CALL TO ORDER A meeting of the Board of Ethics Subcommittee Interview Panel was called to order at 2:04 p.m. The meeting was recessed at 2:57 p.m. and reconvened at 3:13 p.m. 2. ROLL CALL Secretary Montalvo called the roll. 3. ACTION ITEMS 3.1 Conduct Interviews and Select Attorneys to Serve on the City of Chula Vista's Campaign Contribution Ordinance Enforcement Authority Panel Rob spoke in support of item 3.1. Commissioners reviewed questions and decided on the format. Secretary Montalvo shared that due to extraordinary and unforeseen circumstances impacting travel from Mexico at this time, applicant Leslie Devaney is currently unable to return as scheduled to attend an interview today. She is requesting her interview be re-scheduled upon her return. Due to unforeseen circumstances related to her travel in Puerto Vallarta, her interview will be continued to a special meeting to be scheduled based upon her availability upon return, at which time the Board will complete the interview and finalize the selection process. Our firm has devoted its practice exclusively to advising public agencies throughout California, with deep experience in the areas of municipal governance, transparency, accountability, and ethics that align directly with the Charter-mandated mission of the OCA. We would propose that Partners Leslie E. Devaney and Christina Cameron serve as co-lead attorneys for this engagement. Both have developed extensive expertise in all aspects of municipal and public entity law, including open government compliance under the Brown Act and Public Records Act, conflicts of interest under the Political Reform Act and Government Code section 1090, campaign and disclosure laws, and municipal ethics. Leslie ran for public office (City Attorney of San Diego) in 2003 and 2004. She has 35 years’ experience as a public sector transactional attorney advising consistently on the Brown Act, Public Records Act, FPPC/Conflicts, and general transparency issues including working with the press on items of public interest. Leslie was the Assistant City Attorney advising on transactional issues highlighted in this scope of services for the San Diego City Attorney’s Office from 1996 – 2005 after 10 years of litigation experience in that office. She assisted in the creation of the San Diego Ethic’s Commission in that role and trains routinely with Ms. Cameron in AB1234/Ethics for various agencies. She has been the City Attorney of Del Mar, Murrieta and Encinitas. She has provided special counsel services and advice in these areas for Escondido, San Marcos, Chula Vista, National City, NCTD, Vallejo, Community College Districts, the County of San Diego, the San Diego Ethic’s Commission, and various other public agencies. Leslie has served as an “expert” in litigation for the San Diego Housing Commission on the subject of the Public Records Act. Ms. Cameron brings nearly four decades of local government experience in both legislative and legal capacities, with more than 15 years serving California cities as Assistant City Attorney and General Counsel. She regularly trains elected officials, commission members, and municipal staff in ethics, transparency, and conflict-of-interest laws and is an editor of the League of California Cities’ Municipal Law Handbook, the state’s leading resource on municipal law. She graduated with honors from the University of California, San Diego where she spent 2 of her total 3 years working as a resident advisor on campus. As requested, I am providing the following information on my qualifications and experience: Description of Experience: I have been practicing law for over 40 years and have been a member in good standing of the State Bar of California at all times. My experience is primarily in the civil area as reflected in my attached biography and resume. As it relates to my most relevant experience, I have served on the City of Chula Vista Enforcement Authority Panel for the past eight years reviewing citizen complaints, performing probable cause determinations, and taking further investigatory steps when necessary. In addition to my past service on the Enforcement Panel, my experience in criminal investigation or prosecution work also includes serving as Special Master for State Bar of California. In that capacity, I assist peace officers, primarily the San Diego District Attorney’s Office, in the execution of search warrants seeking documentary evidence in the possession of or under the control of attorneys, physicians, psychotherapists, or clergy. With regard to experience with the rules of civil procedure, I have previously served on the State Bar of California Committee on Administration of Justice and the Committee on Rules and Procedures of Court, both of which evaluated and proposed civil procedure and court rule changes to the courts and legislature on behalf of the State Bar. Fee Schedule: My current hourly billing rate is $300.00. As far as costs, I do not believe there have been any costs incurred in connection with my previous services with the Enforcement Authority Panel for the City. Malpractice Insurance: I currently maintain a Lawyer Professional Liability Coverage policy with National Casualty Company. The limits of liability are one million dollars per claim and one million dollars in the aggregate. I have maintained malpractice insurance at all times since entering private practice over 25 years ago without any claims being made on the policies. Conflicts of Interest: I am unaware of any conflicts of interest with the City of Chula Vista or any members or past candidates of the City Council. Further, I maintain complete independence on the Enforcement Authority Panel as I have never resided in the City of Chula Vista nor have I ever made any campaign contribution to anyone associated with the City. Prior Services to City: I have never provided legal representation to the City other than in my capacity on the Enforcement Authority Panel. Firm/Attorney Resume. Kaufman Legal Group’s overall practice provides deep experience and expertise in campaign disclosure and compliance rules and the enforcement operations of local campaign and government ethics commissions. The firm has two of the leading figures in the State and nation on the operation of campaign ethics commissions and enforcement of campaign laws. Stephen Kaufman and Gary Winuk combined have over a half-century of experience in this field and have been extensively involved in enforcement cases before every local ethics commission in California. Gary Winuk will serve as the enforcement attorney for the City of Chula Vista under the RFP, if Kaufman Legal Group APC is selected. Gary is the former Chief of Enforcement for the FPPC and has worked on a contract basis to provide enforcement advice and services for the San Deigo Ethics Commission, Oakland Ethics Commission, and the San Diego District Attorney’s Office public integrity unit. He has practiced before every campaign and governmental ethics commission in the State and has extensive knowledge of the laws governing these issues and the procedures and practices involved in their enforcement. GARY WINUK – Gary Winuk has extensive experience working with government agencies, in general, and with State and local ethics commissions, in particular. Gary was the Chief of the Enforcement Division for the California Fair Political Practices Commission (FPPC) for six years, managing the statewide enforcement efforts of the State’s campaign and governmental ethics laws. During his tenure at the FPPC, he worked closely with all local ethics agencies to help develop and train their staff and operations. While at the FPPC, Gary was also responsible for the development and implementation of numerous FPPC regulations and FPPC sponsored legislation. Gary has worked extensively as a private sector attorney with numerous local enforcement agencies. He currently serves as Counsel for the San Bernardino Campaign Finance Reform Commission. Gary served as enforcement counsel, on a contract basis, for the San Diego Ethics Commission, where he successfully prosecuted the largest administrative campaign money laundering case in the Commission’s history. He also served as an outside counsel for the San Diego District Attorney’s office public integrity unit. There, he assisted in the criminal prosecution of public officials for conflicts of interest and other violations of law. Gary also previously served as a Deputy District Attorney with the San Joaquin County District Attorney’s office. Gary also worked with Orange County and the City of Sacramento in the development of their Ethics Commissions. Currently, he is assisting Los Angeles County with the creation and development of their County Ethics Commission. Gary practices before every ethics commission in the State, including the San Francisco Ethics Commission, Los Angeles Ethics Commission and the San Jose Ethics Commission. He is a recognized expert in the field of local ethics commissions and is frequently called upon to provide training and public presentations on the topic. Gary also served as an adjunct law professor at McGeorge School of Law, teaching a class on local ethics laws and agencies. STEPHEN KAUFMAN – Stephen Kaufman has decades of experience as a leading attorney in the field of campaign and governmental ethics. He has practiced extensively before the Federal Elections Commission (FEC), the FPPC, and all other local ethics commissions in California. Stephen is regularly called upon to provide advice to local agencies on the development and continued operations of ethics commissions. He has served on numerous statewide task forces related to campaign and ethics laws, including the Secretary of State’s advisory group on reform of the State’s campaign reporting system, and on the FPPC’s enforcement task force to provide input on enforcement policies and procedures. Stephen is an expert on enforcement policies and practices, and represents clients facing enforcement investigations and administrative actions initiated by local ethics agencies. He is a frequent speaker on these topics and a recognized top attorney in this practice area. Recently he has provided expert advice to the County of Los Angeles on the reform of their campaign regulation ordinances, and on the development of their ethics commission and governmental restructuring. He has testified on numerous occasions before ethics commissions across the state and nation. Kaufman Legal Group APC asserts that it does not have any known conflicts of interest in the listed parties or any other known party. 7. Prior Services for the City of Chula Vista Kaufman Legal Group APC has not provided prior legal services to the City of Chula Vista, nor does Kaufman Legal Group currently represent any parties in matters involving the City of Chula Vista. An attorney seeking to serve on the panel should have the following qualifications and experience: (1) A member in good standing of the California Bar for a minimum of ten (10) consecutive years; (2) Experience with municipal or public law entity law, civil litigation, and advising elected officials in their public servant capacity; (3) Experience in some criminal investigation or prosecution work, or a demonstrated understanding of the roles of investigator and prosecutor; and (4) Experience in civil litigation and an understanding of the rules of civil procedure and the local courts. The position and assignment will be on an as-needed basis, with cases assigned to panel attorneys on a randomly selected rotation basis. Fees must be reasonable and consistent with amounts commonly paid for municipal law work. GENERAL EXPECTATIONS In accordance with the Chula Vista Municipal Code, the enforcement authority attorneys’ scope of services may include, but are not limited to, the following: - Review citizen complaints of alleged violations of campaign contribution violations. - Determine whether there is probable cause of a willful or negligent violation of the applicable laws within 30 days of receiving a complaint and notify the City Attorney via a written legal memo if probable cause exists. - If applicable, take further investigatory and procedural steps necessary to resolve the matter. - Advise the City Attorney of all significant developments as they occur in any of the assigned cases, and provide periodic status reports. - Observe the highest professional and ethical standards when representing the City. - Provide any and all reasonably required legal representation on behalf of the City as part of the Campaign Contribution Enforcement Panel, in accordance with Chula Vista Municipal Code section 2.52. SELECTION OF COUNSEL After reviewing the proposals, the Board of Ethics will interview selected applicants during an open public meeting. After interviews, the Board will appoint a panel of no fewer than three Page 36 of 39 City of Chula Vista Board of Ethics Subcommittee Interview Panel March 4, 2026 Agenda -2- attorneys to serve as the enforcement authority. These attorneys, referred to as special counsel, will be compensated by the City for their services. Each case will be assigned to a single member of the panel, with assignments made on a rotating basis. INFORMATION TO INCLUDE IN STATEMENT OF QUALIFICATIONS AND PROPOSAL Please provide the following information for consideration: 1. Firm/Attorney Resume. If submitting on behalf of a firm with designated attorneys, provide a “firm resume” describing the firm’s practice areas that related to the legal experience sought. Please also provide a resume for each firm member that the firm proposes to provide services to the City of Chula Vista as part of the campaign contribution enforcement authority. Individual applicants must provide their resume. 2. Description of Firm/Attorney’s Experience. Please provide a detailed description of each proposed attorneys’ experience and expertise in any relevant areas and in those identified under the above “General Expectations” description. 3. References. Please identify the names of three (3) or more client references, ideally public agency clients, and provide specific information as to services provided to each named reference. Please include the name, address, telephone number and email for the named reference or their point of contact. 4. Fee schedule. Please provide a schedule of services along with the associated fees and costs that the Firm or Attorney would charge to the City of Chula Vista. 5. Malpractice Insurance. Selected panel attorneys must have or procure appropriate and adequate malpractice insurance. Please identify Attorney’s professional liability carrier along with a general description of the type of coverage and limits of coverage. 6. Conflict of Interest. The City will require each Firm and Attorney to provide a statement representing that (1) a diligent conflicts search has been performed to check for conflicts with the City of Chula Vista; and (2) Neither Firm or Attorney is aware of any actual or potential conflicts of interest with the City of Chula Vista or any known candidates at this time.
