Gov. Code § 84308 Regulations: To promote transparency and fairness in the governmental decision-making
process, there are rules to prevent public officials from being unfairly influenced by contributors to their
campaigns. The type of activity these laws were enacted to limit is often referred to as “pay-to-play,” and is
governed in California by Government Code section 84308. Parties to any proceedings involving a “license,
permit, or other entitlement for use,” as that term is defined in the Political Reform Act, pending before the City
Council must disclose any campaign contribution over $500 (aggregated) within the preceding 12 months
made by the party, their agent, and those required to be aggregated with their contributions under Gov. Code
§ 82015.5. The disclosure must include the amount contributed and the name(s) of the contributor(s). "G.C. §
84308 Regulations Apply: Yes" on this agenda indicates that the item is subject to these regulations.
PUBLIC PARTICIPATION
Complete Agenda Packet: The agenda packet, including staff reports, draft resolutions and ordinances, and
other backup materials, is available at chulavistaca.gov/councilmeetings or the City Clerk's Office.

Individuals who use a translator will be allotted twice the time.
General Public Comments: Twenty-one (21) minutes are scheduled near the beginning of the meeting. The
first seven (7) speakers will be heard during the first Public Comment period. If additional speakers are
registered, they will be heard during the continued Public Comment period. If all registered speakers present
at the time address the City Council during the first Public Comment period, there will be no continued period.
Submitting Request to Speak: A request to speak must be submitted to the City Clerk before the close of the
public comment period on an item or before the close of the general Public Comments for non-agenda items.
GETTING TO KNOW YOUR AGENDA
AGENDA SECTIONS
Consent Calendar items are routine items that are not expected to prompt discussion. All items are
considered for approval at the same time with one vote. Before the vote, there is no separate discussion of
these items unless a member of the City Council or staff removes the item from the Consent Calendar.
Public Comment provides an opportunity to address the City Council on any matter not listed on the agenda
that is within the jurisdiction of the City Council. Under the Brown Act, the City Council cannot take action on
matters not listed on the agenda.
Public Hearings are held on matters specifically required by law.
Action Items are items expected to cause discussion and/or action by the City Council but do not legally
require a public hearing.
Closed Session may only be attended by members of the City Council, support staff, legal counsel, and others
specified on the agenda. Closed session may be held in very limited circumstances as authorized by law.
CITY COUNCIL ACTIONS
Resolutions are formal expressions of opinion or intention of the City Council and are usually effective
immediately.
Ordinances are laws adopted by the City Council. Ordinances usually amend, repeal, or supplement the
Municipal Code; provide zoning specifications; or appropriate money for specific purposes. Most ordinances
require two hearings and go into effect 30 days after the final approval.
Proclamations are issued by the City to honor significant achievements by community members, highlight an
event, promote awareness of community issues, and recognize City employees.

Procedural Change For Placing Items On Council Agenda
As your constituent I am reaching out with a request that speaks
directly to fairness, representation, and the trust residents place in their
elected officials. Too many of your constituents hold the opinion that
our City Council simply is unable or unwilling to solve the problems
facing our community.
Why is that? At present, the requirement that a majority of
Council Members must first agree before an item can even appear on the
agenda creates a barrier between residents and their government. Too
often, Chula Vista residents who seek solutions to pressing local
problems find themselves shut out, not because their concerns lack
merit, but because their representative cannot bring the matter forward
without majority approval in advance. True representation means that
every Council Member has a meaningful voice in raising the issues their
constituents bring to them.
The present rule unintentionally stifles open dialogue, prevents
diverse perspectives from being considered, and risks silencing minority
viewpoints. Additionally this procedure allows Council Members a
convenient way to avoid discussing difficult topics.
I respectfully urge the Council to amend its procedural rules so
that any individual Council Member may place an item on a future
agenda for discussion, provided that motion receives a second.

Adopting this change would:
Enhance fairness and transparency by ensuring all voices, both
within the Council and across the community, can be heard.
Encourage healthy debate and accountability, allowing ideas to be
tested in the open rather than filtered behind closed doors.
Strengthen democratic principles by guaranteeing that every
elected representative can fulfill their duty to represent the people
who elected them.
Major California cities, including San Diego and Los Angeles,
already provide this opportunity to their Council Members. Chula Vista
should not lag behind. We should lead in ensuring that our residents
receive fair representation and that no community voice is unnecessarily
muted.
I respectfully ask that you docket this procedural rule change for
consideration at a future meeting, and that you vote to adopt it. By
doing so, you will affirm that in Chula Vista, every resident’s concerns
deserve a path to open discussion.

the people of our city.”

Re: Request to Preserve Evidence for Police Chief Roxana Kennedy
Dear Mayor and City Council:
My firm has been retained by Police Chief Roxana Kennedy to investigate, and if
necessary prosecute, claims related to her employment by the City of Chula Vista (not
including claims being handled by the Law Office of Scott A. O'Mara). I am writing to
request that your agency and all of those under its control preserve in its current form any
evidence regarding the allegations that the Chief has been subjected to improper discipline,
retaliation, discrimination, and/or a hostile work environment, including but not limited to
adverse actions against her as a subterfuge for the desire of a majority of the City Council to
force the Chief into an early retirement and replace her with a Latino (collectively, the
Accusation").
Such evidence includes but is not limited to any information regarding your agency's
disciplinary policies applicable to the Chief, any information supporting the Accusation, any
information refuting the Accusation, any information relating to your agency's investigation
of one or more portions of the Accusation, and any information relating to actions taken by
your agency with respect to others accused of similar acts. The obligation to preserve
information continues until further notice and applies to information currently existing,
information created in the future, and recently deleted information that is recoverable with
reasonably diligent efforts.
This request for preservation of evidence includes but is not limited to preserving all
methods by which information is created or maintained. Such methods include but are not
limited to paper and electronic documents, databases, document -management systems, video
recordings, audio recordings, photographs, electronic images, internet images, instant
messages, text messages, social media, voice mails, e -mails (including message contents,
headers, html source, attachments, and logs of e-mail system usage), electronic calendars and

schedules, metadata, file fragments, browser logs, internet-download logs, internet logs,
browser logs, network access logs, cookies, browser caches, work logs, telephone logs, local
and long-distance telephone records, imaged files and drives, and backup media. The
evidence is to be preserved in its native format, and the request includes preservation of
software, tools, applications, utilities, and the like needed to access the evidence in its native
format. Further, the request includes the suspension of routine document destruction and the
preservation of all evidence created after the date of this letter pending completion of
discovery in anticipated administrative and/or judicial proceedings.
Please keep in mind that the information may be part of, by way of example only,
personnel records, medical records, investigation records, incident reports, interview
statements, interview notes, memos, drafts, meeting agendas and notes, time cards, in/out
records, security logs, security tapes, internet-camera recordings, word-processing
documents, word-processing revision marks and metadata, facsimiles, letters, spreadsheets,
calendars, personal -information management data, training materials, presentation materials,
and expense reports.
Also please keep in mind that electronic data may not only reside on hard drives and
backup media, but also on local servers, remote servers, "cloud" -based servers, home
computers, hard drives of copiers, RAM on printing or facsimile devices, personal digital
assistants (PDAs), cell phones, camera phones, digital cameras, digital recorders, analog
recorders, flash drives, floppy disks, CD-ROM disks, DVD disks, Bernoulli disks, magnetic
tapes, computer chips, metadata, mobile devices such as Iphones or Android phones,
netbooks, laptops, GPS devices, Ipads, tablets, and personal devices of individuals controlled
by your agency; and/or with services such as Facebook, LinkedIn, Dropbox, Google+,
WhatsApp, Signal, MySpace, Gmail, Yahoo Mail, Hotmail, Outlook Mail, and other web -
based messaging services. These devices and services may be controlled directly by your
agency or by individuals under your agency's control. Essentially, evidence maybe possessed
by others, such as outside agents and contractors, former employees, vendors, contractors,
and the like.
Until you fully and completely mirror all electronic data regarding the Accusation, we
request that you not alter any electronic data. Altering electronic data can include backup -
media rotation, electronic data -shredding, scheduled destruction of backup media, re -imaging
of drives, hard -drive exchanges, transfers or destruction of electronic storage devices and/or
systems, and defragmentation of and maintenance routines performed on electronic storage
devices. However, an electronic backup of a hard drive or other electronic device is not
adequate preservation; rather, a mirror or image of a hard drive or other electronic device is
needed such that all areas, used and unused, of the device are preserved. Furthermore, any
deleted files covered by this request that are reasonably recoverable are to be recovered now
to prevent over -writing the file.

Please communicate this request to each individual controlled by your agency who
was involved in conduct covered by the Accusation or who may reasonably be expected to
have created, maintained, or stored any of the information described above.
In addition, please keep in mind that Government Code Section 6200 provides, inter
alia, that every public officer having custody of any record "filed or deposited in any public
office, or placed in his or her hands for any purpose, is punishable by imprisonment [for up
to four years] ... if, as to the whole or any part of the record ... the officer willfully does or
permits any other person to do any of the following: (a) Steal, remove, or secrete. (b)
Destroy, mutilate, or deface. (c) Alter or falsify." Consequently, any recently deleted
information covered by this request should be recovered immediately.
Lastly, I request that all future communications from you agency regarding the
Accusation be directed to me and not the Chief. If you have any questions regarding the
contents of this letter or if you do not understand any portion of it, please contact me
immediately.
