula Vista Municipal Code (CVMC) implements the
Quimby Act and requires residential development to dedicate parkland and/or pay in-lieu fees for
parkland acquisition and park development improvements; and
WHEREAS, CVMC Sections 17.10.070(A) and (B) authorize the City Council, by
resolution, to waive all or any portion of parkland dedication, improvements, or in-lieu fee
requirements in the interests of stimulating the construction of housing for low-income families; and
WHEREAS, the developer, Baldwin & Sons, has proposed a 96-unit affordable rental
housing project located on Lot MU-2 within the larger Otay Ranch Village 2 development (the
“Project”); and
WHEREAS, the Project will provide deed-restricted affordable housing units for low-
income households pursuant to a regulatory agreement recorded against the property; and
WHEREAS, Otay Ranch Village 2 is a master-planned community consisting of
approximately 4,202 residential dwelling units, the majority of which are market-rate units subject
to parkland dedication and/or in-lieu fee requirements under CVMC Chapter 17.10; and
WHEREAS, absent a waiver, the Project would be required to dedicate approximately 0.80
acres of parkland and/or pay applicable in-lieu fees for parkland acquisition and park development
improvements at the time of building occupancy; and
WHEREAS, the City Council has considered the staff report, all evidence and testimony
presented, and the applicable provisions of law; and
WHEREAS, the City Council finds that this action is not a project under the California
Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378(b)(4), as it involves
a governmental funding mechanism and does not commit the City to a specific physical project.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista,
as follows:
A. Authority
The City Council has the authority under CVMC Sections 17.10.070(A) and (B) to waive
all or any portion of parkland dedication and/or in-lieu fee requirements, by resolution, in
the interests of stimulating the construction of housing for low-income families.
B. Affordable Housing Benefit
The Project will provide 96 deed-restricted affordable rental housing units, which will
contribute to the City’s housing supply for low-income households and support the City’s
Regional Housing Needs Allocation (RHNA) obligations and Housing Element goals.
C. Public Benefit
The provision of affordable housing constitutes a significant public benefit by increasing
housing availability for lower-income households, reducing housing cost burdens, and
promoting economic and community stability.
D. Financial Feasibility
Affordable housing developments typically rely on multiple financing sources, including
tax credits and public subsidies. The imposition of parkland dedication and/or in-lieu fee
requirements may materially affect the financial feasibility and timely construction of the
Project. The waiver of such requirements will facilitate the development of the Project.
E. Consistency with Quimby Act
The waiver is consistent with the purposes of the Quimby Act in that:
1. Parkland and recreational facilities serving Otay Ranch Village 2 are being
provided through the broader village development framework, including parkland
dedication and fee obligations associated with market-rate units;
2. The waiver will not materially impair the City’s ability to provide park and
recreational facilities to serve the residents of Village 2; and
3. The City retains sufficient mechanisms, including parkland dedication and in-lieu
fees from other development within Village 2, to ensure adequate park facilities are
provided.
F. Nexus and Proportionality
The City Council finds that the waiver is consistent with the requirements of the Mitigation
Fee Act because:
1. The waiver is supported by a clear public purpose - the production of affordable
housing;

2. The reduction or elimination of parkland requirements for the Project does not
result in an unconstitutional taking or otherwise shift a disproportionate burden to
other development.
G. CEQA
The action is not a project under CEQA pursuant to CEQA Guidelines Section 15378(b)(4).
BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista, hereby
waives all of the parkland dedication requirement in the amount of 0.80 acres and in-lieu fee
requirement in the amount of $702,912 applicable to the 96-unit affordable rental housing project
located within Otay Ranch Village 2, as described in the staff report.
